2026 Millenium Park Sediment Removal and
Bank Stabilization Project
The Village of Fox Lake is soliciting bids from qualified vendors for the sediment removal, bank
stabilization, site restoration, and disposal of sediment for the Millenium Park pond. It will be the
responsibility of the Contractor to measure, inspect and verify the project area. The following area
proposed for bidding are:

PROJECT DESCRIPTION
STATEMENT OF INTENT
It is the intention of the Village to have roughly 2,000 cubic yards of sediment removed from the
Millenium Park pond, along with that sediment disposed of by the contractor. Additionally, 185 linear
feet of bank will need to be stabilized along with the site restored.
SCOPE OF WORK
The Contractor shall furnish all labor, materials, equipment, supervision, transportation, permits, and
incidentals necessary to remove accumulated sediment from the detention pond and stabilize eroded
pond banks as shown on the project plans and specified herein. All work shall be completed in
accordance with applicable local, state, and federal regulations.
The Contractor shall:
* Mobilize equipment to the project site.
* Install all required erosion and sediment control measures prior to beginning excavation.
* Dewater the pond as necessary to facilitate sediment removal while maintaining downstream
water quality.
* Remove accumulated sediment from the pond bottom to restore the original design storage
capacity and grades as indicated on the plans.
* Transport and legally dispose of excavated sediment at an approved off-site disposal facility
unless otherwise directed by the Owner.
* Maintain haul routes free of mud and debris and repair any damage caused by construction
activities.
* Excavate unstable soils and reshape slopes to the design grades.
* Install suitable fill material where required to achieve final grades.
* Restore all disturbed turf areas.
* Restore access routes and staging areas to their original condition or better.
* Remove all excess materials, debris, and equipment from the site.
UNIT COSTS: While it is the Village's intent to purchase all of the items provided in these
specification, the unit cost provided on the bid document shall be utilized in the event it becomes
necessary to reduce or increase the quantity purchased.
RESERVATION OF RIGHTS: The Village reserves the right to reject any and all bids, to waive any
technicalities in the bid process, to award any bid or portion of a bid which is deemed to be the
most advantageous to the Village of Fox Lake and to make such investigations as are deemed
necessary to determine the ability of the vendor to perform the services requested.

GENERAL TERMS AND CONDITIONS OF BID
1. PRICES: All prices shall be clearly stated in proposal. No other costs will be permitted to the
vendor beyond those stated in this bid.
2. WARRANTIES: The OWNER shall be provided with full manufacturer's warranty as a condition of
the award. The warranty shall be stated on the bid document. The successful bidder must
provide the OWNER with any and all instructions, manuals and directions for proper cleaning
and maintenance of all items bid. (The CONTRACTOR shall warrant against all defects in material
and workmanship for a period of one year.)
3. INTERPRETATION OF CONTRACT DOCUMENTS PRIOR TO BIDDING: If any person
contemplating submission of a bid for items contained in this bid is in doubt regarding the true
meaning of any part of the contract documents, you may submit questions in writing to Steve
Wirch, at wirchs@foxlake.org for an interpretation to provide clarification. Questions may be
submitted to the Director of Public Works until 4:00 pm Tuesday August 4, 2026. Responses will
be provided if applicable to all parties who have shown interest in bidding, and posted on the
Village website by Thursday August 6, 2026 by 4:00 pm.
4. ERRORS AND OMISSIONS BY VILLAGE: No vendor shall be permitted to use to their advantage
any error or omission in this solicitation or specifications. If the vendor shall have any questions
or desires a clarification or interpretation regarding any of the items specified, the vendor shall
request such clarification in writing and any such clarifications shall be made available to all
vendors prior to the date of submission.
5. SUBMISSION OF BIDS: 2 copies of bids must be submitted prior to 10:00 am, Tuesday, August
11, 2026 at which time the sealed bids will be publicly opened and read aloud. Bids should be
submitted to:

6. 2 copies of bids must be in a sealed envelope clearly marked 2026 Millenium Park Sediment
Removal and Bank Stabilization Project and shall include the name of the bidder and the
date and time of the bid opening.

SPECIFIC CONDITIONS
F.L. 1 - CHANGES AND EXTRAS
The OWNER may at any time by written order, and without notice to the sureties, make changes within
the general scope of this contract. If any change causes an increase or decrease in the cost or time required
for the performance of this contract, then an equitable adjustment shall be made in the contract price.
Such cost may be adjusted in writing only, and must be signed by both CONTRACTOR and OWNER.
Likewise, any claim for extra charges by the CONTRACTOR must be agreed upon in writing by the
OWNER prior to beginning such work.
F.L. 2 - INDEMNIFICATION AND INSURANCE
The contractor shall indemnify, keep and save harmless the Village of Fox Lake and its respective officers,
agents and employees against all suits or claims that may be based on any injury and/or death to persons
or damage to property that may occur, or that may be alleged to have occurred or that may be alleged to
have occurred in the course of the performance of this contract by the contractor, whether or not it shall
be claimed that the injury was caused through a negligent act or omission of the contractor or his
employees; and the contractor shall, at his own expense, defend any and all such actions and shall pay all
charges of attorneys and all costs and other expenses arising there from or incurred in connection
therewith; and if any judgement shall be rendered against the Village of Fox Lake or any of its respective
officers, agents or employees in any such action, the contractor shall, at his expense, satisfy and discharge
the same.
The contractor shall at his own expense obtain and maintain during the life of this contract, Public Liability
and Property Damage Insurance, which shall protect the contractor, the Village of Fox Lake and its
respective officer, agents and employees, and shall also protect any sub-contractors performing work
under this contract, from claims for damages for personal injury (including accidental death) as well as
from claims for property damages which may arise from the performance of work under this contract or by
any sub-contractor or by anyone directly or indirectly employed by the contractor or by any sub-
contractor, and the amounts of such insurance shall be:
1. Comprehensive General Liability
Bodily injury, including death $1,000,000 per person
$1,000,000 each occurrence
Property Damage $1,000,000 each occurrence
$2,000,000 aggregate
2. Comprehensive Automobile Liability
Bodily injury, including death $1,000,000 per person
$1,000,000 each occurrence
Property Damage $1,000,000 each occurrence

Said insurance shall be written by a company or companies licensed to do business in the State of Illinois
and satisfactory to the OWNER. Before commencing any work hereunder, certificates evidencing the
maintenance of such insurance shall be furnished to OWNER and shall contain the following statement:
CONTRACTORs shall not subcontract the performance of any part of the work without requiring the
subcontractor to procure and maintain insurance in the forms and amounts approved by the OWNER.
Contractors must provide proof of construction bond in accordance with Illinois Statute (30 ILCS 550/) Public
Construction Bond Act.
F.L. 3 - CONTRACTOR' S RESPONSIBILTY
Nothing in these specifications shall be construed as placing the work under the specific direction or
control of the OWNER or relieving the CONTRACTOR from their liability as an independent CONTRACTOR
and, as such, They shall be solely responsible for the method, manner and means by which they
shall perform their work, including, but not limited to supervision and control of their own personnel
and scheduling of the work required to insure its proper and timely performance and they shall exercise
due care to prevent bodily injury and damage to property in the prosecution of the work.
Until the work is accepted, it shall be in the custody and under the charge and care of the CONTRACTOR,
and they shall take every necessary precaution against injury or damage to the work by the action of all
the elements, or from any other cause whatsoever. The CONTRACTOR shall restore and make good at
their own expense all injuries or damages to any portion of the work before its completion and
acceptance. Issuance of any estimate or partial payment to the CONTRACTOR for any part of work done
will not be considered as final acceptance of any work.
The CONTRACTOR agrees to assume and shall have full and sole responsibility for compliance with all
Federal, State or Municipal laws and regulation in any manner affecting the work to be performed by the
CONTRACTOR or subcontractors, including, without limiting the generality to the foregoing, the laws of
the State of Illinois.
F.L. 4 - PROSECUTION OF WORK
The CONTRACTOR shall give his personal attention to the work while in progress and shall provide a
competent and reliable superintendent at all times who shall have full authority to act for him. That
superintendent's name and phone number shall be furnished to the Village prior to the start of any work.
Any discrepancies or questions pertaining to the extent of the work shall be submitted immediately to
the Director of Public Works.
Time is of the essence to this contract and any failure by the CONTRACTOR to complete the job within
ninety (90) days of the notice to proceed being issued will result in the OWNER incurring additional
expense. Accordingly, it is agreed that for each calendar day beyond the completion time of this contract
that the work has not been completed, the CONTRACTOR shall be liable for and have deducted from
their pay two hundred dollars ($200) per day. As such, a precise schedule for the complete project shall
be prepared by CONTRACTOR and approved by the Village prior to the start of any work.

F.L. 5 - WORKING CONDITION
The CONTRACTOR will not work on or keep his equipment on any private property without the permission
of the property OWNER involved.
F.L. 6 - TRAFFIC
Local traffic shall be able to use all streets during the installation process. All private entrances shall be
passable. The contractor shall provide notice to any resident whose driveway will be blocked for any
period of time. The CONTRACTOR shall schedule his work to minimize hazards and delays, and shall take
every possible effort to promote safety. Signs, barricades and flagmen shall be utilized to protect the
traveling public and to prevent damage to their vehicles. The minimum number of signs shall include
each direction of travel on each street. The signs must comply with MUTCD standards.
All signs shall conform to MUTCD and be at least 30 inches in size, properly located in advance of the
work and in good overall condition. No work shall commence until the appropriate signs are in place.
F.L. 7 - PREVAILING WAGE
Some or all of the work herein may be subject to the provisions of Prevailing Wage Act, 820 ILCS
130/0.01 et.seq. providing for the payment of prevailing rate wages to all laborers, workmen and
mechanics engaged on work. The Contractor agrees that, prior to making any payments to its own
laborers, workers, or mechanics or to any subcontractor it will determine whether it must legally pay
wages in accordance with the Prevailing Wage Act, and if so legally required, pay the then-current
prevailing rate of wage as determined by the Illinois Department of Labor and posted at:
http//www.state.il.us/agency/idol/
The Village may at any time inquire of the contractor as to rates of wages being paid employees of the
Contractor, and any subcontractor or material men, whereupon such information shall be promptly
provided by the Contractor. The Contractor shall indemnify the village for any and all violations of the
prevailing wage laws and any rules and regulations now and hereafter issued pursuant to said laws.
The contractor shall insert into each subcontract and into the project specifications for each subcontract
a written stipulation requiring all laborers, workers and mechanics performing work under the contract
to comply with the Prevailing Wage Act and to require each subcontractor to insert into each lower-
tiered contract and into the project specification for each lower tiered subcontract a similar stipulation.
In order for payment to be processed, invoices must be accompanied with signed certified payroll.

F.L. 8 - BOND REQUIREMENT
(30 ILCS 550/1) (from Ch. 29, par. 15)
Sec. 1. Except as otherwise provided by this Act, all officials, boards, commissions, or agents of this State,
or of any political subdivision thereof, in making contracts for public work of any kind costing over $50,000
to be performed for the State, or of any political subdivision thereof, shall require every contractor for the
work to furnish, supply and deliver a bond to the State, or to the political subdivision thereof entering into
the contract, as the case may be, with good and sufficient sureties.

CONTRACTOR BID STATEMENT

The undersigned bidder, in compliance with your advertisement for bids for work as specified, and
related documents prepared by or at the direction of the Village of Fox Lake, Owner, and being
familiar with all conditions surrounding the work, including availability of labor and material, does
hereby propose to furnish materials, labor, equipment and services and pay for same and shall
perform all work required for the completion of the Project, in accordance with the Contract
documents and at the price provided.
Bidder certifies this bid to be for the project described in the Instruction to Bidders document and to
be in accordance with plans, specifications and Contract documents, including the invitation for bids.
In no event shall any delays or extensions of time be construed as cause or justification for payment
of extra compensation to the Contractor. Any claims for an increase of the Contract time shall be made
in writing to the Village within seven (7) days of the cause.
If the village awards the contract to bidder, then bidder agrees to sign a contract based upon the bid.

CONTRACT
1. This Agreement, made and concluded this day of , 2026, between
the Village of Fox Lake, known as "Owner", and , and its/their executors,
administrators, successors and assigns, known as "Contractor."
2. WITNESSETH: That for and in consideration of the payments and agreements mentioned
in the Proposal hereto attached, to be made and performed by Owner and according to the terms
expressed in the Contract documents, Contractor agrees with Owner at its/their own proper cost and
expense to do all the work, furnish all materials and all labor necessary to complete the work in
accordance with the Specifications hereinafter described, and in full compliance with all of this Contract
and the requirements of Owner under it.
3. And it is also understood and agreed that the Instructions to Bidders, Proposal and
Contract Bond hereto attached, and the Specifications for the 2026 Millenium Park Sediment Removal
and Bank Stabilization Project in Fox Lake, Illinois, are all essential documents of this Contract and are a
part hereof as "Contract Documents."
4. Contractor agrees to perform the work in a good and workmanlike manner in accordance
with the Contract Documents.
5. Owner agrees to pay for the work in accordance with the Contract Documents.
6. Contractor further declares that it has carefully examined the Contract Documents, and
that it has inspected in detail the site of the proposed work, and that it has familiarized itself with all of
the local conditions affecting the contract and the detailed requirements of construction, and understands
that in making this proposal it waives all right to plead any misunderstanding regarding the same.
Contractor further agrees the work will be completed in accordance with all governing State and local
requirements.
