THIS SOLICITATION IS LIMITED TO NYS-CERTIFIED MWBE AND SDVOB VENDORS ONLY

The New York State Department of Health (NYSDOH) intends to procure services for the removal and disposal of unused expired Personal Protective Equipment (PPE) and unused expired diagnostic testing supplies (not containing any medical waste) pursuant to its discretionary purchasing authority under State Finance Law §163(6). This procurement opportunity is limited to New York State (NYS) businesses certified pursuant to Article 15-A of the NYS Executive Law or Article 3 of the NYS Veterans Service Law.

MANDATORY BIDDER QUALIFICATIONS:

The prime contractor must meet the following qualifications to bid on this opportunity:

  • Bidder must be a NYS-certified Minority and Women Owned Business Enterprises (MWBE) business.

SCOPE OF WORK:

The expired product is located at two warehouses, as detailed below.

Guilderland, NY location: Hours of operation: 0800-1600

Oriskany, NY location: Hours of operation: 0800-1600

Receipt(s) or other proof of disposal at a regulated disposal facility is/are required.

Pallets are standard size (40x48 inches), height varies from 42 to 80 inches. Some can be double stacked, but some are too high.

NYSDOH is able to provide logistical support by operating forklifts or using pallet jacks to move pallets to a truck but is unable to provide manual labor beyond that. NYSDOH will not break down individual pallets. If the selected vendor’s plan requires any logistical support beyond what is noted above, it will be at their expense and will need to be accounted for in their submitted quote. Pallets of product slated for disposal are staged for removal. There is adequate space at both locations to stage multiple trailers if needed, live load is preferred. Please see attached documents for applicable Safety Data Sheet (SDS) information.

Subcontracting is allowed. While the use of NYS-certified MWBE subcontractors is encouraged, it is not required.

Upon receipt of an approved contract by the New York State Attorney General and Office of State Comptroller, the awarded contractor will be expected to complete this work within 90 days.

This procurement is subject to NYS Finance Law §139 j&k, the Procurement Lobbying Law. Therefore, vendors are cautioned that the only permissible contact for this opportunity is the individual listed above. Contacting any other individuals in connection with this advertisement may constitute a violation of NYS Finance Law. Failure to comply with this requirement can range from no contract award to debarment from sales to any NYS agency.

HOW TO RESPOND:

Interested vendors should submit an email that contains all of the following:

  1. Documentation that provides proof of current NYS certification status as a MWBE;
  2. A completed and signed Pricing Quotation (attached); and
  3. A brief written plan outlining the proposed removal process and overall timeframe needed for disposal (not to exceed 90 days).

AWARD:

Only responses that meet the minimum qualification will be reviewed. Award will be made to the lowest cost bidder, which is the bidder who proposes the lowest all-inclusive price per pallet.

The selected vendor, once notified of selection, will be required to provide proof of workers’ compensation and disability insurance, vendor responsibility, NYS Finance Law §139 j&k, and NYS Tax Law Section 5-a documentation in order to proceed with contract award.

  • C-105.2 – Certificate of Workers’ Compensation Insurance
  • U-26.3 – Certificate of Workers’ Compensation Insurance from the State Insurance Fund
  • GSI-105-SI-12 – Certificate of Workers’ Compensation Self Insurance
  • CE-200 – Certificate of Attestation of Exemption

For Disability:

  • DB-120.1 – Certificate of Insurance Coverage under the NYS Disability Benefits Law
  • DB-155 – Certificate of Disability Self Insurance
  • CE-200 – Certificate of Attestation of Exemption
