This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopsis of Proposed Contract Actions." U.S. Army Corps of Engineers (USACE), Portland District intends to negotiate/award an out-of-scope modification to contract W9127N24C0011 titled, “Coos Bay Upriver Clamshell Maintenance Dredging” with Manson Construction Co. for dredging at the Charleston Harbor Federal Navigation Channel. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1 and DFARS 206.302-1, Only one responsible source and no other services will satisfy agency requirements. More specifically, the Portland District finds that Manson Construction Co. is the only available source which can perform the required dredging within the next month, and the District expects that a contract with any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Manson Construction Co. is already mobilized to the area with the equipment required for dredging at the Charleston Harbor under the awarded contract. Through the intended modification the contractor shall provide labor, materials, and equipment to perform critical maintenance dredging at within the Charleston Harbor navigation channel. Approximately 15,000 cubic yards (CY) of material shall be removed using a clamshell dredge. The performance of work is anticipated to commence mid-November and be finished no later than 30 November 2024 (end of the in-water work window). The Government intends to proceed with this sole source action. A SOLICITATION WILL NOT BE POSTED. The NAICS code is 237990. The size standard is $37M for the NAICS code defined by the U.S. Small Business Administration. THIS NOTICE IS NOT A REQUEST FOR PROPOSAL. All responsible sources may submit a capability statement to the contracting officer before the notice end date. If no written responses received by the response due date cause the Contracting Officer to reconsider whether a modification to the awarded contract is the only path forward an award will be made without further notice.
