1. Introduction
City of Upland (“City”) is seeking proposals from qualified companies (“Company”) to provide on-call
geotechnical and materials testing services, Capital Improvement Program (CIP) geotechnical investigation
and testing services and services for preparing design recommendations, plans and other contract
documents for Public Works construction projects within the City as described in the Scope of Services (see
Exhibit A). The Company will be responsible for performing the services in accordance with all applicable
Federal, State, County and Local laws and regulations. The City anticipates selecting multiple companies to
provide these services on an as-needed basis.
The City places a high value on exceptional customer service, meticulous attention to detail, and pride in
public spaces. The selected Company is expected to share these values and to demonstrate a proactive,
responsive, and professional approach to geotechnical engineering and texting services. The City expects the
Company to treat all locations as vital community assets, deserving of the utmost care and stewardship, in
order to enhance the experience for residents, visitors, and businesses.
2. Intent
The City intends to award contracts to the most qualified Companies that will provide the best value to the
City for the services specified in this RFP (see Exhibit A). The City reserves the right to reject all proposals and
to waive minor irregularities, to accept any proposal or portion thereof, and to take all proposals under
advisement for a period of ninety (90) days.
The City reserves the right to issue a single contract, multiple contracts or to issue no contracts because of
this RFP.
3. Background
The City is located approximately 35 miles east of Los Angeles in western San Bernardino County, covers 15.6
square miles and is home to nearly 80,000 residents. Known as the “City of Gracious Living,” Upland traces
its roots to the 1880s but was officially incorporated in 1906. In the years since, Upland has developed into a
vibrant foothill community at the base of the San Gabriel Mountains. Over time, it evolved from an agricultural
hub into a balanced residential and commercial city, while retaining its historic downtown, tree-lined streets,
and strong sense of civic identity.
4. Tentative Schedule of Events
It is the goal of the City to select and retain a Company by March 23, 2026. In preparation for that action, the
following tentative schedule of events has been prepared:

The City reserves the right to amend, withdraw and cancel this RFP. The City reserves the right to request or
obtain additional information about any and all submittals before making an award. The City also reserves the
right to seek clarification from any Company about any statement in its proposal that the City finds ambiguous.
5. Instructions to Companies
Notice to Companies
Companies shall be considered based on their best overall value to the City. The City Council shall
decide in its sole and absolute discretion whether to enter into a contract at all, even if there are
one or more qualified Companies. The City shall not be limited to awarding to the lowest
responsive Company but instead shall be entitled to negotiate for the best overall value to the City.
The City may, but is not obligated to, conduct interviews with Companies.
The City may automatically disqualify any proposal that does not meet the terms and conditions
set forth in this Section 5 - Instructions to Companies.
Irregular Proposals
Unauthorized conditions, limitations, or provisions attached to a proposal will render it irregular
and may cause its rejection. The completed proposal forms shall be without interlineations,
alterations, or erasures. Alternative proposals will not be considered unless specifically
requested. No oral, telegraphic, or telephonic proposal, modification, or withdrawal will be
considered.
Costs
The City is not liable for any costs incurred by proposers before entering into a formal contract.
Costs of developing the proposals, or any other such expenses incurred by the Proposer in
responding to this RFP, are entirely the responsibility of the Proposer, and shall not be reimbursed
in any manner by the City. No reimbursable cost may be incurred in anticipation of award.
Award of Contract
Issuance of this RFP and receipt of proposals does not commit the City to award a contract. The
City reserves the right to reject any or all proposals, to accept any proposal or portion thereof, to
waive any irregularity, and to take the proposals under advisement for a period of ninety (90) days.
The City Council shall decide in its sole and absolute discretion whether to enter into a contract at
all, even if there are one or more qualified Companies. The City shall not be limited to awarding the
lowest responsive Company but instead shall be entitled to negotiate for the best overall value to
the City. In no event will an award be made until all necessary investigations are made as to the
responsibility and qualifications of the Company to whom the award is contemplated. All
responses to this solicitation shall become the property of the City and will be retained or disposed
of accordingly.
Legal Responsibilities
All proposals must be submitted, filed, made, and executed in accordance with State and Federal
laws relating to proposals for contracts of this nature whether the same are expressly referred to
herein or not. Any Company submitting a proposal shall by such action thereby agree to each and
all the terms, conditions, provisions, and requirements set forth, contemplated, and referred to in
the scope of services and contract documents. All Companies shall also agree to full compliance
therewith.
