SUNY Upstate Medical University (“Upstate”) intends to make an award to Interoperability Bidco, Inc., d/b/a Rhapsody, under our discretionary authority, pursuant to NYS Education Law §355(5)(a) for the above noted service, which authorizes purchases without a formal competitive process in certain circumstances, including purchases from NYS small businesses, from business certified pursuant to Article 15-A of the NYS Executive Law and if applicable, from businesses selling commodities or technology that are recycled or remanufactured. A sealed bid will not be held. Effective 11/1/2006, in accordance with State Finance Law Section §139j&k, aka the
Lobbying Law, all questions pertaining to this procurement shall be made formally to
the designated staff; the contact person for questions or bid clarifications and the
contact person to whom you must submit a bid. Contact made to other staff
regarding this procurement may disqualify the firm and affect future procurement
with government entities in the State of New York.
