SPECIAL PROVISIONS
The purpose of this project is to procure delivery of specified chemicals to the City of Effingham Water
Treatment Plant to be used in the production of potable water.
The following Special Provisions supplement the “Standard Specifications for Road and Bridge
Construction of the State of Illinois”, adopted January 1, 2022, which govern the FY 2027 Water
Treatment Plant Chemicals Program, City of Effingham, Illinois, and in case of conflict with any contract
documents, Article 105.05 shall apply.
All Federal, State and local laws, ordinances, and regulations shall be observed and complied with which
may in any manner affect the conduct of the work, including the payment of Prevailing Wages for
employees if applicable.
ACCEPTANCE OF BIDS
The City of Effingham reserves the right to reject any or all proposals, waive or not waive any informality
in the proposals, and to accept any proposal which it deems most favorable to the City. The intent of the
City is to award a contract for the best bid of each Group. A contractor could be awarded one or more
Groups. Each Group will be evaluated independently from the other Groups.
Proposals with any limits or conditions on the requirements or provisions of these Special Provisions will
not be considered for acceptance. The City shall have the sole discretion in determining if any limits or
conditions of a bid are unacceptable.
CONTRACT TIME
The effective date of the bid unit prices will be May 1, 2026 upon acceptance by the City. The Bids
accepted will remain effective and firm for Fiscal Year 2027 (May 1, 2026 to April 30, 2027) unless
terminated as provided for herein.
By providing a Proposal, it is understood and agreed that the chemicals to be provided are essential to
the treatment of water used within the City’s public water distribution system, and that without delivery
of such chemicals in strict compliance with times provided for delivery of said material as set forth
herein, the City will suffer financial loss, and will not be able to provide adequate and safe drinking water
to the public, and therefore, the delivery of such material in strict compliance with the time period
provided for delivery is vital to public health, safety and welfare. Therefore, the City and those providing
Proposals agree that time is of the essence in the delivery of these products.
PROJECT COST
Unit prices shall include any and all service, delivery, and fuel surcharges. Unit prices shall be provided
for the units of measure as shown on the schedule of prices.
The quantities shown in the proposal are the approximate quantities required to complete the work.
The City reserves the right to delete up to twenty-five percent (25%) of the work for budgetary reasons
or due to conflicts with other construction work.

SUBSTANCE ABUSE AND PREVENTION PROGRAM
In addition to all other labor requirements set forth in this proposal and in the Standard Specifications
for Road and Bridge Construction, adopted by the Department, during the performance of this contract,
the Contractor for itself, its assignees, and successors in interest (hereinafter referred to as the
“Contractor”) agrees as follows:
Before the Contractor and any Subcontractor commences work, the Contractor and any Subcontractor
shall have in place a written Substance Abuse Prevention Program for the prevention of substance abuse
among its employees which meets or exceeds the requirements in P.A. 95-0635 or shall have a collective
bargaining agreement in effect dealing with the subject matter of P.A. 95-0635. The Contractor and any
Subcontractor shall file with a public body: a copy of the substance abuse prevention program along with
a cover letter certifying that their program meets the requirements of the Act, or a letter certifying that
the Contractor or a Subcontractor has a collective bargaining agreement in effect dealing with the
subject matter of this Act.
INSURANCE
The Contractor is required to furnish the City with Certificates of Insurance in the following amounts and
the City of Effingham will be listed as an Additional Insured on a primary non-contributory basis. The
Certificate of Insurance shall be accompanied by an “Additional Insured – Designated Person or
Organization” form.

Certificates of Insurance shall contain a provision or endorsement that the coverage afforded will not be
canceled, materially changed or renewal refused until at least 30 days prior written notice has been
given to Owner and Contractor.
Certificates of Insurance remain in effect at least until final payment and at all times thereafter when
Contractor may be correcting, removing, or replacing defective Work.
DELIVERY
Delivery is to be at the City of Effingham Water Treatment Plant at 1910 W. National Avenue. The
contractor shall be responsible for unloading the material to the ground, loading dock, or bulk tank as
requested by the Water Treatment Plant Lead Operator. City staff will provide access to the facility but
will not assist with unloading materials.
Deliveries shall be made between 7:00 a.m. and 3:00 p.m. Central Standard Time Monday through
Friday. A minimum of 2-hour notice shall be given to the Water Treatment Plant Lead Operator.
Deliveries must be made as requested by the Water Treatment Plant Lead Operator, with a maximum
lead time of 2 weeks.
