NOTICE OF LETTING

REQUEST FOR BIDS: Sealed bids for the Business Highway 75 South Patching Project for City of Le Mars, Iowa, will be received by City Clerk in Le Mars, Iowa at her office at 40 Central Avenue SE, until 10:00 a.m. on August 13, 2026. Bids will be opened and publicly read at said time and date. The proposals will be acted upon by the City Council on August 18, 2026, at 12:00 p.m. at City Hall 40 Central Avenue SE City Council Chambers Le Mars, Iowa.

Said improvements shall include full depth and partial-depth PCC patching, and joint cleaning and filling on Business Highway 75 South.

The deposit will be returned to depositor if the construction documents are returned in good condition within fourteen (14) days after award of the project.

Each bid must be accompanied in a separate envelope by one of the following: a deposit of money, Certified Check, Cashier's Check, or Credit Union Certified Share Draft, or a Bid Bond to be executed by a corporation authorized to contract as a surety in the state of Iowa, in an amount equal to ten percent (10%) of the amount of the Bid, made payable to City of Le Mars, Iowa and may be cashed by the City as liquidated damages in the event the successful Bidder fails to enter into a Contract and file a 100% performance and payment bond satisfactory to the City assuring the faithful fulfillment of the Contract and maintenance of said improvements as required by law, the provisions of this notice and the Contract Documents within ten (10) days after acceptance of his Bid.

The Owner will, in evaluating Bids, consider the requirements of the resident bidder preference law, and allow such preferences to resident bidders as are required to be allowed under State Law. Bidder shall, when submitting a Bid, furnish an executed Bidder Status Form for the Owner to use when applying the preference law. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.

Bid Security of the two lowest Bidders will be retained until contract has been awarded and executed but no longer than 30 days after the opening of bids. No Bidder may withdraw his bid within 30 days after opening of bids.

The successful Bidder will be required to furnish a Performance Bond and Material and Labor Payment Bond in an amount equal to one hundred percent (100%) of the Contract Sum, issued by a responsible surety approved by the Board and shall guarantee the faithful performance of the Contract and terms and conditions therein contained and the maintenance of said improvements pursuant to the provisions of the Contract Documents.

Bids shall remain in effect for a period of thirty (30) days, commencing on bid due date. The Owner will issue tax exemption certificates to contractors and subcontractors on this project. Contractors and subcontractors may make copies of these certificates and give them to each supplier providing construction materials. Sales tax will not be charged on construction materials purchased using the tax exemption certificates.

Monthly estimates will be paid to the Contractor as the work progresses in amounts equal to ninety- five percent (97%) of the Contract value of the work completed during the preceding calendar month. Such monthly payments shall in no way be construed as an act of acceptance for any part of the work, partially or totally completed. Final payment of the five percent (3%) due the Contractor will be made thirty (30) days after final acceptance of the work under the Contract by the Owner if no claims are on file and after receipt of satisfactory evidence that all claims pertaining to such Contract have been paid in full as provided in the Contract Documents for said work.

Late Start Date of September 21, 2026. All work on the project shall be substantially complete in 35 working days.

All bids shall be filed on forms included in the Project Manual, furnished by the Engineer, sealed and plainly marked. Any alteration of the bid form may be cause for rejection of the proposal.

The City of Le Mars, Iowa reserves the right to reject any or all bids, re-advertise for all bids and to waive any or all formalities that may be in the best interest of the City.
