Separate sealed Bids will be received by the City of Kosciusko, Mississippi, for City of
Kosciusko, Sewer System Rehabilitation and Repairs, CDBG Project No. 1201-24-224-PF-01,
Attala County, Mississippi, Project No. 54-24, until 11:00 A.M., Local Time, on April 9, 2026,
at Kosciusko City Hall, 222 East Washington Street, Kosciusko, MS 39090, at which time and
place bids will be opened and read aloud.
The Notice and Instruction to Bidders, Form of Bid, Form of Contract, Plans and Specifications,
Form of Bid Bond, Performance and Payment Bond, and other Contract Documents are on file
and open to public inspection at the following addresses:

The Owner reserves the right to waive any informalities or to reject any and all bids.
Each bidder must deposit with his bid, security in the amount, for and subject to the conditions
provided in the Notice and Instructions to Bidders.
Bidders must comply with Section 3 of the HUD ACT of 1968, the Davis-Bacon Act, the Anti-
Kickback Act, the Contract Work Hours and Safety Standards Act, and the President’s Executive
Order No. 11246.
All bids submitted in excess of $50,000 by a prime or subcontractor to do erection, building,
construction, repair, maintenance, or related work, on public projects must comply with Section
31-3-21, Mississippi Code of 1972, must have a “Certificate of Responsibility” license. Where
applicable, the foregoing certificate number and license number must be indicated on the exterior
of the sealed bid envelope before it can be opened.
Certification of Nonsegregated Facilities: The Contractor must complete the Certification of
Nonsegregated Facilities included in the specifications.
The work to be performed under this Contract is subject to the requirements of Section 3 of the
Housing and Urban Development Act of 1968, as amended 12 U.S.C. 1701u (Section 3). CDBG
regulations governing the grant require that, to the greatest extent feasible, opportunities for
contracting, subcontracting, training, and employment arising in connection with this CDBG
project will be extended to Section 3 businesses and Section 3 residents.
This project is subject to the Build America, Buy America Act (BABAA) requirements under
Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58. Absent an
approved waiver, all iron, steel, manufactured products, and construction materials used in this
project must be produced in the United States, as further outlined by the Office of Management
and Budget’s Memorandum M-22-11, Initial Implementation Guidance on Application of Buy
America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022.
Minority and women's business enterprises are solicited to bid on this contract as prime
contractors and are encouraged to make inquiries regarding potential subcontracting
opportunities, equipment, material, and/or supply needs.
