SELECTION OF ESCO FOR ESPC
A. OVERVIEW
The provisions encompassed within this document are those that apply to all contracts and
are part of each formal bid package completed by the City of Newark. Should the General
Provisions conflict with the Technical Specifications or any Special Provisions, the Technical
Specifications or Special Provisions shall prevail. Bidders or their authorized representatives
are required to fully acquaint themselves as to the requirements and regulations of the City
of Newark and State of Delaware procurement laws prior to submitting a bid.
B. RFP PURPOSE
The City of Newark is soliciting proposals from qualified Energy Services Companies
(ESCOs) to provide a turnkey Energy Savings Performance Contract (ESPC) for applicable
City-owned facilities.
The selected ESCO will perform an Investment Grade Audit (IGA), identify and design
energy conservation measures (ECMs), provide construction and implementation
services, guarantee energy and operational savings, and perform ongoing measurement
and verification (M&V).
This RFP will result in the selection of ONE ESCO with whom the City will negotiate a
comprehensive ESPC covering the City’s entire municipal facility portfolio.
This solicitation is issued as a merit-based procurement pursuant to Delaware Title 29 and
applicable Energy Performance Contracting statutes and is intended to result in a
negotiated Energy Savings Performance Contract. Selection will be based on
qualifications, experience, and overall value to the City.
Select energy conservation measures (ECMs) the City intends to investigate with the
selected ESCO include, but may not be limited to:
Installing solar photovoltaic (PV) systems where applicable and appropriate in an
amount that would not exceed municipal electrical consumption, including:
o The installation of rooftop solar on a ~10,000 sq ft new warehouse section at
the Field Operations Complex
o The installation of solar canopy systems in parking lots on City property,
possibly with combined electric vehicle (EV) charging stations
o The installation of rooftop solar on private commercial buildings in Newark
(negotiated with third parties through another RFP)
Installing battery energy storage systems (BESS) where applicable and factoring in
economics of non-backup power applications

Installing controllable smart water heaters, thermostats, and EV chargers where
applicable
Installing waterless, low-flow, or other water conservation plumbing fixtures at City
facilities
Installing exterior motion sensor timers on light fixtures at the Field Operations
Complex and other appropriate City facilities
Replacing a 10,000-gallon unleaded/5,000-gallon diesel underground storage tank
(UST) and associated fuel pumps with a smaller, more efficient model
Replacing exterior lights in Newark parks and trails with LEDs
Installing directional light shielding on exterior lights in Newark parks and trails to
reduce light pollution
Completing other generator or resiliency-related improvements
The City reserves the right to accept additional ECMs as identified by the selected
ESCO, or reject any ECMs (including those listed as options here), at their sole
discretion.
C. CITY BACKGROUND
The City of Newark was chartered in 1758 and is approximately nine square miles in size.
Per the Delaware Population Consortium (DPC), the City’s population is over 30,000
residents, making Newark the third most populous municipality in the State of Delaware.
The city boasts a thriving downtown with a quintessential Main Street, an active economic
climate, and strong development activity, with an abundance of top-rated parks and
recreation programs and facilities. Newark is also home to the University of Delaware,
which is currently the City’s largest employer.
Newark is a full-service municipality, operating electric, sewer, water, and stormwater
utilities for its service territories, as well as a nationally recognized Police Department and
Alderman’s Court in the Newark Municipal Center (220 South Main Street; Newark, DE
19711). Newark functions through a Council-Manager form of government, with a non-
partisan elected Mayor and six Councilmembers. City Council meetings typically occur on
the second, third, and forth Mondays of each month, excluding City recognized holidays.

In 2022, Newark completed an ESPC valued at approximately $10 million, through which
the following ECMs were accomplished:
HVAC upgrades and repairs at the City Municipal Center and George Wilson
Community Center
Lighting upgrades for City facilities, streetlights, and parking lots
