Project Information
In April 2010, an explosion at the BP-operated Deepwater Horizon oil rig caused the worst oil spill in US
history, with millions of barrels oil spilling into the Gulf. In the summer of 2012, Congress passed the
Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies (RESTORE) Act,
which established the Gulf Coast Restoration Trust Fund and mandated that 80% of Clean Water Act
(CWA) civil damages from the spill be allocated directly to the five impacted states, including Texas. In
Texas, the Texas Commission on Environmental Quality (TCEQ) was tasked by the Governor to
administer RESTORE funding.
The Park Board applied in 2016 for two RESTORE projects. This project focuses on Phase 1A of the
Master Plan for the East End Lagoon Park and Preserve, completed in 2011. The East End Lagoon (EEL) is
one of the most ecologically significant undeveloped sites on Galveston Island and is envisioned as a
East End Lagoon Pavilion Construction Project 2 of 40
nature-based tourism and conservation destination.
The project is for the development of an elevated, open-air pavilion with tables and benches, restrooms,
parking, and landscaping. The project protects wildlife habitat, preserves the ecosystem, diversifies
tourism, and promotes economic and ecologic resiliency. The view and educational opportunities from
this pavilion will be a major asset for the Texas coast.
USACE permitting coordination has already been conducted and a 'no permit required' designation has
been obtained, due to the pavilion being constructed on upland property. Permitting documents will be
provided to the successful bidder. City of Galveston building permit coordination has already taken
place through the development of the plans and specifications and the permit has been obtained. The
chosen contractor will have to pick up and pay for the permit as a part of the project. Necessary
information related to this will be provided to the successful bidder.
Requirements of the Davis-Bacon Act do not apply to the East End Lagoon Pavilion Construction Project.
Refer specifically to the following sections of ATTACHMENT A - RESTORE Act Terms & Conditions:
* O Non-Discrimination Requirements (President Trump revoked Executive Order's 11246 & 11375
in January 2025 and replace it with Executive Order 14173)

request for a formal 'Notice to Process' to the U.S. Treasury. Treasury will review the entire package and
have final say to provide approval to move forward with the construction project. This must all take
place before a formal NTP can be issued by the Park Board to the successful bidder. The Park Board has
been advised that this could take anywhere from 45-60 days.
All procurement activities involving the expenditure of RESTORE funds will be conducted in compliance
with the Park Board's Purchasing Policy as well as the Procurement Standards codified in 2 C.F.R.
