1. GuaranteeinwritingtoOwnerthatallworkperformedandallmaterialsandequipment
furnishedunderthisContractarenewandinaccordancewiththeContractDocuments,
arefreefromdefectsinequipment,materialsordesignfurnished,orworkmanship
performedbyContractororanyofhissubcontractorsorsuppliersatanytier.Such
guaranteeshallcontinueforaperiodnotlessthanone(1)yearfromthedateof
SubstantialCompletionoftheWork,orasotherwiserequiredbythecodesandstatutes
withintheStateinwhichtheProjectislocatedorotherprovisionsoftheContract.
2. Underthisguarantee,Contractoragreestoremedyathisownexpenseanyinferioror
defectiveequipment,materials,workmanship,ordesignthatshoulddevelopduringthe
guaranteeperiod,orinrestoringanyotherworkdamagedinfulfillingthetermsofthe
guarantee.
3. Donotperformanyworkthatshallvoidanymanufacturerguaranteeorwarranty.
C. Manufacturer'sGuaranteeandWarranty:
1. AsidentifiedinotherSectionsofthespecifications,providewrittenmanufacturer's
guaranteesandwarrantiesforspecificmaterials,products,andequipmentfurnishedand
installedunderthisContract.
2. GuaranteesandWarrantiesPeriod:Validfortheperiodoftimestatedineachapplicable
specificationSectionfromthedateofSubstantialCompletionoftheWork,butnotless
thantwelve(12)months.
D. ExtendedWarranties:
1. AsidentifiedinotherSectionsofthespecifications,providewrittenmanufacturer's
guaranteesandwarrantiesforspecificmaterials,products,andequipmentfurnishedand
installedunderthisContract.
2. GuaranteesandWarrantiesPeriod:Validforthestatedextendedperiodbeyondtwelve
(12)monthsfromthedateofSubstantialCompletionoftheWork.
E. Exclusions:
1. Warrantyrequirementscontainedinthespecificationstakeprecedence. These
exclusionsaresupersededbywarrantycoveragerequirementsofthespecifications.
2. NotifyArchitectofdesignconditionswhichcannotbefullywarranted. Submitnoticein
writingpriortopurchaseoftheaffectedproductorsystem.
3. Failuretoprovidesuchnoticewillnotbegroundsforwaiverofwarrantyrequirements
containedinthespecifications.
4. Uponreceiptofsuchnotice,Architectwillconsidermodificationsnecessarytoassurethat
finalconstructioniswarrantabletothefullextentofContractrequirements.
1.5 WORKBYOWNER
A. Certainelements,materials,andtasksfortheprojecthavebeenidentifiedasbeing"Notin
Contract"(N.I.C.),"ByOthers,"or"ByOwner." Suchmaterialsandlaborwillbeprovidedby
othersinamannerandschedulewhichisnotintendedtoimpedetheprogressoftheWork
underthiscontract.

1. CoordinateconstructionschedulewithOwner,andgiveadequatenoticeastowhenother

B. Ownerwillsupplyandinstallthefollowing:

1.6 OWNEROCCUPANCY

1. ConstructionOperations: Minimizeinterferencewithnormalfunctioningofbuildingand
occupants.
2. Limitnoise. Radiosarenotpermitted. Ifconstructionactivitieswillproducenoisewhich
isdetrimentaltotheoperationofthefacility,scheduletheseactivitiesduringnon-
occupiedhours.
3. Protectentrances,exits,walkways,andotherareasinthevicinityoftheconstruction
subjecttousebythepublicfromfallingobjects,orappropriatelybarricadeaccordingto
governingregulations.
B. OwnerintendstooccupytheProjectuponSubstantialCompletion.
C. CooperatewithOwnertominimizeconflictandtofacilitateOwner'soperations.
D. ScheduletheWorktoaccommodateOwneroccupancy.

G. SpecialRestrictions:
1. Contractorpersonnelareprohibitedfromexistingbuildinginteriorsexceptasrequiredto
executespecificworkindicatedonDrawings.
2. Contractorisprohibitedfromutilizingthebuilding'scomputers,phonesandinternet
access.
3. Contractorandassociatedpersonnelandsubcontractorsarenotpermittedtouse
existingandnewtoiletfacilitiesandservicesinksinthebuildingforpersonaluse,for
cleaningtools,orfordisposingofconstructionwastematerials.
4. NoconstructionwastematerialsmaybedisposedofinOwner'sdumpstersorother
Ownercontainers.
5. Controlsmoke,dust,dirt,odorsandotherobjectionableeffects,andlimittothe
immediateareaofconstruction. Contractorisresponsibleforcleaningotherareas
affectedbynoncompliancewiththisrequirement,includingcontentsofaffectedareas.
6. Cleanworkareasofdebris,and"broomclean"nolessfrequentlythanattheendofeach
workday. Removealldebrisfromexteriorsiteareaswhichcouldbewindblown. See
Section017000foradditionalrequirements.
1.8 DELEGATEDDESIGNWORK
A. Designofproductsandsystems,orcomponentsofproductsandsystems,specifiedtobe
providedbyContractorareidentifiedinindividualspecificationSections.
B. Contractor'sResponsibilities:
1. Complywithspecifieddesignrequirementsforeachapplicableproductorsystem.
2. CoordinatedesignandspacerequirementswithotheraffectedworkandArchitect.
3. ReviewapplicablesubmittalsandcoordinateselectionswithArchitect.
4. Receiveandunloadproductsandsystemsatthesite;inspectforcompletenessandfor
damage.
5. Handle,store,install,andfinishproductsandsystems.
6. Repairorreplacedamaged,defective,ormissingitems.

supplementalinstructions,othermodificationdocuments,andthestatusofallowances,
includingOwner'scontingencyallowance.

orreviseddrawingsandspecifications.Contractorshallprepareandsubmitafixedprice
quotationwithin10days,estimatinganychangestoContractSumandContractTimefor
executingthemodification. Contractor'squotationshallstipulateanyovertimeworkrequired
andtheperiodoftimeduringwhichtherequestedpricewillbeconsideredvalid.
G. Contractormayproposeachangebysubmittingarequestforchangeorderormodificationto
Architect,describingtheproposedchangeanditsfulleffectontheWork,withastatement
describingthereasonforthechange,andtheeffectontheContractSumandContractTime
withfulldocumentationandastatementdescribingtheeffectonWorkbyseparateorother
contractors.
1. ThetimerequiredfortheOwner,Architect,and/orprojectteamtoreviewproposed
changeorderscannotbeattributedtoconstructionprojecttimeframedelayorproject
timeframeextension.

a. Quantitiesofproducts,labor,andequipment.
b. Taxes,insurance,andbonds.
c. Overheadandprofit.
d. JustificationforanychangeinContractTime.

2. Supporteachclaimforadditionalcostswithadditionalinformation:
a. Originanddateofclaim.
b. Datesandtimesworkwasperformed,andbywhom.
c. Timerecordsandwageratespaid.

3. ForTimeandMaterialwork,submititemizedaccountandsupportingdataafter
