Notice of Intent (NOI) to sole source an out of scope modification to the current construction contractor on Building 125 Renovation at Fort Hamilton, NY, W912DS-23-C-0024
The New York District, U.S. Army Corps of Engineers intends to award a contract modification to FOS Development Corp., for the Building 125 Renovation W912DS23C0024. The work in this modification is an addition to the current scope of the contract to tie in the HVAC system in the LRC portion (unrenovated) portion of the building to the newly installed boilers.
USACE is responsible for the acquisition and administration of the construction contract, to include modifications, for the Building 125 Renovation through Sustainment, Restoration and Modernization funding from the Marine Corps for their new recruitment headquarters at Fort Hamilton, NY.
This is not a formal solicitation or request for proposal. This notice of intent is to give notice of the Government's intent to make a sole source award under the authority cited in Federal Acquisition Regulation 6.302-2(b)(2).
Delay in award of a contract would result in serious injury, financial or other, to the Government. The existing boiler that services the unrenovated portion of the building has failed. The newly installed boiler is sized for the whole building. We need to connect the existing distribution system in the LRC portion of building 125 to the new boiler. The Justification is that the one contractor is already there occupying the mechanical room space delaying an award of a new contract to a new contractor. The LRC portion of the building is currently without heat creating a serious life safety issue for Government employees working in the building and a potential for damage to the facility if pipes were to freeze and burst due to the lack of heat. Separating this work out and competing it would result in both substantial duplication of costs and unacceptable delays.
