ADDENDUM NO. 1
TO THE CONTRACT DOCUMENTS FOR
Town of Middlebury
2026 Municipal Paving Project
Your attention is directed to the following changes in, additions to, or deletions from the Contract
Documents for the Town of Middlebury 2026 Municipal Paving Project. This complete
Addendum, including attachments, shall be included within the Contract Documents and shall
take precedence in the case of any discrepancies.
BIDDER must acknowledge receipt of all ADDENDA on the BID or may be considered non-
responsive. This Addendum consists of twelve (12) pages.
1. Pre-Bid Meeting Minutes: Attached and made a part of this contract are Pre-Bid Meeting
Minutes from April 27, 2026.
2. Bid Schedule: REMOVE the Bid Schedule its entirety and REPLACE with the Bid Schedule
as enclosed in this Addendum.
3. Special Conditions: ADD Special Condition 12 - Project Sequencing in its entirety to the
Contract Documents:
"12. Project Sequencing - The Town of Middlebury reserves the right to withhold
authorization to proceed with this work until June 30, 2026. The other sequencing
requirements are as follows:
Mary Hogan Drive and Parking Lot - This work shall occur after the completion of the Mary
Hogan Stormwater Improvement project, unless otherwise authorized by the Town. The
work shall be completed before the commencement of the 2026-2027 school year. The
Contractor shall coordinate directly with the Town of Middlebury and Champlain
Construction (the Contractor for the stormwater improvement project). It is expected that

Questions During Bid Phase
QUESTION: Can the working hours be extended beyond 5PM?
ANSWER: Yes, on a case-by-case basis. It should not be considered a habit, but
if mix is going down and it can allow an area to be finished that day it
would be considered acceptable. Starting before 7AM is not
acceptable.
QUESTION: Do you really want to mill a butt joint along the parking on south street
the entire length? It would likely be cost prohibitive for the size of the
project?
ANSWER: No. The bid quantities have been revised to allow for a full width
(curb to curb) shim and overlay on South Street. Refer to revised bid
schedule.
QUESTION: What is your expectation for driveway interfaces which are down gradient
from the road centerline?
ANSWER: When paving the apron, contractor can pave a small (shallow) swale
across the drive way or raise the edge of the paving and provide a lip
so that runoff is retained on the road.
QUESTION: What road would be removed if you don't have enough budget?
ANSWER: likely lower plains road. The Town reserves the right to remove an
alternate location however, depending on the bid pricing.
QUESTION: Are bonds required for the project, there is some conflicting information in
the documents?
ANSWER: No. The Town will not require a bid bond or the payment /
performance bonds. This is an error and bidders can consider any
reference to bonds stricken in the current contract. The final contract
will be adjusted accordingly.

QUESTION: In the Mary Hogan parking lot, your specs would basically require us to
remove all of the pavement because its spider webbed. Can you clarify
the intent?
ANSWER: Contractor to sweep road and remove loose debris from the service.
Potholes to be filled. Pave parking lot after applying emulsion.

PreBid Meeting Notes
A. Project Overview
1. Introduction
a. Town: Mattew Cram - Highway Division Chief
b. Town: Emmalee Cherington - Director of Engineering

2. Attendance
a. Sign in Roster attached to these meeting notes.
3. What is the Project:
a. The project involves the shim and overlay sections of the following roads:
Mary Hogan Parking Lot, Mary Hogan Drive, Rec Park Sidewalk, North Side of
the Department of Public Works Shop, Lower Plains Road, Seminary Street,
South Street and Willow Drive.
4. Funding
a. The Project is funded in whole from the Town of Middlebury.
5. Bid Requirements
a. The contractor must provide 5% Bid Bond.
i. The requirement to provide a bid bond has been waived with
Town Paving Contracts.
b. A signed Bid Form
c. A completed Bid Schedule
i. Read the Measurement and payment to understand how each item is
going to be paid and understand what is included in each Item (i.e.
Parts and Pieces)
6. Bid Opening Information
a. Bids are due on Thursday, May 7, 2026 at 2:00 p.m.
b. This may be modified via addendum
c. The bids are due to the Town of Middlebury.
d. The bid opening location is Public Works Building on 1020 Route 7 South
Middlebury, VT 05753.
e. Bids must be submitted in person or via mail.
i. Bidders shall consider travel time for packages when submitting their
bid by mail. Bids that arrive after the opening via mail will not be
accepted.

B. Schedule
1. Project Start Date
a. The anticipated project start date is in June and be completed by October. Refer
to the Special Conditions.
b. There is not an expectation of winter shutdown for this project.
2. Working Hours
a. Monday through Friday, 7 AM to 5 PM
b. Bidder is not expected to work on the following Holidays:
i. New Year's Day (January 1st), Patriot's Day (Mass.) Memorial Day, Independence
Day (July 4th), Labor Day, Veteran's Day, Thanksgiving Day and Day Following,
Christmas Day (December 25th).
C. Contract Requirements
1. Bonds
a. Bonds (payment and performance) are not required for this contract.
2. Insurance
a. Levels of Coverage
i. Bidder should review Article 6 of the General Conditions.
3. Special Provisions
a. Bidders should review the Measurement and payment along with the
Supplementary and special conditions before submitting their bid.
4. Paving Price Adjustment
a. Paving Price Adjustment is included in the bid documents. Refer to the
measurement and payment. The paving adjustment is calculated based only on
the Asphalt Binder used.
5. Temporary Facilities
a. This project does not require Bidder to provide field offices for the engineers.
b. All other temporary facilities are the contractors responsibility.
6. Easements
a. Contractor is required to work within the Town of Middlebury Highway Rights of
Way.
7. Communication / Coordination
a. Communication and coordination with the Town of Middlebury is a requirement
of the project. The Town will furnish risers for grade adjustment and help locate
structures with advanced notice. The Town requests a minimum of 2-weeks
notice.

D. Additional Items of Note
1. Engineers Estimate
a. There is no Engineer's estimate for this project.
2. Subcontract Majority
a. Bidder must inform the Town of Middlebury and Otter Creek Engineering if they
are subcontracting over 50% of the contract value.
3. Existing infrastructure
a. The existing structures should be adjusted to match the new pavement elevation
b. The Town will provide risers and help with location. All installation shall be the
contractors responsibility.
c. Bidder will contact Dig safe to coordinate locating existing utilities
d. It is not the responsibility of Otter Creek Engineering to locate and mark existing
facilities outlined in the plans.
4. Submittals
a. Submittals must be provided before the work can start.
E. Questions?
Last day for questions will be 1 week (7 calendar days) prior to the date and time of
the bid opening.
OCE encourages contractors to submit questions as they come up instead of banking
them to be submitted in one group.

specifications?
ANSWER: No.
QUESTION: Can you provide us with the thickness requirements by Street?
ANSWER: Yes
QUESTION: Do you really want to mill a butt joint along the parking on south street
the entire length? It would likely be cost prohibitive for the size of the
project?
ANSWER: This will be reviewed and revised in addendum.
QUESTION: Can you provide us with your estimates of surface area so we know the
needs per street?
ANSWER: Yes.

QUESTION: Are there time restrictions or areas that must be completed first?
ANSWER: Yes. The Mary hogan parking lot and the rec center drive should be
completed after the stormwater improvement project (under
construction by Champlain Construction) and before school opens
back up. This will be modified by addendum.
QUESTION: Are we really required to provide notification 5 days ahead of time if we
change supervisors? Sometimes, personnel are sick and that makes this
challenging.
ANSWER: Yes however we will consider a change with the addendum.
QUESTION: What is the scope of the project, it was not clear in the specifications how
much and what type of pavement?
ANSWER: a. 3/4" Shim and 1 1/2" Overlay
b. Type 3 design (1/2) mix (2025 AOT Standard will be acceptable)
c. Type 2 design (3/4) mix (2025 AOT Standard will be acceptable)
QUESTION: What mix design and Binder?
ANSWER: Current AOT design for types 2 and type 3
QUESTION: Will all paved driveways need to be milled to match existing?
ANSWER: Yes, this should be included in the pay item for Aprons or under the
item for Contract General Conditions .
QUESTION: Can you double check the quantities and issue a revised bid schedule if
appropriate based on the changes in scope and approach?
ANSWER: Yes, the quantity of paving aprons appears to have been high.
QUESTION: How will the Town assist with this project?
ANSWER: The Town will complete the following tasks:
* Install Shoulder Gravel Post Project
* Complete all line Striping
* Assist Contractor in locating structure and valve box covers
* Provide risers for manholes and valve box covers
