Comments/objections will be received as required per Section 31-7-13 (C) of the Mississippi Code until
8:00 a.m. (Central Time) on August 27, 2026.
Any person or entity that objects and proposes that the commodity listed is not sole source and can be
provided by another person or entity shall submit a written notice to:

Appropriate documentation shall also be submitted if applicable.
If after a review of the submitted notice and documents, USM determines that the commodity in the
proposed sole source request can be provided by another person or entity, then USM will withdraw the
sole source request publication from the procurement portal website and submit the procurement of
the commodity to an advertised competitive bid or selection process.
If USM determines after review that there is only one (1) source for the required commodity, then USM
will appeal to the Public Procurement Review Board. USM will have the burden of proving that the
commodity is only provided by one (1) source.

The University of Southern Mississippi anticipates purchasing the item(s) listed below as a sole
source purchase. Anyone objecting to this purchase shall follow the procedures outlined below.
1. Description of the commodity that USM is seeking to procure:
The School of Mathematics and Natural Sciences seeking to procure the Xenon
EPR Software upgrade and associated installation services from Bruker BioSpin
Corporation for the existing Bruker EMXmicro Electron Paramagnetic Resonance
(EPR) Spectrometer. The upgrade will modernize the instrument's operating
software, improve system performance and functionality, ensure continued
compatibility with the existing hardware, and maintain manufacturer-supported
operation.
2. What efforts were made by the Agency to determine that the proposed provider is the
only entity that can provide the commodity needed?
The department reviewed available alternatives and confirmed that Bruker
BioSpin Corporation is the original equipment manufacturer (OEM) of the Bruker
EMXmicro EPR Spectrometer. The Xenon EPR Software is proprietary to Bruker
and is only available through the manufacturer. No third-party vendors are
authorized to provide, install, or support this software upgrade while maintaining
compatibility with the existing instrument and preserving manufacturer support.
3. What efforts were made to ensure the best possible price for the commodity was
obtained?

The department obtained a detailed quotation directly from Bruker BioSpin
Corporation, the sole manufacturer and authorized provider of the Xenon EPR
Software upgrade. Because Bruker is the exclusive source for this proprietary
software and installation service, competitive quotations are not available. The
quoted price reflects the manufacturer's established pricing for the software,
installation, and technical support required for this upgrade.
4. Why is the commodity the only one that can meet the needs to the Agency?
The Xenon EPR Software is specifically designed to operate with the University's
existing Bruker EMXmicro EPR Spectrometer and is required to maintain full
functionality, compatibility, and manufacturer support. No equivalent software
from another vendor can interface with or control the instrument. Using an
alternative product would result in compatibility issues, loss of manufacturer
support, increased risk of system failure, and potential disruption to research and
instructional activities.
5. Why is the amount expended for the commodity reasonable?
The total cost of $11,505.10 is reasonable because it includes the proprietary
software upgrade, manufacturer installation, system integration, testing, and
technical support provided by Bruker BioSpin Corporation. Upgrading the
existing instrument is significantly more cost-effective than replacing the
spectrometer, which would require a substantially greater capital investment. The
upgrade extends the useful life of the equipment, maintains operational reliability,
and supports the University's ongoing research and instructional mission.
