General Bid Information
Montrose County is accepting sealed bids from qualified asphalt paving contractors for hot mix
asphalt (HMA) paving work on 2.75 miles of roads requiring approximately 9735 tons of HMA.

Bidder Instructions
Submitted bids must be enclosed in a sealed opaque envelope marked 2026 Asphalt Paving
Bid” with the name of the bidder and delivered to Montrose County Public Works, Attn:
Brandon Wallace, 63160 LaSalle Rd, Montrose, CO 81401, no later than 2 p.m. local time,
September 8, 2026. The bids will be opened immediately thereafter and read aloud. Bids
received after the time due will not be considered and will be returned to the bidder un-opened.
A 5% bid security is required with the bid as outlined in C.R.S. 24-105-201. The bid security
shall be placed in a separate envelop marked “2026 Asphalt Paving - Bid Security” that is
either attached to the outside of the bid envelope or placed in a larger envelope that contains both
the sealed bid envelope and the bid security envelope. Bids not including a bid security will not
be considered and will be returned to the bidder un-opened.
Bids are to be submitted on the Bid Forms included within the bid package. Bidder must provide
the Unit Bid Price, Item Total Bid Price and Total Bid Price on the Bid Schedule Form. In case
of discrepancy on the Bid Schedule Form, the Unit Bid Price governs.
Any bid questions must be received by 2 pm local time, August 31, 2026. Any modifications to
the Invitation to Bid package will be an Addendum and posted to the County website and
distributed to all known bidders by 5 pm, September 3, 2026. It is the responsibility of the bidder
to verify if an addendum has been issued. Bidder shall acknowledge Addenda in the Bid and
Addenda Acknowledgment section of the Bid Form.
General Conditions
All bids shall be irrevocable for 45 days from the date of the bid opening.
The successful bidding Contractor will be required to enter into an agreement with Montrose
County. A sample agreement is included in this bid package, but the final agreement may be
altered and/or contain additional or different provisions.
A payment and performance bond equal to 100% of the bid amount will be required as outlined
in C.R.S. 38-26-106 and the contract agreement for the successful bidder.
Contractor shall carry insurance coverage as outlined in the contract agreement.

Payment to Contractor will be made upon submission and approval of invoice(s). Payment will
follow normal County payment processing cycles for issuance of checks.
Awarding of Bid
Award may be made to the lowest responsive, responsible bidder meeting applicable county and
state procurement requirements. In reviewing the bids received, the County reserves the right to
reject, for any reason whatsoever, any and all bids, and to waive any informality or irregularity in
a bid. The County reserves the right to accept the bid that provides the best value to the County
in the County’s sole discretion. The County reserves the right to make a determination in the
County’s sole discretion as to the sufficiency of qualifications of any bidder. The action to award
a contract is subject to approval by the Board of County Commissioners. The submission of a
bid does not in any way commit the County to enter into an agreement or contract with that
bidder.
Bidder must identify for non-disclosure purposes, any information contained within the proposal
that is proprietary in nature or protected by copyright, trademark, or other intellectual property
law. Montrose County will maintain confidentiality of such materials to the extent permitted by
law, the County is subject to the provisions of the Colorado Open Records Act (CORA), C.R.S.
24-72-201, et seq., and cannot therefor guarantee that any materials provided will not be
produced in response to a CORA request.
It is anticipated that award of the contract will be made within two (2) weeks of the bid opening.
All bidders will be notified of the Commissionersdecision. Within two weeks of award, any
required submittals will be due. A purchase order will be used for authorization to proceed.
Requirements of Successful Bidder
A payment and performance bond equal to 100% of the bid amount will be required as
outlined in C.R.S. 38-26-106 and the contract agreement.
Furnish certificates of required insurance coverage.
Furnish a completed Form W-9 “Request for Taxpayer Identification Number and
Certification”.
Enter into a contract agreement with Montrose County.
Furnish an Equal Employment Opportunity Certification letter.
Provide a list of subcontractors.
Provide an anticipated work schedule that includes dates of construction for each site
(roadway).

Additional Terms and Scope of Services
1. The contractor shall meet the specifications as shown on Attachment A” – Project
Specifications 2026 Asphalt Paving.
2. Montrose County Road and Bridge shall be responsible for all subgrade prep work.
Work shall be completed by September 30, 2026.
3. The Owner’s Representative will be a county staff member. This person will be on the
job site periodically to observe operations.
4. Owner’s quality assurance testing of HMA material, including field density testing, will
be performed by Yeh & Associates and paid for by the County.
5. The County will inspect periodically for compliance with specifications. At any time, it
is determined that the work does not meet the specifications, paving operation may be
ordered to cease until specifications can be met.
6. Consistent out-of-specification performance shall be sufficient grounds for termination of
the contract and claim for damages including claims against Contractor’s bond.
7. Once work commences at a site, the work shall proceed in a timely matter to achieve
completion of work at that site.
8. HMA bid quantities have been increased by 5% to account for additional material that
may be needed to correct any deficient road crown and cross-slope.
9. Contractor shall be paid for HMA delivered and compacted in place. The tons of unused,
waste HMA that is not placed and compacted shall not be included in the pay amount.
10. Owner will field mark the pavement start and stop locations for each site (roadway).
11. Contractor shall be responsible for the removal of asphalt millings. Contractor shall haul
the millings to the Montrose County Shavano Pit located at 60768 Highway 90,
Montrose, CO or other location as directed by the County.
12. Contractor shall provide paint striping as per Section 2.22 in the Project Specifications
for all roads.
13. Montrose County will be responsible for gravel shouldering of roads after paint striping
has been completed by Contractor.
14. Bid prices are to be free of sales tax.
15. Contractor shall complete the work no later than November 30, 2026, unless written
permission by the County is granted to extend the completion date.
16. If the deadline for completion is not met, the County may assess liquidated damages
against the Contractor in the amount stated in the contract until the contract is finished.
