Original Combined Synopsis Solciitation
(i)This is a combined synopsis/solicitation for commercial products prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued separately from this notice.
The solicitation is being issued under Subpart 13 – Simplified Acquisition Procedures.
This notice also constitutes the notice of intent to Sole Source as required under FAR 5.2 and is using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart13.106-1 (b)(1)(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available, allowing the Contracting Officer (CO) to solicit from one source. This Notice of Intent (NOI) is to inform industry contractors of the Government's intent to execute a Sole Source Award using FAR Part 13 - Simplified Acquisition Procedures (SAP).
The Department of Homeland Security, Customs and Border Protection, 1331Pennsylvania Avenue, NW, Washington, DC 20229, intends to negotiate and award a sole source procurement to Aware, Inc., 40 Middlesex Tpke, Bedford, MS 01730-1404.
The Government asserts that only one source can satisfy the agency's requirement because although there are other small business companies capable of providing 10-print solutions/maintenance, Aware Inc. possesses unique customized capabilities to meet CBP's requirement. The amount of time and funding that it would take to re-develop, integrate, test & deploy a new interface to our CBP applications, along with the impact of having to transition-in (acquire Background Investigation (BI) clearances) and train a new provider would be too significant at this time.
All responsible sources may submit a quotation which shall be considered by the agency. The solicitation is made available and is attached to this notice. All information necessary to obtain and respond to the solicitation is included in the solicitation. All information the offeror plans to furnish shall be furnished at no cost or obligation to the Government.
A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government.
(ii) The solicitation number is 70B04C25Q00000004 and the solicitation is issued as a request for quotation (RFQ).
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-03.
(iv) This is issued unrestricted, and no set-aside is associated with the solicitation.

(vi) Description of requirements for the items to be acquired.
The requirement is to provide support and maintenance for the 4904 Aware CaptureSuite licenses in the 1-year performance period. The Contractor shall also provide 4904 Aware Capture Suite software maintenance renewals for the 1-year. The contractor shall provide maintenance of the software and any associated media.
The maintenance is for existing or new Aware CaptureSuite Ver. 5.14 and additional licenses with maintenance for the U.S. Department of Homeland Security, U.S. Custom and Border Protection’s (CBP) 10-Print Capture Program effort to US Port of Entry (POE) locations. Aware CaptureSuite annual support and maintenance provides maintenance provides priority technical support, bug fixes, performance and functionality upgrades.
The Aware CaptureSuite software is used to perform the following tasks.

(viii) The provision at 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services, applies to this acquisition and any addenda to the provision. Please see the attached solicitation for reference.
(ix) The provision at 52.212-2, Evaluation-Commercial Products and Commercial Services, if used, and the specific evaluation criteria to be included in paragraph (a) of that provision. If this provision is not used, describe the evaluation procedures to be used.
(x) Offerors shall attest to have completed the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, with the quote.
(xi) The clause at 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services, applies to this acquisition and any addenda to the clause. Please review the attached solicitation for reference.
(xii) The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Products and Commercial Services, applies. Please see the attached solicitation for reference.
(xiii) Any additional contract requirement(s) or terms and conditions (such as contract financing arrangements or warranty requirements) determined by the contracting officer to be necessary for this acquisition and consistent with customary commercial practices are outlined in the attached solicitation and/or Statement of Work (SOW).
(xiv) No Defense Priorities and Allocations System (DPAS) rating is assigned to this solicitation.
(xv) Since the synopsis and solicitation are contained in a single document, the contracting officer has determined it is not necessary to publicize a separate synopsis 15 days before the issuance of the solicitation, and has establish a response time in accordance with 5.203(b). The date, time and place quotes are due are outlined in the attached solicitation.
