Special Requirements:
All Bidders for these services must have adequate industry and professional qualification, and all necessary licensing to provide fireworks or pyrotechnic displays according to the Specifications. The City will confirm the below qualifications and references prior to awarding the Contract.

1.         Bidders must be the regular business of performing large commercial or municipal firework displays for at least five continuous years.

2.        All personnel performing the pyrotechnic display services must have adequate training and/or experience with the necessary equipment and materials used to provide services.

3.        The Bidder company, and the individual personnel, as applicable, must possess all the licenses or permits required to buy, possess, transport, and fire pyrotechnic devices used in the fireworks display.

4.        Bidders must show evidence that they possess adequate equipment, materials, and resources to perform the fireworks display in a professional fashion at the specified time.

I. INSTRUCTIONS FOR SUBMITTAL OF BIDS/PROPOSALS

II. SPECIFICATIONS
A. The City of Daphne is seeking proposals from qualified vendors to present a July 4th Fireworks Display
sponsored by the City of Daphne at Al Trione Park on July 4, 2026 and the 4th of July for each year the bid
contract is extended. Basic details are as follows:

$34,500 (all money to be spent for 2026)
A. The successful Bidder will provide a professionally developed, electronically fired fireworks (pyrotechnics)
display at the above-specified time and location. The Bidder will present a very colorful, high quality
display with an opening barrage, a well-paced main body, and a grand finale. Duration of the display will
be 20-25 minutes.
B. The successful Bidder will provide a turnkey fireworks display including all pyrotechnic materials, supplies,
power generators, labor, supervision, delivery, clean-up of the launch area, and proper disposal of spent
shells or debris.
C. Bidders will submit a detail of the minimum number and size of the shells to be included in the display
performance. Information regarding the types and quantity of shells must be included with the Bid. Use
no less than 3” shells and no greater than 8” shells.
D. A map indicating the fireworks staging and launching/firing area is included with these specifications. By
submitting their bid, the Bidder represents, (1) that a representative has visited and inspected the site
and surrounding area, and (2) that the site is acceptable for safely launching/firing the pyrotechnics
required for the proposed fireworks display.
E. The City is seeking a creative, high-quality display for a budgeted price. Any unique or creative features
included with your proposed firework display should be identified. However, the Bidders may show a
total value that exceeds this budget but the total amount paid by the City to the Contractor shall not
exceed the budgeted amount.
F. CONTRACTOR (Successful bidder) Responsibilities
The CONTRACTOR, at a minimum, shall ensure the following:
1. Provide the shooter(s) with a working cellular phone, and provide the designated CITY personnel with
the cellular phone number.
2. Provide to the designated CITY staff one week before the shoot, a printed, detailed, itemized,
inventory-shipping list of all shells shipped for the firework display.
3. Prior to the loading of the shells, provide an on-site inventory check of shells with assigned CITY staff
at a mutually agreed upon time but no later than 12:00 noon on the day of the show. All fireworks
packages shall be clearly labeled as to size, type, quantity and country of origin.
4. CONTRACTOR will responsible for the safe storage and security of the equipment and fireworks at all
times while on CITY property.

5. Provide to the CITY, as early as possible, but no less than three (3) weeks prior to the shoot, a copy of
all applicable permits (fire, police, local and state approval).
6. Allow access of CONTRACTOR operations to the City of Daphne Fire Marshal at all times on the day of
the display. The CONTRACTOR will allow adequate time for the Fire Marshal to inspect equipment
and materials prior to setup but well prior to the firing time.
7. Provide written procedures outlining plan for delivery, set-up, and discharge of fireworks display in
response to variable weather.
8. Provide a written safety plan of the setup area and all safety precautions to be taken, to include
complying with NFPA 1123.
G. City Responsibilities
1. Provide police presence to be available for patrolling display area to maintain a safety zone around
the shooting area.
2. Provide a member for the CITY staff to coordinate with the CONTRACTOR and act as a representative
of the CITY on matters not directly relating to safety or regulations.
3. Provide a member of CITY staff to count and inventory all shells prior to loading. This employee will
verify the actual number of shells delivered vs. the proposed shell count submitted in this bid.
H. Inclement Weather/Alternate Display Date
The City of Daphne fully intends to have the complete performance of the fireworks display as scheduled
on July 4, 2026; July 4, 2027; and July 4, 2028. In the event the show is cancelled due to weather conditions
(as determined by CITY personnel), the CITY reserves the right to reschedule or to completely cancel the
display. CONTRACTOR is to outline in the CONTRACTOR’s proposal what price, if any, CONTRACTOR may
charge if the show is postponed or completely cancelled due to weather conditions.
I. Proposal Evaluation and Selection Process
A. Due to the wide range of visual quality of the fireworks presentation, the selection of the successful
Bidder will be based on a subjective evaluation of the proposed fireworks display and a review of the
Bidder’s industry qualifications and references for previous displays. The Bidder Qualifications and
References Form must be returned with the submitted Bid Sheet.
B. During the selection process, significant weight is given to the level of satisfaction expressed by the
provided references and based on the CITY’s own inquiries regarding the Bidder’s perceived industry
reputation.
C. A video or graphic demonstration of the proposed fireworks display can be submitted with the Bid as
an example of the type of display to be performed.
D. Bidder should provide details any unique or creative features included in the proposed fireworks
display.
E. Upon request, and for the Bid evaluation and selection, Bidder will agree to an interview by the CITY
regarding the submitted bid.

F. Bidder will submit copies of company’s BATFE Explosives License, USDPT Hazardous Material Safety
Permit, and Exhibitor’s License.

III. GENERAL CONDITIONS
A. Disqualifications of Bids
1. Bids may be disqualified before the awarding of the contract for any reason including but not
limited to the following:
a. Failure to deliver the Bid submittal as required;
b. Failure to sign and/or notarize the Bid documents;
c. Failure to include requested information or others details of the Bid;
d. Excessive errors in calculating prices or total;
2. The successful bidder/supplier will be required to submit proof of compliance with the BEASON-
HAMMON ALABAMA TAXPAYER AND CITIZEN PROTECTION ACT, Code of Alabama, and Section
31-13-9. Failure to submit any and all such documents within a reasonable period will constitute
grounds for cancellation of the contract at the sole discretion of the City of Daphne.
3. Bids may be disqualified for any other reason that may be deemed appropriate by City of Daphne
officials.
B. Bid Proposal Shall be Binding (Contract)
1. Upon signing of an adopted award Resolution, the bidder agrees that this Invitation of Bid along
with the bidder’s proposal and supporting documentation will, when the Bid has been awarded,
constitute a lawful and binding agreement between the City of Daphne and the successful bidder.
2. The sending of a notice of award or purchase order to a successful bidder, to the e-mail address
given in the bid or designated as a contact during the bid process, will be considered sufficient
notice of acceptance of the bid.
3. The bidder agrees that, if awarded the Bid, he/she shall furnish the products and services within
this Invitation of Bid in compliance with all terms, scope of work, conditions, specifications, and
amendments which are incorporated by reference as if fully set forth herein.
C. Reservation of Rights
1. The City of Daphne expressly reserves the right to:
a. Waive minor deviations from specifications that do not impair overall functionality of the
products
b. Waive any defect, irregularity, or informality in an bid procedure;
c. Reject or cancel any or all Bids/Proposals;
d. Reissue the bid invitation
e. Extend the bid opening time and date;
f. Procure any item by other means;
g. Consider and accept alternate Proposals when most advantageous to the City.
h. Negotiate with any bidder after proposals have been made regarding price, warranty, or
any other factor being considered in this proposal.
2. The City of Daphne reserves the right to award the Bid/Proposal in any manner that is in the best
interest of the City.
D. Licenses and Permits - The successful bidder must obtain a City of Daphne business license within ten
(10) days after award notification. Additionally, the successful bidder must acquire all other license
and/or permits required by local and state law.
