The Town of Provincetown, MA will receive sealed bids for construction of Jerome Smith Pump Station, Contract
No. 16716 and CWSRF No. 16716. The scope of work includes constructing one Submersible Pumping Station
and all appurtenances to provide wastewater service to the Jerome Smith sewer subarea of Provincetown, MA.
2. Bids shall be submitted using the Town’s online procurement system located at the following link:

. Bids will be opened publicly at the Provincetown
Department of Public Works, 2 Mayflower Street, Provincetown, MA 02657 at the time and place indicated in the
Town’s online procurement platform.
3. The Work involves construction of submersible wastewater pumping station including connection to an existing
8-inch gravity sewer and 4-inch force main. The Work of the Project shall be substantially complete no later than
December 1, 2025.

5. Interpretations or clarifications to questions shall be submitted through the Provincetown procurement portal at
https://www.provincetown-ma.gov/37/Procurement
. All questions are due 12:00 PM local time on the date
indicated on the Town’s online procurement platform.
6. A non-mandatory Pre-bid Conference will be held at the Provincetown Department of Public Works, 2 Mayflower
Street, Provincetown, MA 02657 at the time and place indicated on the Town’s online procurement platform.
Bidders will have an opportunity to view the site of the work during the non-mandatory Pre-bid Conference.
7. Each bid must be accompanied by a five (5) Percent Bid Security in the form of a bid bond, cash, certified check,
treasurer’s or cashier’s check payable to the Owner in the amount of five percent of the bid, in accordance with
SECTION 00200 - INSTRUCTIONS TO BIDDERS. If, upon acceptance of a Bid, a Bidder fails to enter into a
Contract with the Town of Provincetown, MA, the bid security shall be forfeited to and become the property of
the Town of Provincetown, MA.
8. Contract payment will be by the lump sum price method as indicated on the Bid Proposal. No Bidder may
withdraw its Bid for a period of ninety (90) days after the actual date of the opening of the bids.
9. The successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a
surety company satisfactory to the Town of Provincetown, MA and conforming to SECTION 00610,
PERFORMANCE BOND and SECTION 00615, PAYMENT BOND.
10. Bidder understands that all bids for this project are subject to M.G.L. c.30, s39M as modified by the Town of
Provincetown’s Acts of 2000, Chapter 191. A copy of the Acts and a summary document of the specific
modifications to c. 30, S39M is provided as Appendix B to the Contract Documents.
11. Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development under the provision
of the Massachusetts General Laws, Chapter 149, Sections 26 to 27D, as amended, apply to this project. It is the
responsibility of the contractor, before bid opening, to request if necessary, any additional information on Minimum Wage Rates for those trades people who may be employed for the proposed work under this contract. Federal Minimum Wage
Rates as determined by the United States Department of Labor under the Davis-Bacon Act also apply to this project. Both
Federal and State wage rates for this project are included as an Attachment to Section 00800 – Supplementary
Conditions.
12. A weekly certified payroll submittal shall be required of the successful bidder in accordance with MGL C149,
S27B. No payments will be made by the Town of Provincetown, MA until all payroll information necessary for
the Town to determine compliance with prevailing wage law requirements for the time period of the payment
request have been submitted.
13. Bidders are not to include in their Bid Proposal sales and compensating use taxes on materials and supplies
purchased for this project. All materials used are tax exempt.
14. This Contract to be awarded as the result of this Advertisement for Bids is funded in part through the Massachusetts
Department of Environmental Protection, Bureau of Resource Protection, by loans from the Massachusetts Clean
Water Trust (the “Trust”). This Contract will be subject to the Department of Environmental Protection regulations
contained in 310 CMR 44.00, “DEP Selection, Approval and Regulation of Water Pollution Abatement Projects
Receiving Financial Assistance from the State Revolving Fund” in effect on the date of issuance of the assistance
award (DEP Project Approval Certificate) by the Department.
15. Disadvantaged Business Enterprise (DBE) goals are applicable to the total dollars paid to the construction contract.
The goals for this project are a minimum of 4.2 percent D/MBE participation and 4.5 percent D/WBE participation
by certified DBEs. The two low bidders shall submit completed DBE forms (EEO-DEP-190C, EEO-DEP-191C
and the DBE Certification of United States Citizenship form) by the close of business on the third business day
after bid opening. Failure to comply with the requirements of this paragraph may be deemed to render a proposal
non-responsive. No waiver of any provision of this section will be granted unless approved by the Department of
Environmental Protection (MassDEP).”
16. The project does not require the Contractor to have a DCAMM Certification or MassDOT Highway Division
Certification.
17. The Project requires compliance with the Massachusetts Diesel Retrofit Program (MDRP) by use of engine
emission controls that are EPA certified, or their equivalent, on the off-road (non-registered) diesel
vehicles/equipment used at the job site. Bidders must submit a signed and dated Statement of Intent to Comply as
part of their Bid Proposal Document. Failure to comply with these MassDEP requirements may be deemed to
render a proposal nonresponsive. No waiver of any provision of these MassDEP requirements will be granted
unless approved by the MassDEP.
18. The Contractor shall not discriminate about the personnel employed on this project on the basis of race, color,
creed, national origin, gender, sexual preference, handicap or age.
19. The Owner reserves the right to award the Project subject to appropriation.
20. The Town of Provincetown, MA reserves the right to accept and/or reject any and all bids and to waive any
informalities to the extent allowed by law, and to make the award as deemed to be in the best interest of the Town.
