1 Scope of Bid
The City of Des Moines Public Works Department is soliciting sealed bids from qualified companies for Hot Mix and
Warm Mix Asphalt Mixtures per the terms, conditions, and specifications of this Request for Bid.
2 No Contact Policy
Any contact initiated by the bidder or by a City representative, other than the Procurement Division representative
listed herein, concerning this Request for Quotation is prohibited. Any such unauthorized contact may cause the
disqualification of such bidder's quote from acceptance or consideration.
Following the submittal deadline, Bidders shall not contact the Procurement Division or any other City employee
or representative except to respond to a request by the Procurement Division.

3 Contract Term
The contract shall commence upon effective date of signed contract purchase order.
The initial term of the contract will be for a period of three (3) years with the option to renew for an additional three
(3) year period upon mutual agreement of the parties.
No price escalation will be allowed during the initial term of the contract.
Requests for proposed price changes after the initial term of the contract must be submitted in writing to the Buyer
ninety (90) calendar days prior to the contract start date. The City reserves the right to accept or reject price
increases, to negotiate more favorable terms, or to terminate without cost, the future performance of the contract.
4 General Specifications Flexible Pavement Mixtures
GENERAL
All materials supplied under this bid shall conform to the Statewide Urban Design and Specifications (SUDAS)
Manual, 2025 Edition. The Special Provision listed below shall supplement and take precedence over the above-
mentioned specifications.

Provisions Technical Specifications for Flexible Pavement Mixture
No. 1 February 2021- see Section 8
POINT OF DELIVERY
All hot mix asphalt (HMA) mixtures shall be F.O.B. plant site, loaded by the supplier into City of Des Moines trucks.
HOT MIX ASPHALT PLANT CAPACITY
The plant producing the HMA shall be capable of supplying to City of Des Moines trucks a minimum of 1,000 tons of
HMA during a working day. For the purpose of this section, a working day shall be defined as a maximum of a twelve
(12) hour period. The City of Des Moines does not guarantee that it will take 1,000 tons of HMA per day from the
supplier, nor does it specify any minimum tons per day.
The City of Des Moines reserves the right to determine and designate the amount of material to be supplied per
day, but not to exceed the specified rate. The City will notify the supplier a minimum of 24 hours in advance of the
amount and the type of HMA that will be required from the supplier in setting up daily operations. The supplier’s
plant shall be designed so that it can produce any or all the mixtures specified on any given day. If the primary
supplier is unable to supply the material in a timely manner on any given day, the City reserves the right to
purchase the material from the secondary supplier on that day.
HOT MIX ASPHALT PLANT INSPECTION
The City of Des Moines Public Works Department, or its authorized representative, shall have access at any time to
all parts of the HMA production plant in order to ensure the manufacture of the mixtures in strict accordance with the
specifications. In order that accurate and sufficient samples of aggregate may be obtained from the heated
aggregate bins, easy and safe access shall be provided to the sample location at the plant.
COMPLIANCE WITH O.S.H.A.
The supplier/contractor certifies that all services delivered comply with the Federal Occupational Safety and Health
Act of 1970, as applicable.
HOT MIX ASPHALT PLANT LOCATIONS
The City of Des Moines will consider the distance to plant site in determination of submitted bids. All pick-up
locations must be located within a ten (10) mile radius of the Des Moines metro area. Bidders must designate the
location of the plant site where pick up of the material will occur in Attribute #21.

BID QUANTITIES AND TERMS
Bid prices are to be firm for the initial contract period. Bid escalation clauses for Flexible Pavement Mixtures will not
be accepted. The bidder can bid one or more or all of the bid items indicated.
It is understood that the quantities are estimated for the purpose of this Request for Bid. The City reserves the right
to increase or decrease estimated quantities without adjustment in bid price or eliminate purchase of any item. It is
also understood that the bidder may be designated as the primary supplier or as an alternate supplier of the item
bid.
METHOD OF MEASUREMENT AND BASIS OF PAYMENT
The quantity of HMA mixtures, F.O.B. City Truck, will be measured in tons, net weight. This net weight will be
obtained from scale weights of individual truck shipments.
For the number of tons of HMA mixtures of acceptable quality, measured as prescribed above, the contractor will be
paid the unit price bid per ton. This payment will be full compensation for mixing and placing the mixtures in City
trucks and for furnishing all equipment, materials, and labor required. No separate payment will be made for the
asphalt binder contained in the mixtures.
AWARD - REJECTION
The City of Des Moines reserves the right to identify multiple suppliers, including but not limited to, a primary
and secondary supplier for each item bid. In the event the primary supplier is not deemed responsible, or the
character or quality of the services, including delivery times, supplies, materials, or equipment, does not conform to
the City's requirements or if the public interest may otherwise be served thereby, the City will reject the primary
supplier. In the event the primary supplier is rejected for any of the above reasons, the secondary and alternate
suppliers may be awarded part or the remainder of the bid quantities.

5 Special Provision Technical Specifications
FLEXIBLE PAVEMENT MIXTURE
1. Description
This project involves designing, producing, placing, and compacting flexible paving (HMA and warm mix asphalt
(WMA)) mixtures in accordance with Section 2303 of the Iowa Department of Transportation Standard
Specifications. Use proper quality control practices for the construction of surface or base course on a prepared
base or pavement to the dimensions specified in the contract documents.
Once production of mix for an individual street has begun with a WMA technology, WMA shall be used to complete
that street unless otherwise approved by the Engineer. The WMA shall meet the same requirements established for
conventional HMA mixtures including production, placement, performance characteristics, strength, and durability.
2. Asphalt Plant
The Contractor shall furnish a plant inspector certified by the Iowa Department of Transportation at the Contractor's
expense to ensure compliance to the approved mix design(s). The hot mix asphalt plant shall be capable of
supplying to the work sites a minimum of 1000 tons of hot mix asphalt during a working day. For the purpose of this
section, a working day shall be defined as a maximum of a twelve (12) hour period.
3. Mix Design
Two (2) weeks prior to supplying any asphaltic concrete, the Supplier shall submit an HMA mix design for each mix
bid to the Public Works Department for review and approval. If the supplier changes any mix design, the revised mix
design shall be submitted to the Public Work Department for approval prior to use. Upon approval of the mix
design(s) by the Public Works Department, the Supplier may begin supplying asphaltic concrete mixes. The cost of
HMA mix design(s) shall be included in the unit price bid for each mix.
4. Bituminous Materials
The PG grade for Surface mixes shall be PG 64-22. This PG grade may be lowered depending on the amount and
source of the recycled binder. Refer to Iowa DOT I.M. 510 for the requirements on adjusting the PG grades. The PG
grade for Base mixes shall be PG 58-28.
5. Quality Control
The Supplier shall provide quality control management, provide sampling, provide testing, and maintain the quality
characteristics to meet all levels of tolerances and specifications. The Supplier shall perform the sampling and
testing to provide quality control of the asphalt binder and Flexible Pavement Mixture that conform to Urban
Standard Specifications for Public Improvements, including all subsequent current revisions. The cost of all
sampling and testing shall be included in the unit price bid for the flexible pavement mixture. The City may take
samples at the plant site for independent testing.
6 Withdrawn bids
Bids may not be withdrawn for sixty (60) days from the due date to allow for a full evaluation and to make an award
deemed in the best interests of the City of Des Moines.
