Rental of Trash Bins/Containers and Pickup Services
Questions and Concerns received from Lagu, LLC on September 4, 2026.
1. While understanding that volumes remain indefinite under the IDIQ structure, could GSA share the
current list of active sites by agency that may order under this solicitation?
Response: The General Services Agency (GSA) does not maintain a list of active sites, as utilization and
service will be determined by each agency based on its actual operational needs and may vary
throughout the contract period.
2. Article III Item 8 stipulates that "The Government of Guam is required to order its actual requirements
during the one (1) year period from the awarded bidder," with the Destination defined as "all Government
of Guam Agencies to include Autonomous Agencies" on page 4. Does this create a binding obligation for
all departments, autonomous or otherwise, to use this confirmed price rather than issuing independent
RFQs, or is utilization left to each office's discretion?
Response: The availability of this contract does not create a mandatory obligation for all Government
agencies to utilize the awarded contract. Each agency remains responsible for determining its
procurement needs; however, agencies are encouraged to use available existing contracts for the same
need, or when applicable to their requirements, to maximize existing procurement resources and avoid
unnecessary duplication of procurement efforts.
3. Article III Item 8 states, "The term of this contract is for a period of one (1) year on an as-needed basis
upon availability of funds."
a. Does any extension mechanism exist? If so, would it be governed by 2 GAR Division 4, Chapter 3,
Section 3102(b)?
Response: Yes.
b. Should a PO be issued partway through this span, must performance conclude at the end of the
term, or may it continue beyond that point?
Response: A Purchase Order (PO) may be issued during the active contract period for the
required services. The service period shall be established based on the date of delivery;
however, all services, including the final pickup, must be completed no later than the expiration
of the contract term, including any approved extension.
4. How much advance written notice would be given for a termination for convenience under Instruction
11(b), and separately for cancellation due to non-appropriation or insufficient funds per General Terms
Item 43?
Response: Thirty (30) days.

5. Item 9 of the General Terms allows for "not more than two (2) Basic and Alternate item prices," and
Instruction 2(c) notes that unit and extended figures "apart from the Basic and Alternate bid" will not be
considered.
a. Please clarify whether two prices can or should be submitted per line item.
Response: See Amendment #2. This section does not apply to this bid.
b. If so, how would GSA determine which is the final rate for evaluation purposes?
Response: See Amendment #2. This section does not apply to this bid.
c. Where on the Bid Form (pages 46-47) should the second value be entered?
Response: See Amendment #2. This section does not apply to this bid.
d. Item 9 further calls for bidders to "explain fully each price" regarding compliance and product
origin - what does this entail, and where should the explanation appear?
Response: See Amendment #2. This section does not apply to this bid.
6. Kindly confirm that Occupation Code 31364 (Heavy Truck Driver, $17.88 per hour) and Occupation Code
23470 (Laborer, $13.83 per hour) under WD 2015-5693 Rev. 27 are the correct classifications for drivers
and helpers, respectively.
Response: Wage determinations are published and maintained by the U.S. General Services
Administration System for Award Management (SAM.gov) and are subject to periodic revision. Local
GSA does not establish or administer the wage rates. Bidders may refer to SAM.gov for the current
wage determination and applicable revision.
7. Would a bid bond issued by a Guam captive insurer with a certificate of authority meet the bid bond
requirement, or would a Power of Attorney still be necessary?
Response: Refer to page 2 and page 23 of the solicitation packet. The Surety Bond requires a Power of
Attorney issued by the Surety to its Resident General Agent and executed by two (2) authorized officers
of the Surety to the individual signing on its behalf, only when the Surety is a foreign or alien
corporation. The Insurance Commissioner at the Guam Department of Revenue and Taxation (DRT) is
the appropriate authority for determining applicable insurance requirements.
8. Article IV Item 12 sets payment within thirty (30) days of receipt and acceptance of services. Does this
apply independently of invoice submission date and take precedence over the Prompt Payment Act (11
GCA)?
Response: The payment term set forth in Article IV, Section 12, is contingent on the vendor's timely
submission of invoices and the receiving agency's review and approval of those invoices. This section
does not change the provisions of the Prompt Payment Act.
9. Section 30.b requires a three-month guarantee and service period for "other types of equipment offered."
a. Would any items besides trash bins qualify as such equipment?
Response: No. This solicitation is limited to the rental of trash bins/containers and pickup
services. No other equipment is required. Therefore, this section is not applicable.
b. After this initial period, would repair and replacement costs become the Government's
responsibility?
Response: See response above.

10. What recourse will the Contractor have if a bin contains banned material, is overloaded (i.e., waste
exceeds the confines of the bin with the lids closed), or is too heavy for the Contractor's truck to service?
May the Contractor submit additional line items for such cases?
Response: The awarded contractor may notify the using agency of any prohibited material, overloaded
bin, or other condition that prevents service in accordance with the contract requirements. Any
additional costs resulting from the using agency's failure to comply with the applicable disposal
requirements shall be the responsibility of the using agency.
11. Please affirm that the Contractor's responsibility is limited to servicing waste fully contained within the
provided bins, and that the Contractor will not be liable for materials left outside or on the ground.
Response: Yes.
12. We request assurance that Items 5.1 and 7.1 will be limited to scrap metal free of non-metallic and
electronic components, and that Items 6.1 and 8.1 will be limited to untreated and unprocessed wood.
Response: GSA does not control the using agency's disposal activities. The using agency is solely
responsible for ensuring compliance with applicable material and disposal requirements.

submitted to the General Services Agency via email to bids@gsadoa.guam.gov no later than 5:00 PM, Tuesday,
