Project Description: PUBLIC NOTICE IS HEREBY GIVEN to all prospective Bidders that Whitpain Township (Owner) shall accept sealed proposals online for the following Project: Whitpain Basin Retrofits - Ridings Basin in Whitpain Township, Montgomery County, PA.
Sealed Bids shall be accepted via PennBid (https://pennbid.bonfirehub.com/) until 11:00 AM, prevailing time, on Thursday, March 19, 2026 at which time they shall be opened electronically, and the results made available on PennBid immediately following the opening.
The Scope of Work consists of but is not limited to:
Retrofitting of a stormwater management BMP to restore or improve its function.
Bidding Documents are available online and may be downloaded via PennBid (https://pennbid.bonfirehub.com/). Prospective Bidders are urged to register with PennBid as a plan holder, even if Bidding Documents are obtained from a plan room or source other than PennBid in either electronic or paper format.
PennBid will be updated periodically with Addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, Addenda, and other Bidding Documents will be offered only through PennBid. Neither Owner nor Engineer will be responsible for Bidding Documents, including Addenda, if any, obtained from sources other than PennBid.
All Bids are to be accompanied by a Bid Bond or certified check in the amount of 10% of the total Bid price. Said check or bond shall be subject to the conditions provided in the Instruction to Bidders. Bonds are required to be issued by a surety licensed to do business in the Commonwealth of Pennsylvania.
All questions about the meaning or intent of the Bidding Documents are to be submitted via PennBid in accordance with the Instructions to Bidders. Telephone inquiries are unacceptable and shall not be considered or answered. Questions must be submitted via PennBid by Thursday, March 12, 2026, at 5:00 PM. Submission of a question does not guarantee that such question will be answered.
For all further requirements regarding Bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents.
Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project and will be required to submit an executed non-collusion affidavit with the Bid.
Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972.
This Project falls under The Commonwealth of Pennsylvania Act 127 of 2012, known as the Public Works Employment Verification Act (‘the Act’) which requires all public work contractors and subcontractors to utilize the Federal Government’s E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award.
The successful Bidder must comply with the Pennsylvania Prevailing Wage Act. Bidders are advised that prevailing minimum wage rates, promulgated by the Pennsylvania Secretary of Labor and Industry, must be paid to workmen employed on this project.
This Project is subject to Ordinance No. 394, Whitpain Township Responsible Contractor Ordinance (RCO), including pre-qualification requirements as specified in the Ordinance. The Bidder shall complete the Responsible Contractor Certification Form provided, and shall submit the Form to the Township, to the attention of Eric Traub, Manager, via E-mail to etraub@whitpaintownship.org no later than fourteen (14) days prior to the Bid opening date, together with all documentation required by Section 4 of Ordinance 394, a copy of which is provided, in order to be pre-qualified before submitting a Bid.
Responsible Contractor Certification (RCO) Forms must be submitted to the Township no later than Thursday, March 5, 2026, at 5:00 PM.
The successful Bidder is required to furnish all payment, performance, and maintenance bonds as referenced in the Bidding Documents. Bids must be submitted unconditionally. All Bids shall be irrevocable for 60 days after the Bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the Bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142).
All Bidders are hereby notified that in regard to any contract pursuant to this advertisement, businesses will be afforded full opportunity to submit Bids in response to this notice and will not be subjected to discrimination on the basis of gender, race, color, creed, sex, age, physical disability or national origin in consideration for an award. Similarly, the Successful Bidder shall in no manner discriminate against or intimidate any employee involved in the manufacture of supplies, the performance of work, or any other activity required under the contract on account of gender, race, creed or color.
Whitpain Township reserves the right to waive any defects, errors, omissions, mistakes, or informalities, accept any Bid or combination of Bids that are deemed to be in the best interest of the Township and reject any or all Bids.
