Notice is given that on June 4, 2026, at 2:00PM the Metropolitan Council will receive and publicly open
separate sealed bids for St. Croix Valley WRRF Upgrades, Project Number 807811 Contract Number
26P024.
The work of this project includes: Upgrades to St. Croix Valley Water Resource Recovery Facility
including: new bar screens, new primary sludge pumps, aeration blower VFDs and aeration
improvements, new UV disinfection system, alum storage and feed system improvements, HVAC
improvements, electrical improvements, fiber work, road reconstruction, carbon vessels fall protection,
gravity thickener repairs and access upgrades, and sludge backup hauling during construction.

The plans for this project contain data that are classified as nonpublic data that may not be accessed by
or disclosed to anyone without a legitimate business need, including data that are classified as
nonpublic security information under Minnesota Statutes section 13.37 or other applicable
classifications. This notice specifically includes but is not limited to all of the contents of any page of
these plans that is marked with the words NONPUBLIC DATA or any substantially
similar designation. By downloading or accessing the project plans or any portion of
them, you irrevocably agree to the non-disclosure agreement (“NDA”) set forth below. If you do not
agree to any of the terms of the NDA then do not download or access these plans, as your affirmative

at the gate and sign in no less than 10 minutes prior to the site visit. Safety glasses are required for the
site visit.
The Metropolitan Council is only accepting electronic bid packages. All bids MUST be submitted through

By downloading or accessing these plans or any portion of them, you irrevocably agree to the
following non-disclosure agreement terms and conditions (the “NDA”):
1. That you understand the terms of this NDA are binding and irrevocable as to you, your company,
and any person or entity acting by you, through you, or on your behalf including
any potential subcontractors, suppliers, or other lower tier entities;
2. That you must treat as nonpublic data in accordance with the Minnesota Government Data
Practices Act (Minnesota Statutes Ch. 13) the full contents of these plans and the information they
contain, including but not limited to all portions of the plans marked as nonpublic (the “plans” or
the “data”);
3. That you will destroy, at your expense, all copies of the plans or any portion thereof in your
possession upon receipt of notice that you are not the selected bidder, or at any other time upon
written request from the Metropolitan Council, and that you will advise all your representatives,
subcontractors, or other recipients of the plans from, by, or through you to likewise destroy all
copies of the data in their possession;
4. That you will not further disclose the plans or the data except to individuals and
entities that both have a legitimate business need have access to these data, and have
affirmatively agreed in writing to abide by all the provisions of this NDA without limitation;
5. That you and your company will accept all liability and responsibility for any and all loss, personal
injury, or damage, including attorney fees, arising out of a breach of this NDA and that you will
defend, indemnify, and hold harmless the Metropolitan Council from all such loss, injury, damage,
or attorney fees; and
6. That you understand this agreement cannot be changed, revoked, or rescinded orally or in any
other manner except for a writing signed by the Metropolitan Council.
If you do not agree to any of the terms of this NDA then do not download or access these
plans, as your affirmative act to download these plans constitutes your irrevocable consent to enter a
binding agreement.
