Notice To Bidders
The Town of Colonie (“Town”) invites bids for the following:
RFB: Asphalt Sealcoating and Striping at the Police Training Facility DB397
Sealed bids will be received at the Office of Purchasing, Memorial Town Hall, Latham, NY
12110 until September 2, 2026 10:00 AM local time. At that time and place all bids will be
publicly opened and read aloud.
All bidders shall comply with the N.Y. Gen. Mun. Law §103.
Beginning on August 19, 2026, the solicitation documents for this matter will be on file and
publicly exhibited at the Office of Purchasing, 534 New Loudon Road, Memorial Town Hall,
Latham, NY 12110. Copies of said documents may be obtained at that address. Complete bid
documents may also be available for download from the Empire State Purchasing Group’s web
site at http://www.bidnetdirect.com/new-york.
Bids shall be submitted at the time and place indicated in the Notice to Bidders and shall be
enclosed in an opaque, sealed envelope. The opaque envelope shall be marked on the outside
with the project title and name and address of the bidder. The submission shall consist of the
completed pages of this document marked “TO BE SUBMITTED,” and any other required
documents. The submission shall also include, if required in the Notice to Bidders, the bid
security. If the bid is sent through the mail or other delivery system, the sealed envelope
containing the bid shall be enclosed in a separate envelope with the notation "BID ENCLOSED"
on the face thereof AND the outer envelope shall be marked on the outside with the project title
and name and address of the bidder.
Each submitted proposal must be accompanied by (a) a certified check in the sum of 5% of the
amount of the bid, drawn upon a national or state bank or trust company, to the order of the
Town of Colonie, New York, or (b) a bond with sufficient sureties in a penal sum equal to 5% of
the bid, conditioned that if its bid is accepted, successful bidder will enter a contract for the
same and that he will execute such further security as may be required for the performance of
the contract.
At the execution of the anticipated contract, the Successful Bidder will be required to furnish a
performance bond equal to 100% of the full amount of its bid; provided that with the approval of
the Town, the Successful Bidder may be allowed to substitute, as an alternative to the
performance bond, an indemnity agreement acceptable to the Town along with cash, an
irrevocable letter of credit from a banking organization, or a certified check.
At the execution of the anticipated contract, the Successful Bidder will be required to furnish a
labor and materials payment bond in an amount equal to the full amount of its bid.
The bidder to whom the contract may be awarded shall within seven days after the date of
notification of the acceptance of its proposal, provide insurance and security as required by the
contract in a form acceptable by the Town of Colonie. In case of its failure to do so, or in case
of its failure to give further security as herein prescribed, the bidder will be considered as having
abandoned the same, and the certified check or other bid security accompanying its proposal
shall be forfeited to the Town of Colonie.
The Town of Colonie reserves the right to waive any informality in or to reject any or all bids
submitted.
Please Note: The Town will host a meeting for all potential Bidders at 10:00 AM on Monday,
August 24, 2026. Attendance at this meeting is mandatory for Bidders,
and a Bid from a bidder who did not attend this meeting will not be accepted by the
Town. The meeting will take place at the Police Training Facility located at 102 Onderdonk Ave,
Latham, NY 12110. Attendees will be given opportunities to make investigations and pose
questions about the project.
