PUBLIC NOTICE is hereby given that the following Ordinance was submitted in writing, introduced, read by title and passed on first reading at a meeting of the Township Committee of the Township of Millburn, in the County of Essex on Tuesday, July 14, 2026. The ordinance will be considered for final passage and adoption at the public hearing held at a Township Committee meeting beginning at 7:00 p.m. on Tuesday, August 11, 2026 at the Millburn Education Center, 434 Millburn Avenue, Millburn, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. ORDINANCE NO. 2762-26
AN ORDINANCE TO AMEND AND SUPPLEMENT THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF MILLBURN, CHAPTER II “ADMINISTRATION” ARTICLE V “BOARDS, COMMITTEES AND COMMISSIONS”
STATEMENT OF PURPOSE: the purpose of this Ordinance is to establish the Creative Arts Advisory Committee in the Township’s General Ordinances under Boards, Committees and Commissions. This ordinance will codify a creative arts group that will be responsible for planning and coordinating the installation and inventory of public art within the Township of Millburn. This ordinance will replace any previous art groups or collectives that have previously been established or appointed by the Township, with all previous members welcomed to apply to be a part of this newly established advisory board. Under this ordinance a maximum membership is set as well as terms for those serving on the committee. In addition, guidance is provided for the organizational structure, meetings and responsibilities of this committee.
WHEREAS, the Township Committee of the Township of Millburn wishes to establish the Creative Arts Advisory Committee under the Township’s General Ordinances; and
WHEREAS, the Creative Arts Advisory Committee will be responsible for recommending the placement of both temporary and permanent public art in the Township; and
WHEREAS, the Creative Arts Advisory Committee brings together several groups that have previously dealt with public art and will create more efficient and clear process to establish the standards, process and installation of public art; and
WHEREAS, the Creative Arts Advisory Committee will replace duplicative efforts and groups that have previously worked on art to provide a clear and concise vision of the Township’s public art; and
NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Millburn in the County of Essex and State of New Jersey as follows:
Article 2-42 “Creative Arts Advisory Committee” is hereby established as showed in the underlined text.
2-42. Creative Arts Advisory Committee
The Township of Millburn Creative Arts Advisory Committee is hereby established within the Township.
2-42.1 Purpose
There is hereby established a Creative Arts Advisory Committee to serve as a volunteer advisory committee to the Township Committee to review and consider applications for the creation of public art within the Township.
2-42.2. Composition
The Creative Arts Advisory Committee shall be composed of the following seven regular members:
(a) Class 1: one (1) representative from the Township Committee;
(b) Class 2: the mayor or his/her designee;
(c) Class 3: one (1) member of the Historic Preservation Commission;
(d) Class 4: one (1) representative from the Board of Education, one (1) representative of the High School Art Department and one (1) representative from the Special Improvement District Board or its staff;
(e) Class 5: three (3) residents of the Township of Millburn who hold no other municipal office, position, or employment.
(f) Advisory Class: Up to fifteen (15) non-voting resident members that can be utilized in an advisory and support capacity to the Public Art Advisory Committee.
2-42.3. Appointments
(a) All members of the Creative Arts Advisory Committee shall serve without compensation and shall be appointed by a simple majority vote of the Township Committee. The Special Improvement District, Board of Education and Historic Preservation Commission shall be permitted to make recommendations to the Township Committee for the appointment of their members to the Public Art Advisory Committee; however, such recommendations shall not be binding upon the Township Committee. The Class 2 member shall serve as Chair and presiding officer on an annual basis.
(b) Appointments to the Creative Arts Advisory Committee shall be as follows: Class 1, 2 and 3 members shall each be appointed for one-year terms. Class 4 and Class 5 members shall be appointed for two year terms. Notwithstanding the forgoing, the initial terms of Class 5 members shall be one, two, and three years respectively. Any vacancy occurring other than by the expiration of a term shall be filled for the unexpired term only, in the same manner as the original term.
2-42.4. Removal
Any member of the Creative Arts Advisory Committee may be removed by the Township Committee for cause, on written charges served upon the member and after a hearing thereon, at which the member shall be entitled to be heard in person or by counsel.
2-42.5 Rules of Procedure; Design Guidelines; Meetings
(a) The Creative Arts Advisory Committee shall establish bylaws and design guidelines, which shall be submitted to Township Committee for adoption by resolution. Once adopted, the rules of procedure and design guidelines shall be filed with the Township Clerk.
(b) The Creative Arts Advisory Committee shall meet on an as-needed basis and can be held in person or virtually. There shall be a quorum of voting members required to act at Committee meetings, which is a majority of the full, regular voting members of the Committee.
(c) All Creative Arts Advisory Committee meetings shall be conducted using Robert’s Rules of Order, include an agenda and have minutes taken
(d) Meeting agendas, minutes, public notices including their meeting dates, times and locations shall be posted on the Township’s website.
(e) The Creative Arts Advisory Committee shall keep records of agendas and minutes of its meetings and activities and shall make an annual report on or before December 1 of each year or at the request of the Municipal Clerks Office. This report shall be submitted to the Municipal Clerk's Office for dissemination to the Township Committee. All original records for the advisory committee shall be submitted at year end to the Municipal Clerks Office for record keeping purposes.
2-42.6 Powers and Duties
The Creative Arts Advisory Committee shall have the following powers:
(a) The power to schedule meetings on an as-needed basis, to be called by the Chairperson.
(b) The power to hear and review applications for the creation of public art within the Township, including the erection, painting and/or installation of murals, and the power to render decisions regarding the issuance or denial of permits therefor.
(c) The power to advise the Township Committee, the Planning Board, and the Board of Adjustment regarding matters which affect the creation of public art within the Township, including the erection, painting, and/or installation of murals or streetscapes.
(d) The power to create a nonexclusive list of spaces that are eligible and appropriate for the potential location and siting of both temporary and permanent display of public art within the Township and have said list of spaces approved by the Township Committee each year.
(e) Provide an annual report to Township Clerk reciting the activities and progress of the Creative Arts Advisory Committee.
(f) Keep and maintain a complete inventory of all public art owned by the Township of Millburn and submit inventory annually to the Township Clerks Office as part of their annual report.
