I. SCOPE OF WORK AND SPECIFICATIONS
A. PURPOSE OF THIS REQUEST FOR PROPOSALS
Lincoln County is hereby seeking formal, sealed proposals from qualified licensed
contractors authorized to do business in the State of New Mexico for County wide general
construction services utilizing a GB-98 license for a multi-source on-call/on-demand basis
in accordance with the specifications contained in this Request for Proposal (RFP).
Submitting a proposal for this Request for Proposal (RFP) implies agreement by the
proposer to these terms.
Federal funding may be used for purchases under this contract. If federal funds are used,
the Contractor is required to comply with federal regulations in addition to local law.
Applicable federal requirements are set forth in this RFP under section X. If federal funds
will not be used, anything in section X of this RFP is not a requirement. It is the
responsibility of the Contractor to determine if federal funds will be used under any
contract, and the responsibility of the Participating Agency to provide such information
upon request. Performance of work under federal funds is at the discretion of the contractor.
Use by Other Government Agencies: It is the intention of Lincoln County to make any
award made under this solicitation available for use by other government agencies within
the State of New Mexico, if allowed by law and their governing directives. Reference
paragraph III C 28 herein for more detailed information.
The Procurement Code, 13-1-28 through 13-1-199 NMSA 1978, imposes civil,
misdemeanor and felony criminal penalties for its violation. In addition, the New Mexico
criminal statutes impose felony penalties for bribes, gratuities and kick-backs.
B. SCOPE OF WORK
Lincoln County reserves the right to issue one or multiple awards for the listed items
and services. Multiple awards are anticipated to ensure availability and timely delivery.
Multiple awards are also anticipated to ensure Lincoln County Taxpayers that Lincoln
County is providing the best product for the most efficient overall cost as reasonably
possible.
Lincoln County is hereby soliciting formal, sealed proposals from qualified licensed
contractors authorized to do business in the State of New Mexico for County wide
general construction services utilizing a GB-98 license for a multi-source on-call/on-
demand basis described herein. Per New Mexico Procurement Code Statute 13-1-153
multiple source award; limitations on use and determination required, Lincoln County
has determined that it is necessary to make a multiple source award to ensure the
vendor requirements of responding to emergencies within a two (2) hour time period
can be achieved.

C. CONTRACT TERM
The initial term of this contract shall be for one (1) year, from to 2026-2027. The County
reserves the right to extend this contract, on an annual basis (or any portion thereof) and
by mutual agreement, for up to three (3) additional one-year terms for annual updates.
Under no circumstances will the term of this contract, including any extensions thereto,
exceed three (3) years.
D. PROFESSIONAL LIABILITY INSURNCE
The successful offeror shall maintain professional liability insurance covering any error or
omission committee during the term of the contract. The amount shall be $1,000,000.
E. PROCUREMENT MANAGER
Lincoln County has designated a Procurement Manager who is responsible for this
procurement and whose name, address, and telephone number are listed below. Any
inquiries or requests regarding this procurement should be submitted to the Procurement
Manager in writing. Offerors may contact ONLY the Procurement Manager regarding the
procurement. Other County employees do not have the authority to respond on behalf of
Lincoln County. Contacting any other Lincoln County employee, department head or
manager in regard to this RFP may result in disqualification of the potential offeror’s
proposal.

F. DEFINITION OF TERMINOLOGY
This section contains definitions that are used throughout this procurement document, including
appropriate abbreviations.
“Addendum” A written or graphic instrument issued prior to the opening of Proposals which
clarifies, corrects, or changes the Request for Proposals. Plural: addenda.
“Board of County Commissioners” also “BOCC” The elected board in whom all powers of the
County are vested and who are responsible for the proper and efficient administration of the County
government.
"Close of Business" means 5:00 P.M. Mountain Standard Time (MST) or Mountain Daylight Time
(MDT), whichever is in effect on the date specified.
"Chief Procurement Officer" means the person or designee authorized by the County of Lincoln to
manage or administer a procurement requiring the evaluation of proposals. In the County of

Lincoln, this is the County Manager.
"Contract" or “Agreement” A written agreement for the procurement of items of tangible personal
property or services.
"Contractor" A successful offeror who enters into a binding contract.
"County" The County of Lincoln, State of New Mexico and or Lincoln
County.
"Determination" The written documentation of a decision of the procurement manager including
findings of fact required to support a decision. A determination becomes part of the procurement
file to which it pertains.
“Desirable" The terms "may", "can", "should", "preferably" or "prefers," which identify a
discretionary item or factor. (As opposed to a “mandatory” item or factor.)
"Evaluation Committee" A body appointed by County management to perform the evaluation of
offeror proposals.
"Evaluation Committee Report" A report prepared by the Procurement Manager and the
Evaluation Committee for submission to appropriate approval authorities for contract award that
contains all written determinations resulting from the conduct of a procurement requiring the
evaluation of competitive sealed proposals.
"Finalist" is defined as an offeror who meets all the mandatory specifications of this Request for
Proposal and whose score on evaluation factors is sufficiently high to merit further consideration
by the Evaluation Committee.
"Mandatory" refers to the terms "must", "shall", "will", "is required" or "are required," which
identify a required item or factor. (As opposed to a “desirable” item or factor.) Failure to meet a
mandatory item or factor will result in the rejection of the Offeror's proposal.
"Offeror" means any person, corporation, or partnership legally licensed to provide professional services
in this state, who chooses to submit a proposal in response to Request for Proposals.
"Page” means one (1) side of an 8 ½ X 11-inch sheet of paper. One (1) 8 ½ X 11-inch sheet of
paper printed on both sides constitutes two (2) pages. (See, however, Section III.C for the one
exception to the 8 ½ X 11-inch page size limitation.)
"Procurement Manager" means the person or designee authorized by the County to manage or
administer a procurement requiring the evaluation of competitive sealed proposals; also referred
to as “Chief Procurement Officer,” or “Chief Procurement Officer,” in this document and
attachments.
"Procuring agency of the County" means the department or other subdivision of Lincoln County
that is requesting the procurement of services or items of tangible personal property.
