Naval Surface Warfare Center (NSWC) Crane Division has a requirement for a five (5) year Firm Fixed Price and Cost Plus Fixed Fee Type, Basic Ordering Agreement (BOA) to support the MPRA CSHW with efforts to include Hardware, Repair/Rework and Maintenance, Engineering Support Services, Research and Development, Test and Evaluation, Redesign and Modification, Data Collection, Logistics Support Services and Travel. A BOA is the most appropriate contracting mechanism for this requirement because NSWC Crane anticipates multiple individual orders for CSHW support over the next five years. The need for these supplies and services is recurring and the requirements are subject to rapid change due to the dynamic nature of the operational environment. A BOA will provide the flexibility to quickly issue orders to meet emergent needs without the delays associated with issuing individual contracts. Delivery requirements will vary based upon each order placed under the BOA. The estimated ceiling amount for all orders is $96,700,000. The proposed noncompetitive contract action is anticipated to be awarded under FAR Part 15, Contracting by Negotiation. The anticipated contract action award date is Second Quarter FY26. Task orders under this BOA will be priced in accordance with FAR 15.4, Contract Pricing. The Government will request and evaluate cost or pricing data from the vendor and will perform an analysis to ensure that prices are fair and reasonable.
The proposed contract action is for supplies and services for which the Government intends to solicit and negotiate with one source, General Micro Systems, 8358 Maple PL, Rancho Cucamonga, CA 91730, under the authority of FAR 6.302-1 (statutory authority 10 U.S.C. 3204(a)(1)), one responsible source. Market research did not identify any other vendors with the capability to provide the required CSHW hardware and support within the required timeframe. This is being sole sourced due to lack of sufficient technical data and extensive duplication of costs. The Government lacks the necessary proprietary technical data package to enable competition for these services. General Micro Systems possesses the exclusive rights to this data. To independently develop this data package would require reverse engineering, re-tooling, and extensive testing, estimated to cost $19,700,000. These costs are not expected to be recovered through competition. Furthermore, a competitive procurement would delay the necessary CSHW hardware support by an estimated five (5) or more years, which would negatively impact mission readiness.
All responsible sources may submit a capability statement, proposal or quotation, which shall be considered by the agency. However, a determination by the Government not to compete this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of re-evaluating the justification for sole source or limitation of sources and making a determination to change the acquisition strategy to a competitive procurement. The Solicitation and any amendments for this sole source action will not be posted to SAM.gov and are available only from the POC identified below.
