Summary

The proposed contract action is for product or services for which the City of Pembroke Pines intends to negotiate and award with only one source under the authority of the City of Pembroke Pines Code Section 35.18 (C) (3) City standard, single-source and sole-source commodities or services. Any responses received as a result of this Notice of Intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Responses will not be considered as proposals, bids, or quotes.

The Procurement Department has received a request to make the following sole-source procurement:

Requesting Department/Office: Recreation & Cultural Arts

Product and/or services to be purchased: Precision sidewalk trip hazard evaluation and remediation services, including on-site sidewalk surveys, measurement and documentation of trip hazards, ADA-compliant precision concrete grinding to remove vertical height differentials, dust-controlled cutting methods, photographic documentation, hazard mapping, and final reporting for City park and recreational facilities.

Sole Source Justification: The Recreation Department requires a specialized method of sidewalk trip hazard removal that reduces liability, improves pedestrian safety, and maintains ADA compliance without requiring full sidewalk replacement. The Department reviewed available options and determined that most sidewalk contractors can only provide complete concrete panel removal and replacement, which is significantly more costly, disruptive to park operations, and time-consuming. Florida Sidewalk Solutions utilizes proprietary and patented equipment and methodologies licensed exclusively through Precision Concrete Cutting for the measurement and removal of sidewalk trip hazards. These patents cover the tools, techniques, and dust-abatement processes used to precisely grind and correct vertical sidewalk displacements while preserving the existing concrete slabs. Precision Concrete Cutting is the only company authorized to perform this patented process, making Florida Sidewalk Solutions the sole provider capable of delivering this specific service. The Recreation Department evaluated whether other vendors could provide an equivalent solution and found that while alternative contractors could replace sidewalks, they cannot legally or technically replicate the patented trip hazard removal method. Additionally, the vendor’s proprietary inspection and reporting system (GPS mapping, measurements, photos, and audit-ready reports) supports the claim that the full scope of services cannot be replicated by other vendors. Moreover, the patented process allows the City to correct hazards efficiently, minimize downtime in active park areas, reduce overall project costs, and maintain consistent documentation and reporting standards. As a result, Florida Sidewalk Solutions is the only vendor capable of meeting the City’s operational, safety, and compliance requirements for this service.

Action To Be Taken: No action is required if you agree this proposed purchase is a valid sole-source. If you do not agree that this proposed purchase is a sole-source, you may respond by submitting in writing through OpenGov with the vendor’s name, address, point-of-contact, telephone number, email, and a statement regarding the capability to provide the specified procurement. Interested vendors will be considered only if they respond with clear and convincing documentation that they are capable of meeting or exceeding the requirements stated herein. All responses received by 2:00 pm on Wednesday, January 7, 2026 will be reviewed by the City.
