NOTICE TO BIDDERS
SEALED PROPOSALS will be received by the City of San Juan addressed to Lori A. Maldonado, Purchasing Agent,
no later than August 18, 2026 at 10:00 a.m. for furnishing all labor, materials, supplies, and supervision necessary
for the Re-Bid of Wastewater Treatment Plant Improvements, Phase Two - Rehabilitation of Existing Facilities
Revised Project, Texas Water Development Board CWSRF Project No. 73796, RFP NO. 26-006-08-18 located in
the City of San Juan, in accordance with plans and specifications. Bid proposals shall be submitted at the City
of San Juan City Hall office located at 512 S. Nebraska, San Juan, Texas 78589. Bids received will be opened and
read publicly. Any bid received after the closing time will not be accepted and returned to the bidder unopened. The
bids shall be addressed as follows:

Summary of Work: Rehabilitation of Existing Wastewater Treatment Plant Facilities
Equipment and Related Appurtenances
PLANS AND SPECIFICATIONS may be obtained at 1004 W. Frontage Rd, Alamo, Texas, 78516 for the purchase
price of $300.00 for each set of documents. This payment represents reproduction costs and is non-refundable. If
requested, the documents will be promptly dispatched by courier at the expense of the bidder, but no liability can be
accepted for loss or late delivery. No refunds will be made.
A Pre-bid Conference shall be held on August 4, 2026 at 10:00 a.m. at the San Juan City Hall EOC Conference
Room, 512 South Nebraska, San Juan, Texas
A CERTIFIED OR CASHIER'S CHECK, or an acceptable BID BOND in an amount not less than five percent (5%)
of the total bid shall accompany each bid proposal as a guarantee that, if awarded the contract, the bidder will
promptly enter into contract with the City of San Juan and furnish performance and payment bonds on the forms provided.
CONTINGENT AWARD OF CONTRACT. This CONTRACT is contingent upon release of funds from the Texas Water
Development Board. Any contract or contracts awarded under this Invitation for Bid (IFB) or Request for
Qualifications (RFQ) are expected to be funded in part by financial assistance from the TWDB. Neither the U.S.
Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees,
are or will be a party to this IFB, RFQ, or any resulting contract.
AMERICAN IRON AND STEEL. Any contract(s) awarded under this Invitation for Bids is/are subject to the American
Iron and Steel (AIS) requirements of Section 608 of the Federal Water Pollution Control Act.
EQUAL EMPLOYMENT OPPORTUNITY. All qualified Applicants will receive consideration for employment without
regard to race, color, religion, sex (including pregnancy), sexual orientation, gender identity, national origin, age (40
or older), disability, or genetic information. Bidders on this work will be required to comply with the Department of
Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which
include the President's Executive Order No. 11246, as amended by Executive Order No. 11375 and Executive Order
No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements.
Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of
the awarded financial assistance.

DAVIS-BACON WAGE REQUIREMENTS. Davis-Bacon prevailing wage requirements apply to the construction,
alteration or repair of treatment works carried out, in whole or in part, with assistance made available by the Clean
Water State Revolving Fund (CWSRF) or a construction project financed, in whole or in part, from the Drinking Water
State Revolving Fund (DWSRF).
The Davis-Bacon prevailing wage requirements apply to Contractors and Subcontractors performing on federally
funded or assisted contracts in excess of $2,000 for the construction, alteration or repair (including painting) of a
treatment works project under the CWSRF or a construction project under the DWSRF.
For prime contracts in excess of $100,000, Contractors and Subcontractors must also, under the provisions of the
Contract Work Hours and Safety Standards Act, as amended, pay laborers and mechanics, including guards and
watchmen, at least one and one-half times their regular rate of pay for all hours worked over 40 in a workweek. The
Fair Labor Standards Act may also apply to Davis-Bacon covered contracts.
THE SUCCESSFUL BIDDER will be required to furnish a Performance Bond and a Payment Bond, each in the amount
of the contract, written by a responsible surety company authorized to do business in the State of Texas, and
satisfactory to the City of San Juan as required by Article 5160, V.A.T.C.S.
IN CASE OF AMBIGUITY or lack of clearness stating the price in the bids, the City of San Juan reserves the right to
consider the most advantageous construction thereof, or to reject all bids.
THE CITY OF SAN JUAN reserves the right to reject any or all bids, waive any or all informalities, and to award the
contract to the bidder or bidders, who, in the opinion of the City of San Juan offer the proposal in the best interest
of the City of San Juan.
BIDDERS are cautioned that conditional or qualified bids, or bids not in the proper form may be rejected.
BIDDERS will be allowed to modify and/or withdraw bids prior to date of bid submission and receipt.
BIDS may be held by the City of San Juan for a period not to exceed 90 days from the date of the bid opening.
