Notice of Intent to Award a Contract

Notice is hereby given that the City of Abbotsford (the “City”) is contemplating making a direct award of a contract to Kerr Wood Leidal Associates Ltd . (the “Service Provider”) for the following:
  • Sumas Prairie Flood Risk Mitigation Program – Engineering Services Support for Consultation Process
Previous Notice of Intents to Award a Contract

The City issued two Notice of Intents as follows:
  1. The City issued a Notice of Intent to Direct Award – NOI No.: 1220-2023-2909 – Engineering Services Support for Consultation Process for Sumas Prairie Flood Risk Mitigation Program on February 27, 2023; closed unchallenged. The value of the contract was $250,000.00 CAD plus applicable taxes.
  2. The City issued a Notice of Intent to Direct Award – NOI No.: 1220-2023-3041 – Engineering Services Support for Consultation Process for Sumas Prairie Flood Risk Mitigation Program on September 6, 2023; closed unchallenged. The value of the work was $300,000.00 CAD with the total value of the contract @ $550,000.00 CAD plus applicable taxes.
Background

The November 2021 extreme weather event had caused flooding in various parts of the City, and most notably the widespread flooding in the Sumas Prairie, due to the Nooksack River overflow from Whatcom County in the United States of America.

As part of the post disaster recovery, the City engaged the services of a Qualified Professional, Kerr Wood Leidal Associated Ltd. (“KWL”), to assist with developing options for the Sumas Prairie for flood mitigation. Four options were developed for discussion purposes; after completing a number of engagement activities in the months of April and May of 2022, a preferred option was formulated and presented to Council on June 13, 2022 with subsequent funding from the Province.

The Province is facilitating consultation with First Nations on this project.

Scope of Services
This is continuous work of the scope of services of the following:
  1. Attend consultation meetings
  2. Present best practices, options and preferred option reviewed as part of the Flood Risk Mitigation Program.
  3. Respond to questions and provide technical support during the consultation process.
The value of this work is approximately $550,000.00 CAD plus applicable taxes.

Rationale for Contemplating a Direct Award

The City is contemplating a direct award with the Supplier for the following reasons:
  • With the objectives of public security and safety and the protection of human, animal and plant life and health and due to the unpredictability of severe weather events, it is important that the provision of services be expedited as delays increase the risks of Sumas Prairie being exposed to the same magnitude of the flood risk seen in November 2021.
  • Kerr Wood Leidal Associates Ltd is mid-stream with the existing process and the process requires continuity to meet the timelines. KWL completed various studies on the Sumas Prairie, including the recent long-term flood mitigation options for Sumas Prairie, 2018 Drainage Master Plan, and the 2020 Nooksack River Overflow Flood Mitigation Plan. In addition, KWL had provided technical support to the City during the November 2021 extreme weather event.
Contract Value:

The value of the contract is expected not to exceed $1,100,000.00 CAD plus applicable taxes.

Submissions by other methods will not be accepted.

Respondents objecting must outline specific reasons for their objection in their email as well as demonstrate their ability to perform the contemplated work and/or services and show availability and resources.  The Respondent’s ability to provide goods and services of the same or better quality and price and within the required period will be the key criteria used in the consideration of any Respondent’s objections.
