The City of Blue Springs, Missouri is seeking proposals from qualified Contractors for contracted on-call tree services for the parks and recreation department. Contractor will be responsible for responding to on-call needs for the department along with performing an all-inclusive tree maintenance initial service for Blue Springs Park including but not limited to full tree trimming, tree assessment, tree removal, stump grinding, and dead wooding.

Notice to Bidders
Sealed proposals will be received by the Assistant Director of Park Services of the City of
Blue Springs at Carson Ross Community Recreation Complex at 425 NW Mock Ave., Blue
Springs, MO 64015 until 1:00 pm CST, on May 8, 2026, at which time bidding will be
closed. In accordance with the Missouri Sunshine Law, RSMo 610.021., proposals will be
opened on said date and time and only the bidder name and base proposal price will be
read aloud. All other documents will be checked for responsiveness after Bid opening.
The specific locations of the work to be done shall be contained in the special provisions
section of the bid document. The Contractor shall bid on all work.
All equipment, materials, and workmanship must be in accordance with the
Specifications and other Contract Documents.
A Pre-Bid Meeting will be held on by appointment only. An appointment for a pre-
bid meeting is recommended but not required. Addenda will be issued as the City
deems necessary.
Pursuant to 610.021 RSMo Item 12, all documents within a request for proposal will
become open record to the public upon a negotiated contract being executed. All
documents within a request for bid become open record as soon as the bid is opened.
Bidders and proposers should be aware that all documents within a submittal will
become open records.
The City reserves the right to reject any or all proposals and to waive informalities or
deficiencies therein to negotiate with any or all bidders or others for more favorable
terms or prices and to award a contract to other than the bidder submitting the lowest
cost bid proposal with or without negotiation and to determine which is the lowest,

best, and most responsive to accept, at its option, any alternates and to approve the
bond.
In no event shall the City be liable to the Contractor for special, indirect, or
consequential damages. The maximum liability of the City shall be limited to the amount
of money to be paid or received by the City under this Contract.
The Contractor shall defend, indemnify, and hold the City and its elected or appointed
officials, officers, employees, and agents harmless from and against all actual claims and
alleged claims and all damages, including but not limited to losses, liabilities, costs,
expenses and attorney fees arising out of personal injuries, including illness or death,
and damage to, or destruction of, property, which are caused by the Contractor or the
Contractor’s agents, employees, sub-contractors or by others for whom Contractor is
liable arising out of or in any way connected with or resulting from, performance of, or
failure to perform, this contract, regardless of whether or not caused in part by any act
or omission of City, its elected or appointed officials, officers, employees or agents.
Contractor affirms that it has had the opportunity to recover the costs of the liability
insurance required in this Contract in its Contract price.
The Contractor shall indemnify and hold the City harmless from all wages or overtime
compensation due its employees in rendering services pursuant to this contract,
including payment of reasonable attorneys' fees and costs in the defense of any claim
made under the Fair Labor Standards Act, the Missouri Prevailing Wage Law, or any
other federal or state law.
The indemnification obligations of Contractor hereunder shall not be limited by any
limitations as to the amount or type of damages, compensation, or benefits payable by
or for the Contractor, under any federal or state law, to any person asserting the claim

against City, its elected or appointed officials, officers, agents and employees, for which
indemnification is sought.
The indemnification obligations herein shall not negate, abridge, or reduce in any way
any additional indemnification rights of the City, its elected or appointed officials,
officers, agents and employees, which are otherwise available under statute, or in law or
equity.
All the provisions in this RFP, which becomes part of the Agreement, are subject to the
terms of Missouri Sovereign Immunity as set forth in section 537.610.2 and 537.610.5 of
the Missouri Revised Statutes. Further, this Contract is not intended to act as a waiver or
limitation of City, or any of its officer’s, agent’s or employee’s rights and/or defenses
regarding sovereign or any other immunity or defense under Federal Law, Missouri Law
or Municipal Regulation.
