The Georgia World Congress Center Authority (¿Authority¿) will receive responses from firms specializing in Banquet Chairs. The Authority retains the right to reject any or all submittals, and to waive technicalities, irregularities, and informalities, or cancel this procurement at any time. IMPORTANT- A RESTRICTION OF COMMUNICATION IS IN EFFECT FOR THIS PROJECT. From the time of advertisement of this solicitation until final award is made, interested firms are not allowed or permitted to communicate about this solicitation or scope with any staff or any official representatives of the Authority, GWCC, or other facilities of the Authority, or their consultants, except for submission of questions as instructed in the IFB, or as provided by any existing work agreement(s). The GWCCA is accepting sealed bids for the purchase of Banquet Chairs and accessories for conventions, meetings, and entertainment use in the Georgia World Congress Center.
All respondents to this IFB are subject to instructions communicated in this document and are cautioned to completely review the entire IFB and follow instructions carefully. The Authority retains the right to reject any or all submittals and/or bids, and to waive technicalities, irregularities, and informalities, and retains the right to cancel or conclude this procurement at any time without selecting a firm to provide the described services, without any liability to any respondents, or any other person or entity, and is under no obligation to make an award relating to this IFB to any person or entity. The final terms of any Agreement for the project contemplated by this procurement will be determined by the Authority, subject, in all cases, to strict compliance with the applicable provisions of the laws of the State of Georgia.
All submitted bids must be secured in a sealed, opaque envelope, with reference to the correct bid number indicated clearly and prominently on the outside of the envelope. Sealed bids should be addressed to the GWCCA Purchasing Department, 285 Andrew
Young International Blvd., Atlanta, GA 30313, and should be received by the Purchasing Department one hour prior to bid opening, if sent by courier or mail, etc. With the submission of a valid bid, the bidder agrees that the bid may not be withdrawn for a period of thirty-five (35) days. Due to the anticipated dollar amount, verbal, faxed, or unsealed bids will not be accepted.
Please note that the Georgia World Congress Center Authority is a Tax-Exempt Authority of the State of Georgia. The Authority reserves the right to waive technicalities and informalities. Schedule of IFB Events
The following Schedule of Events represents the Authority's best estimate of the schedule that will be followed. All times indicated are Eastern Standard Time. The Authority reserves the right to adjust the schedule as deemed necessary. If a component of this schedule, such as the close date, is delayed, the rest of the schedule may be shifted as appropriate.
BID CONDITIONS
SCOPE - It is the intent of the Georgia World Congress Center Authority to immediately engage the successful vendor(s) for coordination of the purchase of all services specified (see SPECIFICATIONS.), with the vendor(s) assuming responsibility for delivery and all transfer fees.
PRICE - The bidder is required to propose firm prices for the individual items specified, so as to provide the Purchasing Office with complete and accurate costing information to be used as a basis for awarding a contract. All prices submitted shall be F.O.B. Destination, and include dock delivery, unless specified otherwise herein. Payment terms shall be attached to or indicated on the bid. Payment discounts over 5% will not be considered in evaluation. The bidder shall indicate on the Bid Form the total amount of the bid and shall include a statement by the bidder of whether the total amount is or is not representative of all of the items indicated in the specifications herein. In the event there is a discrepancy between the extended price(s) and the unit price(s), the unit prices shall govern. Bid responses containing a minimum order/ship quantity or dollar value, unless otherwise called for in the specifications herein, may be treated as non-responsive and may not be considered for award. In accordance with state law, bid responses containing provisions for late or interest charges may not be awarded a contract. Bidders are instructed to remove or strike through any reference to this provision in or on vendor printed forms and to initial changes prior to submitting a bid response to the Authority.
SUBMISSION OF BIDS - The Bids shall be submitted on the attached Bid Form or as otherwise herein instructed and shall be notarized, and submitted prior to bid deadline in a sealed, opaque envelope with reference to the correct BID NUMBER and the words "SEALED BID" indicated clearly and prominently on the outside of
the envelope, to be considered as a valid bid. If sent by courier or mail, etc., sealed bids shall be addressed to the GWCCA Purchasing Department, 285 Andrew Young International Blvd., Atlanta, GA 30313, and shall be received by the Purchasing Department at least one hour prior to bid opening. All bids must by typed or written in ink. Only one bid and, if requested, copies of that particular bid should be sent in an envelope. Vendors bidding on more than one solicitation must use a separate envelope for each bid. Fancy bindings, colored displays and/or promotional material other than hose necessary are not desired. Emphasis in each proposal must be on completeness and clarity of content. To expedite the evaluation of bids, it is essential that bidders follow the format and instructions contained herein. The bidder is requested to provide company information, performance data, as well as stated payment and delivery terms. Any changes, options, or substitutions that the successful vendor proposes must be approved in advance by the GWCC Purchasing Department. All expenses for preparing and submitting a bid, product samples, and product demonstration(s), are the sole costs of the party submitting the bid. The Owner is not obligated to any party to reimburse such expenses. All bids upon receipt, become the property of the Owner. Labeling information provided in bids "proprietary" or "confidential", or any other designation of restricted use will not protect the information from public view. BID EVALUATION AND AWARD - The Georgia World Congress Center
Authority intends to award a contract or purchase order to the responsible and responsive vendor that provides the best-suited product and cost, with respect to the criteria below, and satisfactory stated delivery time. Other factors, however, may be considered, including, but not limited to, past performance or references, and payment terms indicated.
CRITERIA: Due to the nature of this prospective procurement of equipment, the varieties of equipment of this type generally available in the market, and the Owner's desire to purchase equipment with aesthetic appeal, functional quality, and "fit" to the application, the Owner will base the overall evaluation of valid bids on the following criteria:
Technical Merit, (60%)
Technical Merit shall be judged as follows:
General qualifications, relevant experience, proposed approach, responsiveness and references. Describe in detail information for each above merit.
Cost, (40%)
Cost shall be evaluated including predicted costs of selected items, warranties, and payment terms indicated (see Payments).
The Owner intends to award a contract (or Purchase Order) to the vendor or vendors that provide(s) the best overall service/product, with respect to the stated criteria.
The Georgia World Congress Center Authority reserves the right to reject any and all bids and waive technicalities and informalities. This request and any bid submitted in response, regardless of whether the bid is determined to be the best bid, is not binding upon the Owner and does not obligate the Owner to procure any goods or services. Neither the Owner, nor any party submitting a response shall be bound unless and until a written contract (or Purchase Order) mutually accepted by both parties is negotiated as to its terms and conditions and is signed by the Owner and a party containing such terms and conditions as are negotiated between those parties. The Owner reserves the right to waive non-compliance with any requirements of this solicitation and to reject any or all proposals submitted in response. Upon receipt and review of responses, the Owner shall determine the party(s) and bid that in the sole judgement of the Owner is in the best interest of the Owner (if any is so determined). The Owner then intends to conduct negotiations with such party(s) to determine if a mutually acceptable contract may be reached and in the course of doing so may use ideas expressed in any bid. If those negotiations, in the judgement of the Owner, are not successful, the Owner may, but is not required to, enter into negotiations with any other party that has submitted a bid.
RECIPROCAL PREFERENCE LAW - For the purposes of evaluation only, bidders resident in the State of Georgia will be granted the same preference over bidders resident in another State in the same manner, on the same basis, and to the same extent that preference is granted in awarding bids for the same goods or services by such other State to bidders resident therein bidders resident in the State of Georgia. For the purposes of this law, the definition of a resident bidder is one who maintains a place of business with at least one employee inside the State of Georgia. A post office box address will not satisfy this requirement.
PAYMENTS - The successful vendor(s) must invoice for payment, referencing the applicable contract or purchase order number. Successful vendor(s) will be provided our Sales and Use Tax Certificate of Exemption, and address for invoicing. Vendor is requested to allow a standard (30) day payment term, but other terms with payment discounts will be considered.
BRAND NAME STATEMENT: Any reference to brand names, trade names, model numbers or other descriptions peculiar to brand products is made to establish a required level of quality and functional capability, it is not intended to exclude other products of that level. Comparable products of other manufacturers will be considered if proof of comparability is contained in the bid. It shall be the responsibility of the bidder, including the bidder whose product is referenced, to indicate the brand name and model or series number of the product offered and to furnish with their bid such specifications, catalog pages, brochures or other data as will provide an adequate basis for determining the quality and functional capabilities of the product offered, and its comparability to the item(s) indicated herein. The Owner reserves the right to request samples of any bidders prior to bid award. Failure to provide this data to such extent may be considered valid justification for rejection of a bid.
STATEMENTS OF AGREEMENT (GENERAL INFORMATION) - Having
carefully examined the Invitation to Bid, and with submission of a bid, the Bidder agrees that they have discussed any issues in any section of the Invitation to Bid, with which the Bidder disagrees or wishes to clarify its positions, and understands that failure to list these items in its proposal will be interpreted to mean that the Bidder is in full agreement with the terms, conditions, specifications and requirements therein. With submission of a bid, the Bidder hereby certifies: (a) that this bid is genuine and is not made in the interest or on behalf of any undisclosed person, firm, or corporation; (b) that Bidder has not directly or indirectly included or solicited any other Bidder to put in a false or insincere bid; (c) that Bidder has not solicited or induced any person, firm, or corporation to refrain from sending a bid.
BID SUBSITUTIONS, ALTERNATES, EXCEPTIONS, AND EXTENSIONS:
Bidders that intend to propose alternate materials, equipment or substituted items, the specifications of which might be significantly different than the specifications of the items and/or services indicated herein, are required to request approval for such items from the Owner at least one week prior to time of bid opening, for such deviations to be considered. Such a request must completely describe all of the differences between the deviation and the specification herein in a simple, concise manner. If such a request is deemed by the Owner to have merit as an acceptable significant deviation, and is granted by the Owner, an addendum may be issued to all prospective bidders to inform them of such an allowance, and/or to amend the Specifications. The Owner reserves the right to extend the bid opening time based on such information but is not required to do so. The Owner reserves the right to cancel the solicitation in its entirety and possibly re-advertise and issue a revised Invitation to Bid for any reason. Any bidder exceptions to the information listed in the Conditions or Specifications must also be communicated to the Owner at least one week prior to time of bid opening to be properly considered. Any exceptions that the bidder has must be clearly noted on the bid to be considered by the Owner, regardless of whether or not such exceptions have already been communicated to the Owner. Similarly, any requests for bid opening time extensions must be communicated to the Owner at least one week prior to bid opening time, including the reason(s) for such a request. The Owner reserves the right to approve or reject such requests as the Owner deems necessary.

All Bidders should be aware that Contractors and subcontractors who utilize qualified minority subcontractors may qualify for a Georgia state income tax credits for qualified payments made to minority subcontractors. See Official Code of Georgia Annotated (O.C.G.A.) O.C.G.A. Section 48-7-38.
NON-DISCRIMINATION - The Owner may require, prior to, or incidental to, the award of a contract, confirmation by the Bidder that they have not discriminated and will not discriminate on the basis of race, creed, color, sex, religion or national origin in any of its employment practices with respect to the work force of the business, or procurement services in connection with this project. The successful Bidder may be required to execute certificates, affirming these requirements of non-discrimination.
DRUG FREE WORKPLACE: The Authority, as policy, operates all facilities as a drug-free workplace, and requires that the labor force of the Contractor be drug-free. The Contractor hereby acknowledges this requirement and asserts that the organization of the Contractor adheres to such policy and practice. The Contractor acknowledges that it may be required to execute certificates affirming these requirements of drug-free workplace, at execution, or at any time during the term of the agreement.
RESTRICTION OF COMMUNICATION: From the issue date of this solicitation
until a successful bidder is selected and the selection is announced, bidders are not allowed to communicate for any reason with any Authority staff about this solicitation except through the Issuing Officer named herein, or during any bidder's conferences (if applicable), or as provided by existing work agreement(s). For violation of this provision, the Authority shall reserve the right to reject the proposal of the offending bidder. All questions concerning this RFP must be submitted in writing (e-mail preferred or fax may be used) to the Issuing Officer. No response other than written will be binding upon the Authority.
