INVITATION TO BID
The Calhoun County Commission (“County”) will be accepting sealed bids for the use of the
batting cage facility located at the Calhoun County Sports Complex, 901 Glade Road E., Anniston,
AL 36206 (“Facility”) for the sole purpose of training, batting practices, and activities relating to
those activities. Bids will be received at 1702 Noble Street, Suite 103, Anniston, Alabama 36201,
until Tuesday, July 21st, 2026, at 2:00p.m. The Contract period will be for one three-year period,
upon the execution of the Agreement, subject to termination provisions as provided in the Use and
License Agreement, if any. The bids are subject to all conditions and instructions as stated herein.
GENERAL
Each Bidder is required to state compliance with each requirement as contained herein. The
Invitation to Bid (“ITB”) responses must be received as herein provided on or before the date and
time shown herein. Responses not received by this date and time will be automatically disqualified
from consideration.
Attached is a copy of the description of the Batting Cage Facility, as Exhibit A, located at the
Calhoun County Sports Complex. The Calhoun County Commission reserves the right to reject any
or all bids. Bid awards will be in the best interest of the Calhoun County Commission. Questions
concerning the Batting Cage Building should be directed to Lisa Mullinax, the Director of Calhoun
County Sports Complex/Woodland Park, sometimes herein referred to as “Director”, telephone
number (256) 342-5068.
The Selected Bidder will, by accepting this bid award, agree to the following: By signing
this contract, the contracting parties affirm, for the duration of the agreement, that they will not
violate federal immigration law or knowingly employ, hire for employment, or continue to employ
an unauthorized alien within the state of Alabama. Furthermore, a contracting party found to be in
violation of this provision shall be deemed in breach of the agreement and shall be responsible for all
damages resulting therefrom.
The Selected Bidder must complete all necessary paperwork required by the County for
verification of enrollment in the e-verify program to verify full compliance with the Immigration
Reform and Control Act of 1986, as amended by Immigration Act of 1990 and the Beason-Hammon
Alabama Taxpayer and Citizen Protection Act, as amended.
The Selected Bidder will, by accepting this bid award, agree to the following: By accepting
the bid award, the contracting parties affirm, for the duration of this agreement to remain in
compliance with Act 2016-312, the Parties hereby agree that they are not currently engaged in, and
will not engage in, the boycott of a person or an entity based in or doing business with a jurisdiction
with which this state can enjoy open trade.
BID AWARD
All factors stated in this ITB will be evaluated in determining the Selected Bidder. Any
omission(s) of the herein stated requirements may be cause for rejection of the bid(s) submitted, at
the sole discretion of the Commission.
The Commission reserves the right to evaluate bids for correctness and completeness, and to
award the bid at any time within ninety (90) days following the bid opening.
The Commission reserves the right to reject all bids, to waive any defects and/or
technicalities in the formality in bids, and to accept in whole or in part, such bid or bids, solely at its
discretion.
Bid will be awarded to the most responsive, responsible bidder with the highest bid amount
for leasing/permit of the facility.
MISCELLANEOUS REQUIREMENTS
The Selected Bidder, if any, shall execute a Use and License Agreement upon award, if any,
similar to the attached draft.
The Selected Bidder shall be granted an exclusive Lease and Permit for the use of the
aforementioned County owned batting cage Facility. The Selected Bidder may use said Facility for
training purposes in direct relation to batting training and/or practices.
The Selected Bidder, may, but shall not be required to make additions and/or improvements
to the current state of the Facility, such as adding required netting, but only upon the County’s prior-
approval. County’s prior approval must be given by the County Administrator and/or his designee.
Any additions and/or improvements shall be at the sole cost of the Selected Bidder. All additions
and/or improvements permanent in nature become County’s property. The County shall not be
required to reimburse the Selected Bidder for any property additions/improvements upon the
expiration of the Lease/Permit.
At all times during the term o f t h e a g r e e m e n t , the Selected Bidder, at the Selected
Bidder’s expense, shall keep the interior of the Premises in good condition and repair, ordinary
wear and tear, damage by fire, earthquake, acts of God or the elements excepted. Selected Bidder
shall not be responsible for any alteration or modification, structural or otherwise, as may be
required by any present or future governmental laws, ordinances, orders, or regulations unless
required as a sole result of Selected Bidder’s specific use of the Premises or improvements installed
by the Selected Bidder, with the County’s prior approval. The Selected Bidder shall be solely
responsible for all general maintenance and repairs. The County shall be responsible for all major
maintenance and repairs. Major and minor repairs will be more defined in the Use and License
Agreement upon award, if any to be executed by the County and Selected Bidder, upon bid award,
if any.
