This Addendum is issued in accordance with the IFB Terms & Conditions and is intended to provide

additional information and clarification to Respondents.

This Addendum consists of two (2) items which are listed below and are an integral part of the IFB to which

it is attached and is incorporated therein and made part thereof by this reference.

Item 1 – Changes to IFB

1. Add Attachment L – Memorandum Electronic Data Authorization, for requesting AutoCAD

files.

1. AutoCAD files for the Livingston Landfill Cell II D-Alpha Construction

“The electronic data is provided for convenience only. Original signed hard copies of drawings

are the official design drawings. The Recipient uses these files at their own risk. Any conclusion or

information obtained or derived from the data will be at the user’s sole risk. Modification or

reuse of the data is not authorized by TRC Engineers, Inc (TRC). TRC has no legal liability for

claims arising out of unauthorized use of the data or modification of the information. Transfer

of the data does not transfer any license for use. TRC makes no representation as to the

durability of the data or the medium in or on which it is transferred. Because of the possibility

that information and data delivered in an electronic file format may be altered, whether

inadvertently or otherwise, TRC reserves the right to retain the original tapes, disks, and other

forms of electronic data. TRC also reserves the right to retain hard copy originals of all

documentation and data which is delivered in electronic file format, which originals shall govern

in the event of any inconsistency between the two. It is also understood that the automated

conversion of information and data from the system and format used by TRC to an alternate

system or format may not be able to be accomplished without the introduction of inaccuracies,

errors, and anomalies. In the event any data provided in electronic file format is modified or

corrupted you agree to assume all risks associated therewith and, to the fullest extent permitted

by law, to hold TRC harmless and indemnify it from and against any claims, liabilities,

damages, losses and costs, including but not limited to attorney’s fees, arising therefrom or in

connection therewith.”
