Notice of Proposed Sole Source Purchase

Mississippi State University anticipates purchasing the item(s) listed below as a
sole source purchase. Anyone objecting to this purchase shall follow the
procedures outlined below.
1. Commodity or commodities to be purchased (make, model, description):
(2)5’ X 10’ Slimline Series Aluminum Structure manufactured by Brasco International.
Three sided; full rear and side walls; front-centered windscreen with two ADA
openings. Dark bronze anodized aluminum finish. White acrylic dome roof with 12”
aluminum plate for fascia and integral gutter. Three-way split ¼” clear tempered
safety lass wall panels with tow horizontal mullions. 5’ wall-mount aluminum bench
with backrest. Solar lighting package with 55-watt rigid solar panel, one 32-amp hour
battery, solar controller, vented enclosure, and 4.3-watt LED light for general shelter
illumination
2. Explanation of the need to be fulfilled by this item(s), how is it unique from all other
options, and why it is the only one that can meet the specific needs of the department:
Since the inception of the SMART system, we have been installing the above-
mentioned Brasco shelters at all our shelter locations. Our goal is to have consistent
identity for all the locations. This is not only important for imagery, but also because
we need consistent dimensions for display cases, advertising materials, signage, and
ETA notification devices. By having a standard shelter, we can order parts and
interchange components as needed.
3. Name of company/individual selling the item and why that source is the only possible
source that can provide the required item(s):
Brasco International, Inc. was the selected company when the first shelters were
purchased for SMART with other companies being evaluated at the time
4. Estimated cost of item(s) and an explanation why the amount to be expended is
considered reasonable:
$11,975.00 for (1) shelter. Considering the way all things structure related have
escalated in cost over the past year, this price is in line with current costs.
5. Explanation of the efforts taken by the department to determine this is the only source
and the efforts used to obtain the best possible price:
Prior to selecting Brasco as the shelter of choice for the SMART transit system, other
vendors were evaluated. This included reviewing the shelter design type and the cost.
The SMART committee charged with making the decision for a shelter type chose to
go with the Brasco International structure. This decision has proven to be a solid
choice with the test of time in use.
Any person or entity that objects and proposes that the commodity listed is not sole source and
can be provided by another person or entity shall submit a written notice to:

Subject Line must read “Sole Source Objection”
The notice shall contain a detailed explanation of why the commodity is not a sole source
procurement. Appropriate documentation shall also be submitted if applicable.
If after a review of the submitted notice and documents, MSU determines that the commodity
in the proposed sole source request can be provided by another person or entity, then MSU will
withdraw the sole source request publication from the procurement portal website and submit
the procurement of the commodity to an advertised competitive bid or selection process.
If MSU determines after review that there is only one (1) source for the required commodity,
then MSU will appeal to the Public Procurement Review Board. MSU will have the burden of
proving that the commodity is only provided by one (1) source.
