Addendum #3
ADDENDUM #3 The plans and specifications are modified, corrected,
augmented or supplemented as follows and this Addendum #1 is hereby
made a part of the RFP documents. Vendor shall note on the form below that
this Addendum #3 has been received and include the completed form in
the submitted proposal.
CLARIFICATION: Monroe County Community College is not considering this project a
Construction Project based on the following criteria and will not require a Bid Bond or a
Performance Bond.
Asphalt sealing — such as sealcoating or crack sealing — is not typically classified as a
full-scale construction project in the traditional sense, but it does involve construction-
like activities and can be considered a pavement maintenance or repair operation.
Why it’s not full construction

Full construction projects usually involve creating new structures, infrastructure, or major
pavement layers (like milling and resurfacing). Asphalt sealing is a preventative
maintenance measure that applies a protective layer over an existing surface to
extend its life. It does not add new structural capacity or change the pavement’s

Why it has construction-like elements
Despite being maintenance, asphalt sealing follows construction procedures:
• Surface preparation: cleaning, crack filling, and milling if needed.
• Material application: using specialized sealants or emulsions in a controlled

• Quality control: ensuring even coverage, proper curing, and meeting
performance standards.
• Regulatory compliance: in public or highway contexts, it follows manuals like the

Accounting and project classification
From a business or government project standpoint:
• Routine sealing (e.g., every 3–5 years) is generally maintenance capital
expenditure if it extends the life of an asset beyond one year
• Major sealing projects (e.g., large-scale public road sealing) may be treated
as capital improvement projects if they are part of a long-term infrastructure
plan.
• Minor repairs (like patching small cracks) are often expensed as maintenance
costs.
Asphalt sealing is not a traditional construction project, but it does involve construction
methods and can be part of a larger pavement maintenance or capital improvement
program. Whether it’s classified as construction depends on the scale, purpose, and
context — routine sealing is maintenance, while large-scale or public infrastructure
sealing can be considered a construction or capital project.
