Project Description
Tuolumne Utilities District (TUD) is seeking qualified contractors for district wide Patch Paving for FY27. In general, the project will consist of Patch Paving in various locations throughout Tuolumne County, CA. The scope includes approximately 66 patches, totaling 1,686 SF requiring paving (more to be added throughout the FY)

INVITATION TO BID
Sealed Bids for the construction of the FY27 Districtwide HMA Patch Paving addressed to the
Tuolumne Utilities District, 18885 Nugget Boulevard, Sonora, California 95370, will be received
at the office of the District until 2:00 p.m., local time, on May 15, 2026, and will then be publicly
opened and read.
In general, the project will consist of Patch Paving in various locations throughout Tuolumne
County, CA. The FY2027 patch list is attached. The District's FY27 runs from July 1, 2026 to June
30, 2027. Paving under this contract shall start as early as July 1, 2026 and be completed by the
end of the 2026 calendar year (assuming a Notice to Proceed is issued prior to July 1).

Notice is hereby further given that the Project is a public works project within the requirements of
Division 2, Part 7, Chapter 1 of the California Labor Code, and that each Bidder and all
subcontractors are required to be registered pursuant to Labor Code section 1725.5 at the time
of bidding. Failure of the Bidder to be registered at the time of bidding shall render the Bid non-
responsive and unavailable for award. A Subcontractor who is unregistered will not be permitted
to work on the Project. If any Subcontractor required to be listed in the Bid is unregistered, that
Subcontractor will be required to be substituted with a registered Subcontractor at no additional
cost to the District and/or the listing of an unregistered Subcontractor may render the bid
nonresponsive. Bidders shall provide the registration numbers for all listed Subcontractors with
the Subcontractor Listing Form and registration numbers of all Subcontractors who are not
required to be listed not later than 24 hours before they are to start work on the Project.
The District affirmatively identifies this project as a "public work" as that term is defined by Labor
Code Section 1720, and the Project is, therefore, subject to prevailing wages under Labor Code
Section 1771. Contractor and its Subcontractors shall fully comply with all the provisions of the
California Labor Code governing the performance of public works contracts including, but not
limited to, payment of prevailing wages, limitations on time worked, compliance with apprentice
requirements, maintenance of payroll records, posting of wages at the job site and prohibitions
against discrimination. The District has obtained from the Director of the Department of Industrial
Relations the prevailing wage rates applicable to the work. Copies are on file at the District's
office or on the internet at http://www.dir.ca.gov/OPRL/PWD. Bidders are responsible for
determining which wage classifications are applicable to this Project. (Labor Code Section
1773.2.) Bidders may also obtain them at the DIR website:

Payment for the work accomplished will be made monthly. A portion of the amount earned will
be withheld to ensure performance under the Contract. Substitution of securities for the monies
withheld is permitted by the Contract Documents as an option open to the successful Bidder,
pursuant to the provisions of Section 22300 of the Public Contracts Code.
Bids shall be prepared in accordance with the requirements set forth in the Contract Documents,

on the forms therein or copies thereof. Upon being awarded the contract, Bidder shall provide a
100% Public Works Payment Bond and a 100% Performance Bond.
No Bid will be accepted from a contractor who has not been licensed in accordance with the laws
of this State to perform the work herein described and who does not possess a Class A license
or its equivalent for the type of work called for under this Project.
The Contract time for performance is 180 calendar days from the date specified in the written
Notice to Proceed. Failure to complete the work within the time allotted may result in the imposition
of liquidated damages, as outlined in the Instructions to Bidder.

The District reserves the right, in its sole discretion, to award the Contract, to reject any or all Bids,
to re-Bid, to waive inconsequential deviations from Bid requirements, to reject nonconforming,
nonresponsive, non-responsible, or conditional Bids, and to postpone the award of the Contract
for a period of time which, however, shall not extend beyond 90 days from the bid opening date.
As used in the Contract Documents, "District" and "Owner" all refer to the Tuolumne Utilities
District.

INSTRUCTIONS TO BIDDERS
1. CONTRACT DOCUMENTS
a. FORMAT
The Contract Documents are divided into parts, divisions, and sections for
convenient organization and reference. Generally, there has been no attempt to
divide the Specification sections into work performed by the various building
trades, work by separate subcontractors, or work required for separate facilities in
the project.
b. DOCUMENT INTERPRETATION
The Contract Documents governing the work proposed herein consist of the Bid
Documents, Contract, and Drawings and Specifications, all material bound
herewith, addenda to the foregoing, and material incorporated by specific
reference, and other documents in the definition of "Contract Documents" in the
General Conditions. The Contract Documents are intended to be mutually
cooperative and to provide all details reasonably required for the execution of the
proposed work.
Should there be any doubt as to the meaning or intent of the Contract Documents,
the Bidder should request, in writing, at least 6 working days prior to bid opening,
an interpretation from the Engineer. Any interpretation or change in the Contract
Documents will be furnished to all Bidders receiving a set of the documents.
Bidders shall submit with their Bids, or indicate receipt of, all Addenda. The District
will not be responsible for any other explanation or interpretations of said
Documents.
2. GENERAL DESCRIPTION OF THE PROJECT
A general description of the work to be done is contained in the Invitation to Bid. The
scope is indicated on the accompanying Drawings and specified in other parts of these
Contract Documents.
3. LICENSING REQUIREMENTS FOR CONTRACTORS
Bidders and their proposed subcontractors shall hold such licenses as may be required
by the laws of the State for the performance of the work specified in the Contract
Documents, including a Class A license or its equivalent for the type of work called for
under this Contract. Any Bid submitted to the District by a Contractor who is not licensed
in accordance with the California Contractors State License Law, Business and
Professions Code Section 7000 et seq., or in violation of Business and Professions Code
Section 7028.15, shall be considered non-responsive and will be rejected by the District.
4. CARB DIESEL REGULATION CERTIFICATES
This contract is subject to the California Air Resources Board Off-Road Diesel Regulation
(Title 13 CCR 2449). In order to be eligible to perform work under this contract, you must
submit to the agency copies of the valid Certificates of Reported Compliance, as described

in section 2449(n), for the fleet selected to perform work for this bid and any listed
subcontractors, if applicable. If you do not submit said Certificates with your bid, your bid
will be disqualified.
5. BIDDER'S UNDERSTANDING
Each Bidder must be aware of the conditions relating to the execution of the work, and it
is assumed that they will inspect the site and make themselves thoroughly familiar with
the site and of all the Contract Documents. Failure to do so will not relieve the successful
Bidder of their obligation to enter into a Contract and complete the contemplated work in
strict accordance with the Contract Documents. The Bidder's attention is called to the
General Conditions and the Site Conditions section of the Technical Specifications
regarding Bidder's obligation to verify the complete satisfaction of all information
concerning site and subsurface conditions. Each Bidder shall be informed of, and the
Bidder awarded a Contract shall comply with, Federal, State and local laws, statutes, and
ordinances relative to the execution of the work. This requirement includes, but is not
limited to, applicable regulations concerning minimum wage rates, nondiscrimination in
the employment of labor, protection of public and employee safety and health,
environmental protection, the protection of natural resources, fire protection, burning and
non-burning requirements, permits, fees, and similar subjects.
6. TYPE OF BID
UNIT PRICE
Where the Bid for an item of Work is to be submitted on a unit price basis, the Bidder
shall bid a unit price as total compensation for completion of one unit of the work
described under that item. This price shall be multiplied by the Estimated Quantity
included in the Bid Form to derive a total bid price for that item. The total amount bid for
a unit price contract shall be entered on the space provided on the Bid Form as a grand
total of all individual items. The Estimated Quantities included on the Bid Form are
approximate and are only included in the Bid Form as a basis for comparison of Bids.
The District does not, expressly or by implication, represent or agree that the actual
amount of Work will equal the approximate Estimated Quantities. Payment will be made
for the actual quantity of Work performed in accordance with the Contract, subject to the
District's reserved right to increase or decrease the amount of any class or portion of the
Work, or to omit portions of the Work, as may be deemed necessary or advisable in the
sole discretion of District. For compensation for alterations in quantities of work,
including deviations greater than twenty-five percent (25%), see Section 11.8 of the
Contract General Conditions.
LUMP SUM
When the Bid for the work is submitted on a lump sum basis, a total lump sum price, which
is the sum of the unit prices, shall be submitted in the appropriate place along with
amounts for the individual portions of the work. The total amount to be paid to the
Contractor shall be the amount of the lump sum Bid as adjusted for additions or deletions
resulting from changes in quantities or scope; however, no changes in contract price will
be made for any variance between installed quantity and quantity shown on the Drawings
if such variance is less than two (2) percent for quantities in any separate bid item. The
Bidder shall furnish a schedule of values on the lump sum bid if required in the Bid.
