Effective July 1, 2016, the International Maritime Organization (IMO) has amended the Safety of Life at Sea Convention (SOLAS) to require, as a condition for loading a packed container onto a ship for export, that the container has a verified gross weight (VGM). The SOLAS requirement, states the shipper is responsible for the verification of the packed container’s weight; however, in most instances Food Aid cargo is containerized at Carrier’s time, risk and expense.

Therefore, the Carrier is required to provide the Verified Gross Mass (VGM) of each container, whether required containerization or for Carrier’s convenience, directly to the master or his representative and to the marine terminal operator sufficiently in advance via the appropriate platform. All responsibility and costs for VGM will for be the Carrier’s account and should be included in the freight offer. In addition, the carrier agrees to hold CRS harmless of any liability for an VGM that is not accurately reported.

If accurate & timely VGM is not provided to above parties, any & all liability, delays or costs will be for Carrier’s account.  After the effective date, it would be a violation of SOLAS to load a packed container onto a vessel if the vessel operator and marine terminal operator do not have a verified container weight.

The SOLAS amendments provide that there are two methods that may be used to determine the container weight once the container packing process has taken place.

1. weighing the packed container; or

2. weighing all packages and cargo items, including the mass of pallets, dunnage and other securing material to be packed in the container and adding the tare mass of the container to the sum of the single masses, using a certified method approved by the competent authority of the State in which packing of the container was completed.

The Inland Transporter appointed by the Ocean Carrier shall submit to the Surveyor appointed by the consignee an initial discharge/ dispatch plan indicating data required to facilitate effective and efficient dispatch, including truck license number, quantity to be loaded, name of consignee, and inland destination. Inland Transport drivers should present their trucks at the quay for loading with proper written documents, e.g. waybill, presenting theses data.

The inland Transporter appointed by the Ocean Carrier shall confirm to the Surveyor appointed by the consignee all waybill numbers documenting the inland transport of all commodities discharged from each vessel not later than 12 hours after departure of trucks from the Port.

Any deviation from the above by the Inland Transporter shall be communicated immediately to the Surveyor appointed by the Consignee.

If container service offered, carrier must certify that each container utilized to load cargo is: (a) in wind and watertight condition; (b) not more than ten (10) years old; and, (c) not a salvaged container or mustered out from regular service.  As a condition of payment, carrier must provide the forwarder a FGIS survey report attesting to the satisfactory condition of containers.  Survey is to be performed prior to loading cargoes.  As a temporary change, (b) above is being removed to allow for containers over 10 years old.  All containers must still be approved by FGIS prior to loading commodity.  This change does not diminish carrier’s liability for commodity loss/damage while the commodity is in the carrier’s care and custody.  If containers arrive at the point of origin, for commodity loading, and are rejected by the vessel loading observation (VLO) surveyor or by the commodity supplier, all dry run charges are for the carrier’s account.

Vessel Loading observation requirements and procedures, as per The U.S. Department of Agriculture Kansas City Commodity Office’s notice to the trade of May 5, 2000, is hereby incorporated.  A copy of which can be furnished upon request.

For all non-containerized cargoes, a signed copy of the Federal Grain Inspection Service (FGIS) Official Stowage Examination Certificate, a signed copy of the National Cargo Bureau Certificate of Readiness, and a signed copy of the Certificate of Loading issued by the National Cargo Bureau or a similar qualified independent surveyor.

Bill of Lading integrity is to be maintained at all times while in the carrier's custody and control, assuring that individual ocean bill of lading quantities are not commingled.

Certain commodities covered by this RFP must be inspected by APHIS/PPQ or other such authorities prior to loading so that phytosanitary certificate can be issued. Such inspection must take place not more than 30 days prior to the cargo being loaded aboard the vessel at the port of export.  Carriers intending to load these cargoes into containers, lash barges, or otherwise unitize cargoes in a way that will prohibit or restrict inspections without sustaining additional costs will be required to bear all such additional expenses if this is done before inspections are effected or if cargoes are not loaded on-board a vessel within the 30 day period following inspection.

All vessel substitution requests must be reviewed by USDA. The proposed substitute vessel should be of the same type as the originally awarded vessel. This applies to both U.S. and foreign flag vessel substitutions. The proposed substitute vessel must also appear on the applicable Maritime Administration U.S. or foreign flag vessel list which can be accessed using the following URL:

https://www.maritime.dot.gov/ports/cargo-preference/agricultural-cargoes

Vessel substitutions must be approved by the Shipper and USDA, as applicable, and cargo shall not be loaded into unapproved substitute vessels.

In keeping with U.S. Customs enforced compliance program for outbound documentation, carriers are hereby notified that any assessments against the cargo due in whole or in part to delay by carrier in verifying final load count, and providing same to

LifeLink Logistics, will be solely for carrier’s account.
