General Bid Information
Montrose County is accepting sealed bids from qualified asphalt producers to
manufacture 15,000 tons of hot mix asphalt (HMA). The successful bidder shall provide
all labor, materials, equipment, and supervision necessary to produce the specified
asphalt. This bid solicitation is for material only.

Bidder Instructions
Submitted bids must be enclosed in a sealed opaque envelope marked “2026 Hot mix
Asphalt (Material only)” with the name of the bidder and delivered to Montrose County
Public Works, Attn: Brandon Wallace, 63160 LaSalle Rd, Montrose, CO 81401, no later
than 2 p.m. local time, April 7, 2026. The bids will be opened immediately thereafter
and read aloud. Bids received after the time due will not be considered and will be
returned to the bidder un-opened.
A 5% bid security is required with the bid as outlined in C.R.S. 24-105-201. The bid
security shall be placed in a separate envelop marked “Bid Security” that is either
attached to the outside of the bid envelope or placed in a larger envelope that contains
both the sealed bid envelope and the bid security envelope. Bids not including a bid
security will not be considered and will be returned to the bidder un-opened.
Bids are to be submitted on the Bid Forms included within the bid package. Bidder must
provide the Unit Bid Price, Item Total Bid Price and Total Bid Price on the Bid Schedule
Form. In case of discrepancy on the Bid Schedule Form, the Unit Bid Price governs.
Any bid questions must be received by 2 pm local time, March 31, 2026.
Any modifications to the Invitation to Bid package will be an Addendum and posted to
the County website and distributed to all known bidders by 5 pm, April 2, 2026. It is the
responsibility of the bidder to verify if an addendum has been issued. Bidder shall

acknowledge Addenda in the Bid and Addenda Acknowledgment section of the Bid
Form.
General Conditions
All bids shall be irrevocable for 45 days from the date of the bid opening.
The successful bidding Contractor will be required to enter into an agreement with
Montrose County. A sample agreement is included in this bid package, but the final
agreement may be altered and/or contain additional or different provisions.
A payment and performance bond equal to 100% of the bid amount will be required as
outlined in C.R.S. 38-26-106 and the contract agreement for the successful bidder.
Contractor shall carry insurance coverage as outlined in the contract agreement.
Payment to Contractor will be made upon submission and approval of invoice(s).
Payment will follow normal County payment processing cycles for issuance of checks.
Awarding of Bid
Award will be made to a responsive, responsible bidder meeting applicable county and
state procurement requirements. In reviewing the bids received, the County reserves
the right to reject, for any reason whatsoever, any and all bids, and to waive any
informality or irregularity in a bid. The County reserves the right to accept the bid that
provides the best value to the County in the County’s sole discretion. The County
reserves the right to make a determination in the County’s sole discretion as to the
sufficiency of qualifications of any bidder. The action to award a contract is subject to
approval by the Board of County Commissioners. The submission of a bid does not in
any way commit the County to enter into an agreement or contract with that bidder.
Bidder must identify for non-disclosure purposes, any information contained within the
proposal that is proprietary in nature or protected by copyright, trademark, or other
intellectual property law. Montrose County will maintain confidentiality of such materials
to the extent permitted by law, the County is subject to the provisions of the Colorado

Open Records Act (CORA), C.R.S. 24-72-201, et seq., and cannot therefor guarantee
that any materials provided will not be produced in response to a CORA request.
In addition to the physical proposal package, all documents are to be submitted digitally
by email, preferably in accessible format (Word or accessible PDF), to Rusty Catlin by
e-mail at rcatlin@montrosecounty.net. Digital submissions are not official submissions
for purposes of compliance with timing requirements.
It is anticipated that award of the contract will be made within two (2) weeks of the bid
opening. All bidders will be notified of the Commissioners’ decision. Within two weeks
of award, any required submittals will be due. A purchase order will be used for
authorization to proceed.
Requirements of Successful Bidder
A payment and performance bond equal to 100% of the bid amount will be
required as outlined in C.R.S. § 38-26-106 and the contract agreement.
Furnish certificates of required insurance coverage.
Furnish a completed Form W-9 “Request for Taxpayer Identification Number and
Certification”.
Enter into a contract agreement with Montrose County.
Furnish an Equal Employment Opportunity Certification letter.

Additional Terms and Scope of Services
1. Contractor shall meet the specifications as shown on Attachment “A” – 2026
Hot Mix Asphalt Specifications.

3. Delivery shall be into Montrose County haul trucks, FOB producer’s batch plant,
which shall be located within a 15-mile haul distance from the intersection of
Main Street and Townsend Avenue in Montrose, Colorado.
4. The County, at its discretion, may take samples of the HMA to verify compliance
with material specifications. If the test results fail to meet the minimum
specifications, Montrose County will have the option to seek remedy or terminate
the contract.
5. Pricing shall be guaranteed through October 30, 2026.
6. County will place orders at least 3 working days prior to needing the material. All
orders will be for at least 100 tons of material or be coordinated during days with
orders from other customers of the Contractor.
7. The Contractor shall make reasonable accommodations to meet the County’s
daily order for HMA. If the County’s daily order cannot be met, the Contractor
shall notify the County one day in advance and the County may purchase HMA
elsewhere at the County’s own discretion to meet project needs.
8. The hot mix bid quantity is estimated. There is no guarantee that the County will
purchase the bid quantity.
9. Anticipated hot mix asphalt quantities may be exceeded if the County has need,
and has appropriated additional money to pay for the additional hot mix asphalt.
10. This bid for HMA is for materials the County will use in the Montrose area only
