The Dallas County Conservation Board, Iowa is seeking competitive quotations for the construction of the public improvement hereafter described. Contractors qualified to perform the work and able to obtain the required performance and payment bond are invited to submit competitive quotations, pursuant to the requirements of Section 26.14 of the Iowa Code.

Description of the Public Improvement Work to be Performed Pursuant to This Solicitation: The public improvement work for which the County is seeking competitive quotations is generally described as follows: The work includes all materials, equipment, transportation, and labor necessary to complete the improvements. The proposed project includes 248 SY of Full Depth HMA Patching, 54 SY of T-Patching, 7,382 LF of Crack and Joint Cleaning and Filling, and temporary traffic control.

Plans and Specifications: Plans and specifications for construction of said public improvement are available and may be examined at the Dallas County Conservation Board, 14581 K Avenue, Perry, IA 50220. Hard copies may be obtained from Snyder & Associates, 2727 SW Snyder Boulevard, Ankeny, Iowa 50023 at no charge.

Time, Place and Manner for Filing Competitive Quotations: Competitive quotations to construct the public improvement work described above shall be filed in the office of the Dallas County Conservation Board, 14581 K Avenue, Perry, IA 50220, on or before 11 a.m. on October 1, 2026.

  1. Placing them in the United States Mail, appropriately stamped and addressed to the Dallas County Conservation’s office at the address listed above.
  2. Filing them in person / in hand at the office of the Dallas County Conservation Board at the address listed above.

If a competitive quotation is delivered by U.S. Mail or by in-hand delivery, it shall be placed in a sealed envelope addressed to Dallas County Conservation at the address stated above. Competitive quotations received after the time stated above will not be considered and the quoting contractor will be so notified.

REQUEST FOR QUOTATIONS (RFQ)

TRAIL PAVEMENT REHABILITATION
DALLAS COUNTY, IOWA
The Dallas County Conservation Board, Iowa is seeking competitive quotations for the construction of the
public improvement hereafter described. Contractors qualified to perform the work and able to obtain the

Competitive Quotations to be Submitted on Form Provided:
Competitive quotations shall be filed on the Competitive Quotation form provided by the County and
included with this RFQ. Competitive quotations which are filed in any other form shall be determined to be
non-responsive and shall be rejected by the County.
Documentation of Costs to be Included in Competitive Quotations Submitted by Contractors:
Interested contractors are required to include in their competitive quotations the price for labor, materials,
equipment and supplies required to perform the work.
Evidence of Insurance Required:
Each contractor submitting a quotation pursuant to this RFQ shall be required to commit to provide to the
County, at the time of the award and execution of the contract, a certificate or certificates of insurance,
evidencing insurance with coverages and in amounts as required by the County and as set forth in section
1070 of the Iowa Statewide Urban Standard Specifications for Public Improvement.

Required Commitments by Contractors:
Contractors submitting quotations pursuant to this RFQ shall be required to commit to the execution of a
contract for the work in the form required by the County, which form of contract is included with this RFQ.
Contractors submitting quotations pursuant to this RFQ shall be required to commit to the completion of the
work on or before November 30th, 2026.
Sales Tax:
A. The County will issue a sales tax exemption certificate to the Contractor for all materials purchased
on the project. The County will issue the appropriate exemption certificates and authorization letters
to the Contractor and all subcontractors completing work on the project. Tax exemption certificates
are applicable only for the specific project for which the tax exemption certificate is issued.
B. The Contractor shall provide a listing to the County identifying all appropriate subcontractors
qualified for use of the tax exemption certificate. The Contractor and subcontractors may make
copies of the certificate and provide to each supplier providing construction material a copy of the tax
exemption certificate.
Evaluation of Competitive Quotations:
If a quoting contractor does not submit its quotation on the form required by the governmental entity or does
not provide all information or documentation or make all commitments required by the governmental entity,
or does not cause said form to be executed as required by the governmental entity, said quotation shall be
determined to be non-responsive and shall be rejected by the governmental entity.
Performance and Payment Bond Required:
The contractor who is awarded the contract to perform the work shall be required to provide a performance
and payment bond to secure the performance and timely completion of the work and to secure the payment of
subcontractors and suppliers, as required by Section 573.2 of the Iowa Code.
Notification to Contractors:
Each contractor submitting a quotation pursuant to this RFQ shall be notified of the winning contractor.
Execution of Contract:
Upon the County's determination which contractor has submitted the lowest responsive, responsible
quotation, the County will take action to award the contract to that contractor, conditioned upon the
contractor's submission, and the County's approval, of the contractor's performance and payment bond and
evidence of insurance, and further conditioned upon the contractor's execution of a contract in the form
included with this RFQ and its approval and execution by the County. Notwithstanding anything to the
contrary in this RFQ or any other component part, the County is not obligated to enter into a final contract
with the winning bidder and a winning bid shall not create any interest in the subject matter of this RFQ
unless and until the County executes the necessary final contract with the winning bidder.

following described public improvement:

Quoting Contractor's Acknowledgments.:

County) reserves the right to:
1. Reject any, or all, competitive quotations. Award of the contract, if any, shall be made to be to the
lowest responsive, responsible bidder.
2. Make such alterations in the contract documents or in the proposal quantities as it determines
necessary in accordance with the contract documents after execution of the contract. Such alterations
shall not be considered a waiver of any conditions of the contract documents, and shall not invalidate
any of the provisions thereof.
3. Notwithstanding anything to the contrary in this competitive quotation or any other component part,
the County is not obligated to enter into a final contract with the winning bidder and a winning bid
shall not create any interest in the subject matter of the RFQ unless and until the County executes the
necessary final contract with the winning bidder.
Quoting Contractor's Agreements:

1. To enter into a Contract to Construct a Public Improvement with the County, if this Competitive
Quotation is selected, in the form included in the RFQ.
2. To provide insurance in the form and limits required by the County and as set forth in section
1070 of the Iowa Statewide Urban Standard Specifications for Public Improvement.
3. To furnish a performance, payment, and maintenance bond upon execution of the contract in
accordance with Chapter 573 of the Iowa Code, in the form acceptable to the County.

CONTRACT
THIS CONTRACT, made and entered into this day of , 2026, by and between
the Dallas County Board of Supervisors, 800 Court Street, Adel, IA 50003 party of the first part, hereinafter
referred to as the COUNTY and _______ , party of the second part, hereinafter referred to as
the CONTRACTOR.
WITNESSETH: THAT WHEREAS, the COUNTY has heretofore caused to be prepared certain plans,
specifications and proposal blanks for the RACOON RIVER VALLEY TRAIL REDFIELD TO ADEL -
TRAIL PAVEMENT REHABILITATION under the terms and conditions therein fully stated and set forth,
and, WHEREAS, said plans, specifications and proposal blanks accurately and fully describe the terms and
conditions upon which the Contractor is willing to do the work specified:
NOW, THEREFORE, IT IS AGREED:
1. That the COUNTY hereby accepts the quotation of the CONTRACTOR for the work as follows:
The work includes all materials, equipment, transportation, and labor necessary to complete the
improvements. The proposed project includes 248 SY of Full Depth HMA Patching, 54 SY of T-
Patching, 7,382 LF of Crack and Joint Cleaning and Filling, and temporary traffic control.
The Contractor agrees to perform said work for and in consideration of the County's payment of the

damages will be difficult to compute, the parties agree that liquidated damages for noncompliance

damages are an appropriate measure of damages and are not a penalty.

PERFORMANCE, PAYMENT AND MAINTENANCE BOND
KNOW ALL BY THESE PRESENTS:
That we, , as Principal (hereinafter the "Contractor" or "Principal") and

injured by any breach of any of the conditions of this Bond in the penal sum of

Work includes commitment to faithfully perform all the terms and requirements of said Contract within the
time therein specified, in a good and workmanlike manner, and in accordance with the Contract Documents.
It is expressly understood and agreed by the Contractor and Surety in this bond that the following provisions
are a part of this Bond and are binding upon said Contractor and Surety, to-wit:
1. PERFORMANCE: The Contractor shall well and faithfully observe, perform, fulfill and abide by
each and every covenant, condition and part of said Contract and Contract Documents, by reference
made a part hereof, for the above referenced improvements, and shall indemnify and save harmless
the County from all outlay and expense incurred by the County by reason of the Contractor's
default or failure to perform as required. The Contractor shall also be responsible for the default or
failure to perform as required under the Contract and Contract Documents by all its subcontractors,
suppliers, agents, or employees furnishing materials or providing labor in the performance of the
Contract.
2. PAYMENT: The Contractor and the Surety on this Bond are hereby agreed to pay all just claims
submitted by persons, firms, subcontractors, and corporations furnishing materials for or
performing labor in the performance of the Contract on account of which this Bond is given,
including but not limited to claims for all amounts due for labor, materials, lubricants, oil, gasoline,
repairs on machinery, equipment and tools, consumed or used by the Contractor or any
subcontractor, wherein the same are not satisfied out of the portion of the contract price which the
County is required to retain until completion of the improvement, but the Contractor and
Surety shall not be liable to said persons, firms, or corporations unless the claims of said claimants
against said portion of the contract price shall have been established as provided by law. The
Contractor and Surety hereby bind themselves to the obligations and conditions set forth in Chapter
573, Code of Iowa, which by this reference is made a part hereof as though fully set out herein.

3. MAINTENANCE: The Contractor and the Surety on this Bond hereby agree, at their own expense:
A. To remedy any and all defects that may develop in or result from work to be performed
under the Contract within the period of four (4) years from the date of acceptance of the
work under the Contract, by reason of defects in workmanship or materials used in
construction of said work;
B. To keep all work in continuous good repair; and
C. To pay the County's reasonable costs of monitoring and inspection to assure that any defects
are remedied, and to repay the County all outlay and expense incurred as a result of
Contractor's and Surety's failure to remedy any defect as required by this section.
Contractor's and Surety's agreement herein made extend to defects in workmanship or materials not
discovered or known to the County at the time such work was accepted.
4. GENERAL: Every Surety on this Bond shall be deemed and held bound, any contract to the
contrary notwithstanding, to the following provisions:
A. To consent without notice to any extension of time to the Contractor in which to perform the
Contract;
B. To consent without notice to any change in the Contract or Contract Documents, which
thereby increases the total contract price and the penal sum of this bond, provided that all
such changes do not, in the aggregate, involve an increase of more than twenty percent of the
total contract price, and that this bond shall then be released as to such excess increase; and
C. To consent without notice that this Bond shall remain in full force and effect until the
Contract is completed, whether completed within the specified contract period, within an
extension thereof, or within a period of time after the contract period has elapsed and the
liquidated damage penalty is being charged against the Contractor.
The Contractor and every Surety on the bond shall be deemed and held bound, any contract to the contrary
notwithstanding, to the following provisions:
D. That no provision of this Bond or of any other contract shall be valid which limits to less
than five years after the acceptance of the work under the Contract the right to sue on this
Bond.
E. That as used herein, the phrase "all outlay and expense" is not to be limited in any way,
but shall include the actual and reasonable costs and expenses incurred by the County
including interest, benefits and overhead where applicable. Accordingly, "all outlay and
expense" would include but not be limited to all contract or employee expense, all
equipment usage or rental, materials, testing, outside experts, attorney's fees (including
overhead expenses of the County's staff attorneys), and all costs and expenses of
litigation as they are incurred by the County. It is intended the Contractor and Surety will
defend and indemnify the County on all claims made against the County on account of
Contractor's failure to perform as required in the Contract and Contract Documents, that
all agreements and promises set forth in the Contract and Contract Documents, in
approved change orders, and in this Bond will be fulfilled, and that the County will be
fully indemnified so that it will be put into the position it would have been in had the
