This Notice is being published in accordance with Federal Acquisition Regulation (FAR) requiring the dissemination of information on proposed contract actions. This is a notice of intent to award sole-source contracts under the authority of FAR 6.302-5, "Authorized or Required by Statute."
The U.S. Army Corps of Engineers (USACE), Baltimore District (NAB), intends to award a follow-on contract to BB&E, Inc., (UEI: JCHUL8M1HHK5) on behalf of the Air National Guard at Joint Base Andrews, Maryland, to provide support to the Environmental Restoration Branch’s Environmental Restoration Program (ERP). Section 874 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2022 (Pub. L. 117-81; 10 U.S.C. §3204) and section 872 of the NDAA for FY 2024 (Pub. L. 118-31; 10 U.S.C. §3204) established the Employee Stock Ownership Plan (ESOP) Pilot, as implemented at DFARS 270. This acquisition has been accepted into the ESOP Pilot.
The prior contract was no. GS00Q14OADS144 and task order no. 47QFSA20F0035, awarded on 20 March 2020 to BB&E. The ANG ERP involves cleanup actions under the Installation Restoration Program (IRP), Military Munitions Response Program (MMRP), and Compliance Restoration Pro-gram (CRP) at 177 installations. The Contractor would provide technical expertise to support ERP’s mission requirements, including all phases of the IRP, MMRP, PFAS Program, and Resource Conservation and Recovery Act (RCRA) Corrective Actions.
This notice is not a request for competitive proposals. All responsible sources may submit a capability statement, which shall be considered by the agency. Capability statements must be received by the response data and time of this notice. Submissions will be reviewed to determine if they can meet the additional design requirements. A determination by the government to compete these proposed contracts based upon responses to this notice is solely within the discretion of the Government. The Justification for the exception to full and open competition for this procurement will be posted upon approval.
