Question
1. When will vendors receive the applicable
contract for review?
2. Will customer be willing to consider
contract revisions/exceptions?
Answer
Contracts with awarded vendors are anticipated
to be available in Fall 2026.
In the event the vendor intends to deviate from
the general terms and conditions or specifications
contrary to those listed in the "Terms and
Conditions", "Specifications" and other
information attached in the RFP, all such
deviations must be listed as noted in the RFP,
with complete and detailed conditions and
information also being attached (attach additional
pages as necessary). Vendors must list all
specifications for item(s) bid that differ from any
specifications/brands listed in proposal. ESC-20
will be the sole judge to determine if deviations
are acceptable in meeting the needs of ESC-20.
3. To what extent will revisions/exceptions
impact final award decisions?
4. Is customer receptive to mutual
termination rights?
5. Is customer receptive to the prospect of
rate/pricing increases where unexpected
market forces make this a necessary
consideration?
6. The solicitation references the Uniform
Commercial Code (UCC) as being
applicable to the relationship between
customer and vendors. With the UCC
being applicable to transactions involving
the sale of goods, how is it applicable
where customer is seeking services?
For subsequent contracts, ESC-20 will be the sole
judge to determine if any revisions/exceptions are
acceptable in meeting the needs of ESC-20.
Contracts would be in alignment with the "Terms
and Conditions", "Specifications" and other
information attached in the RFP.

the Standard Evaluation Criteria. ESC-20 will be
the sole judge to determine if deviations are
acceptable in meeting the needs of ESC-20.

As noted on page 1 of the RFP, “Proposals marked
"subject to price change" or "price in effect on
date of delivery" will not be considered.” Renewal
terms are subject to conversations between ESC-
20 and the vendor.
The Uniform Commercial Code (UCC) would be
applicable to any goods purchased. The UCC
would not be applicable to specific services.

for positions?

curriculum?

technology to their staff to utilize in

17. What are the parameters of the crisis
management for the intended program?
If the invoice is reflective of services rendered to
date and not pre-billing for future service periods,
ESC-20 is receptive to Net 30 payment terms.
No. As noted in the Scope of Services on page 3,
“ESC-20 is seeking to partner with a company to
provide centralized contracted behavior services
designed to meet the needs of students with
significant behavioral challenges who also present
with varying cognitive abilities. The successful
service provider will partner with ESC-20 to
ensure the services offer a structured,
therapeutic environment with separate
classrooms to support students with average
cognitive abilities as well as those with lower
functioning skills.”
At this time, it is anticipated that the sending or
host LEA will provide the curriculum. The vendor
is responsible for intervention curriculum.
Vendor is responsible for providing technology to
their staff.
It is the vendor responsibility to hire and ensure
staff members meet Texas license and
certification requirements.
Contracts with awarded vendors are anticipated
to be available in Fall 2026.
ESC-20 projects a start date in January 2027.
ESC-20 will award all recommended vendors
following the Standard Evaluation Criteria
outlined in Attachment A on pages 19-22.
ESC-20 is in the process of working with LEAs to
determine needs. Initial projections indicate a
higher need for preliminary services to middle
school students.
ESC-20 is in the process of working with LEAs to
determine needs. At this time, ESC-20 anticipates
hosting one preliminary program starting in
January 2027 with the potential for additional
settings in the following school years aligned with
the RFP renewal periods.
Vendor must adhere to the requirements of the
Individuals with Disabilities Education Act (IDEA)
and Texas regulations, including TEA proposed
minimum standards. It is the expectation of ESC-
20 that any awarded vendor is aware of and
adheres to applicable federal and state
regulations. To allow for fair scoring, no further
information will be provided.
