APEX Accelerators are an official government contracting resource for small businesses. Find your local APEX Accelerator (opens in new window) for free government expertise related to contract opportunities.
APEX Accelerators are funded in part through a cooperative agreement with the Department of Defense.
The APEX Accelerators program was formerly known as the Procurement Technical Assistance Program (opens in new window) (PTAP).
Under the authority of 10 USC 2304(c) and FAR 13.106-1(b)(1)(i), there is only one responsible source and no other supplies or services will satisfy the agency requirements. These preventative maintenance, calibration, and corrective maintenance services can only be performed by the Original Equipment Manufacturer (OEM). The determination that the procurement for this service is a Sole Source requirement is based on the following excerpt from the Limited Source Justification form dated 12/05/24: "This manufacturing company's equipment has proprietary rights. These rights limit the technicians to be SCHENCK certified to perform Calibrations, Preventative and or Corrective Maintenance. SCHENCK is the only company that has certified SCHENCK technicians." Therefore, this requirement is to be solicited in accordance with Sole Source exclusive rights.
