Description

This is a notice of intent to sole source a procurement under FAR Part 13 Simplified Acquisition Procedures, 41 U.S.C.3304(a)(1), and FAR 6.302-1 Other Than Full and Open Competition - one responsible source. The applicable NAICS Code is 519290 – Web Search Portals and All Other Information Services. The USMC Regional Contracting Office (RCO) – Marine Corps Installations-National Capital Region (MCI-NCR) at Quantico Marine Corps Base, VA intends to award a sole source contract to:



LRP PUBLICATIONS, INC., 360 HIATT DRIVE, PALM BEACH GARDEN, FL 33148-7106



The MCI-NCR RCO intends to award this requirement under the authority of 41 U.S.C. 3304(a)(1) and FAR 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This unique requirement is for the procurement of renewal CyberFeds Licenses on the Web Subscriptions with Worker's Compensation Subscriptions.



This exclusion to full and open competition is in accordance with 41 U.S.C.3304(a)(1) Use of Noncompetitive Procedures which states; “An executive agency may use procedures other than competitive procedures only when the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency.” Furthermore, FAR 8.405-6(a)(1)(i)(B) states (1) Circumstances justifying limiting the source.




  1. For a proposed order or BPA with an estimated value exceeding the micro-purchase threshold not placed or established in accordance with the procedures in, 8.405-2, or 8.405-3, the only circumstances that may justify the action are–



(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.



CyberFEDS on the Web Subscription with Worker's Compensation Subscription is the only one responsible source utilized to provide access to case laws, arbitration awards, statues, regulations, decisions (i.e. Federal Sector, court, Private sector), forms for Human Resource Programs (i.e. Employee Relations, Staffing, and Classification, Recruitment/Retention, Succession Planning, Pay and Benefits, Training, and Workforce Development), and Equal Employment Opportunities (EEO), Diversity, and Labor Relation decisions in support of the United States Marine Corps' mission and readiness. LRP Publications, Inc. is the sole source of this unique combination of required data which provides the latest developments and news in case law subject areas.



This notice of intent is NOT a request for competitive quotes; however, all responsible sources may submit a capability statement or quotation which shall be considered by the agency. Capability statements or quotes, if received timely, will be considered; however, a determination by the Government not to compete the requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses shall be emailed to kevin.guertin@usmc.mil no later than 21 March 2025, 10:00 AM Eastern Daylight Time. Late responses will not be considered.
