Bozeman WRF MCC Upgrade – InstallationThe City of Bozeman, Montana (Owner) is requesting Bids for the construction of the following Project:
Bozeman WRF MCC Upgrade - Installation
Owner’s Project No.: WW121 | Engineer’s Project No.: P05097-2022-012
The OWNER will only be accepting online electronic bids through QuestCDN. Electronic plan download and electronic bidding can be completed through QuestCDN for a fee of $45.00. To access the electronic bid form, download the project documents and click the online bidding button at the top of the advertisement. For electronic bids, scans of required electronic bid documents will be accepted. Bids will be received by QuestCDN until 2:30 PM on Thursday, July 24, 2025. At that time, the bids will be opened and read publicly over a virtual video conference – a link to which will be distributed to all registered plan holders no later than 24 hours before the bid opening and will also be made available through the Project Listing on QuestCDN for the general public’s viewing access. (See “Obtaining the Bidding Documents” below).
The Project includes the following Work:
Perform the duties of Installation Contractor to install equipment procured through the Bozeman WRF MCC Procurement Contract as well as the duties of Contractor of this Construction Contract which generally consists of acting as the General Contractor or Prime Electrical Contractor to complete planning, scheduling, demolition, installation, commissioning, closeout and other construction administration duties for the replacement of three (3) Motor Control Center (MCC) assemblies at the Bozeman Water Reclamation Facility (WRF). The three MCCs control the following critical unit processes: MCC-1 – Unitrol TM , controls miscellaneous pumps with 4+ motors totaling 73.5 hp; MCC 2 – anaerobic digester boiler room, controlling 8+ motos with a total load of 57.4 hp; and MCC-3 – gravity thickener and secondary clarifiers, controlling 4+ motors with a total load of 2.75 hp.

Bidding Documents may be downloaded from the designated website for a fee of $45.00. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.
Bidding Documents may also be examined at the following locations: Builders Exchanges in Billings, MT; Bozeman, MT; Great Falls, MT; Helena, MT; and Missoula, MT. All Work shall be done according to the Bidding Documents.

PROCUREMENT CONTRACT TO BE ASSIGNED
Owner as “Buyer” has executeda procurement contract with The Third Element, Inc. as “Seller” for the procurement of goods and special services forBozeman WRF MCC Procurement. The materials and equipment to be provided through the procurement contract are to be furnished and delivered to the Sitefor installation by Contractor. Owner will assign said procurement contract to Contractor as set forth in the Agreement. Contractor will accept the assignment, as Buyer (Contractor/Assignee), and will be responsible to Owner for the performance of obligations by Seller, which will become a Subcontractor or Supplier to Contractor.
Bidders may examine the contract documents for the procurement of goods and special services for Bozeman WRF MCC Procurement in “Section 00 73 26” of this Project Manual.
Pre-bid Conference
No Pre-Bid Conference will be held for this project. If Bidders wish to coordinate a site visit, please do so by contacting the Engineer with the Contact Information provided in the Instructions to Bidders.
Bid Security
Bid security shall be furnished in accordance with Instruction to Bidders.
Contractor Registration:
CONTRACTOR and any of the CONTRACTOR’S subcontractors bidding or doing work on this project will be required to be registered with the Montana Department of Labor and Industry (DLI). Forms for registration are available from the DLI, PO Box 8011, 1805 Prospect, Helena, Montana 59604-8011. Information on registration can be obtained by calling (406) 444-7734. CONTRACTOR is not required to have registered with the DLI prior to bidding on this project, but must have registered prior to execution of the Construction Agreement.
Montana Prevailing Wage Rates:
All laborers and mechanics employed by CONTRACTOR or subcontractors in performance of the construction work shall be paid wages at rates as may be required by the laws of Gallatin County and the state of Montana.
Non- Discrimination
City of Bozeman is an Equal Opportunity Employer. In submitting its bid, the bidder affirms it will not discriminate on the basis of race, color, religion creed, sex, age, marital status, national origin, or because of actual or perceived sexual orientation, gender identity, or disability in the performance of work performed for the City of Bozeman, if a contract is awarded to it, and also recognizes the eventual contract, if awarded, will contain a provision prohibiting discrimination as described above and that this prohibition shall apply to the hiring and treatment of the bidders employees and to all subcontracts it enters into in the performance of the agreement with the City of Bozeman.
As such, each entity submitting under this notice shall include a provision wherein the submitting entity, or entities, affirms in writing it will not discriminate on the basis of race, color, religion, creed, sex, age, marital status, national origin, or because of actual or perceived sexual orientation, gender identity or disability and which also recognizes the eventual contract will contain a provision prohibiting discrimination as described above and that this prohibition on discrimination shall apply to the hiring and treatment of the submitting entity’s employees and to all subcontracts.
In addition, pursuant to City Commission Resolution 5169 , the entity awarded a contract under this project and any subcontractors must abide by the Equal Pay Act of 1963 and Section 39-3-104, MCA (the Montana Equal Pay Act), and affirm it will abide by the above and that it has visited the State of Montana Equal Pay for Equal Work “best practices” website , or equivalent “best practices publication and has read the material.
Such affirmations shall be written using Section 00 45 14 (found in Appendix A – Project Forms).
Non-Collusion:
Each Bidder must submit a signed Non-Collusion Affidavit with its bid, as provided in Section 00 45 15 (Found in Appendix A – Project Forms). The affidavit confirms that the bid has been prepared and submitted without collusion, fraud, or improper conduct. Bidders are responsible for reviewing the full affidavit language in the Instructions to Bidders.

Rights Reserved.
The City of Bozeman reserves the right to reject any and all Bids, to waive irregularities and informalities, to postpone the award of the contract for a period not to exceed sixty (60) days, and to Award the Contract to the Lowest responsive and responsible Bidder which is in the best interest of the Owner. The Work must be completed in accordance with the dates outlined in the Agreement.
