Citywide Tree Pruning and Removal
INSTRUCTION FOR SUBMITTING BIDS
The City of Union City is soliciting bids from qualified Contractors to complete the project described herein.
Instructions and requirements for completing a bid are described below.
1. Qualifications: Contractor shall possess a valid Class C-61/D-49 (Tree Service), California Contractor's
license and a City business license at the time the contract is awarded.
2. The City of Union City is soliciting formal bids from qualified Contractors to complete the work described herein.
Instructions and requirements for completing a bid are described below.
3. Project Location: Various locations, City of Union City, California
4. Project Description: Work generally includes tree pruning services with a small allowance for tree removal
and emergency call out work. The estimated cost of the base bid and all additive bid item work is approximately
$300,000. As the City's annual tree maintenance contract, the project duration is two years, with the possibility

of being extended up to three times for a period of one additional year.

7. Bidder's Security: Bids must be accompanied by a proposal guarantee amounting to ten (10%) percent of the
total bid as described in the specifications. Said guarantee shall be forfeited to the City in case the bidder
depositing the same does not, within fifteen days after written notice that the contract has been awarded to him
(1) enter into a contract with the City and (2) furnish Performance and Payment Bonds as described in the
specifications.

9. Prevailing Wage: As a "Public Works" project and pursuant to Section 1773 of the Labor Code, the general
prevailing wage rates for Alameda County shall apply to this contract, as determined by the Director of the
California Department of Industrial Relations.

10. Reply Format: All forms in the "Bid Proposal" Section shall be completed and returned by the bid's due date.
Bids are required for the entire work described herein. All blanks on the bid schedule must be completed.
11. Bid Award: The bid will be awarded to the lowest responsible bidder at the discretion of the City Council. The
City reserves the right to reject any and all bids, or to waive any errors, discrepancies or irregularities.
12. Firm Prices: All bid prices will be held firm for a minimum of sixty (60) calendar days after the due date for

INSTRUCTIONS TO BIDDERS
1. DEFINITIONS
1.1 Addenda or Addendum. As used in the Instructions to Bidders, any document
signed by an authorized representative of the City, reflecting an interpretation,
correction, or change regarding the bid package prior to bid opening. Depending
on the context, each addendum shall constitute a part of the bid package as one
of the Contract Documents, Bid Forms, and/or Project Plans and Technical
Specifications.
1.2 Agreement. As used in the Instructions to Bidders, the proposed contract
between the City and bidder concerning the Project, as evidenced by and
comprised of all of the Contract Documents.

1.5 Contract Documents. Depending on the context, this either refers to all the
documents in Volume 1 of the bid package, the definition of the term "Contract
Documents" as specified by the Agreement, and/or any addenda, if applicable.
1.6 Project. Citywide Tree Pruning and Removal, as described in the bid package.
1.7 Project contract. All of the Contract Documents combined.
1.8 Project Plans and Technical Specifications. The Project Plans are a document
or set of documents indicating primarily graphic detailed requirements concerning
the Project. The Technical Specifications are a document or set of documents
indicating the detailed Project requirements. Both are contained in Volume 3 of
the bid package and any addenda, if applicable.
1.9 State of California, Department of Transportation, Standard Specifications and
Standard Plans dated 2022. These documents are part of the project

specifications and specifications. In case of a conflict or inconsistency between
the two sets of documents, the Project Plans and Technical Specifications noted
above per Section 1.8 will take precedence.
2. BIDDER'S REPRESENTATIONS
2.1 Each bidder, by submitting a bid, represents that all of the following is true:
2.1.1 The bidder has read and understands the bid package and the submitted
bid is in accordance with all the requirements of the bid package and
applicable laws and regulations.
2.1.2 In accordance with California Labor Code Sections 1777.1 or 1777.7,
neither the bidder, nor any proposed subcontractor included on the List of
Subcontractors form to be submitted with the sealed bid, are ineligible to
perform work on public works projects.
2.1.3 The bidder understands that quantities of unit price items may vary from the
estimates provided in the Project Plans and Technical Specifications.

3. PRE-BID COMMUNICATION AND INTERPRETATION OF THE BID PACKAGE
3.1 Any bidder that discovers any apparent conflicts, errors, or ambiguities in the bid
package or between the contents of the bid package and the project site, and any
bidder that has questions or requires clarification concerning the bid package or
its intent, must inform the City in writing as soon as reasonably possible, but no
later than five (5) working days before the date specified for bid opening. Such
notice to the City must be sent to the fax number specified in the Notice Inviting
Bids for questions concerning the Project, based on the bid package. Such notice
to the City, if received less than five (5) working days before the time specified
for opening bids, may not be answered.
3.2 All interpretations, corrections, or changes regarding the bid package prior to bid
opening shall be made with an Addendum, written, and signed by an authorized
representative of the City and transmitted to all bid package recipients by e-mail
or in person. No other interpretations, corrections, or changes regarding the bid
package, issued prior to the date specified in the Notice Inviting Bids for the

opening of bids, will be binding. All Addenda issued by the City prior to the time
and date specified for opening bids will form a part of the bid package and must
be acknowledged as such by the bidder. Any party that receives a bid package
after an Addendum has been transmitted to bid package recipients by mail shall
instead receive the addendum along with the bid package and shall also be bound
by the terms and conditions of this subsection. Any changes, exceptions or
conditions concerning the Project and/or the bid package submitted by any bidder
as part of a bid may render that bid non-responsive.
4. PRE-BID ACCESS TO THE PROJECT SITE
4.1 Prior to submitting a bid, it will be the sole responsibility of each bidder to conduct
any additional examination, investigation, exploration, test, study or other inquiry
and to obtain any additional information pertaining to the physical conditions
(including, but not limited to, surface, subsurface, and underground utilities) at or
near the project site that may affect the cost, progress, or performance of the
Project, and that the bidder deems as necessary to prepare its bid in accordance
with the bid package. Bidders seeking any such additional examination,
investigation, exploration, test, study, other inquiry, or additional information

concerning the Project will do so at the bidder's sole expense.

4.3 The location of any eNxcavation, boring, sampling, or other testing will be subject

to approval by the City and any other agencies with jurisdiction over such testing.

Bidders may not conduct tests at the project site prior to obtaining City approval.

The City may require bidders to execute an Access Agreement prior to approving
any testing at the project site.
4.4 Once the approved testing is complete, bidders must, to the City's satisfaction, fill
all trenches or holes, restore all pavement to match existing structural section,
and otherwise clean up and restore the test site to its pre-test condition.
5. BIDDING PROCEDURE
5.1 Bids must be received by the Office of City Clerk - City of Union City, 34009
Alvarado-Niles Road, Union City, California 94587, no later than the time and date
specified in the Notice Inviting Bids. Bids will be opened and read publicly at that
time. Bids that are submitted late according to the official time kept by the City
Clerk, or a designee, including any extension granted due to a material change,
will be returned unopened. City telephones, fax machines and computers are not
available for use by bidders.
