Sealed proposals for:
CITYWIDE MILL AND OVERLAY 2026
CDBG YR-51 INFRASTRUCTURE IMPROVEMENTS - DPW GROUP 1143B
will be received by the Commissioner of Public Works no later than:
WEDNESDAY, APRIL 29, 2026 at 11:00 AM
It is the bidder’s responsibility to ensure the sealed proposal is delivered before the bid opening and
bidders must utilize one of the following methods:
1.) Drop off the sealed proposal to Room 502 of City Hall, Buffalo, New York, 14202 on Wednesday, April
29, 2026 between the hours of 9:00 AM and 11:00 AM. The DPW will set a bid box up inside Room
502 for the bidder to deposit the sealed proposal. There may be multiple bids on this date; it is the
bidder’s responsibility to properly label the sealed proposal and place the proposal inside the correct
box.
2.) Mail the sealed proposals to Room 502, City Hall, Buffalo, New York, 14202 with ATTN to the
Commissioner of Public Works. Bidders should allow for delivery before the bid opening (highly
encouraged to schedule the delivery one day prior to bid opening). It is also highly encouraged that
bidders track delivery of their mailed proposals and use appropriate priority mail as necessary. City
of Buffalo staff are available to accept deliveries on standard business days Monday-Friday from 8:00
AM to 4:00 PM.
Bids will be opened by City of Buffalo Representatives on WEDNESDAY, APRIL 29, 2026 at 11:00 AM
LOCAL TIME via video/phone conference call. Bidder representatives can request to view the public bid
opening by emailing Phillip Pecoraro (ppecoraro@buffalony.gov) before 5:00 PM on Tuesday, April 28, 2026.
A meeting invitation will be sent to all requestors prior to the bid opening time.
Proposal documents can be viewed and ordered at www.avalonbuff-planroom.com in the Public Jobs section.
If you do not have internet access or have questions about ordering from the website, please contact Avalon
Document Services at (716) 995-7777. Proposal documents may be obtained from Avalon Document
Services, 40 La Riviere Dr, Suite 150, Buffalo, NY 14202, upon a non-refundable payment of FIFTY-EIGHT
DOLLARS ($58.00) per set. Payment can be submitted only by company check or money order made payable
to the City of Buffalo Department of Public Works. NO CASH AND NO PERSONAL CHECKS.
Addenda will be emailed from Avalon Document Services to Bidders listed on the official Plan Holders List.
Bidders must acknowledge receipt of all Addenda by securely stapling in place all addenda within the front or
back covers of the proposal book. All Addenda so issued shall become part of the Contract Documents.
The City of Buffalo will not be responsible for full or partial set of Contract Documents, including any Addenda
obtained from any other source. The City of Buffalo reserves the right to reject any and all bids and to waive
any informalities therein.
PRE-BID MEETING
A pre-bid meeting will be held via video meeting/conference call on WEDNESDAY, APRIL 16, 2026, AT 10:00
AM where M/WBE compliance and Section 3 requirements will be reviewed. Bidder representatives must
contact William Ratka, P.E. at wratka@didonato.cc via email before 5:00 PM on Tuesday, April 15, 2026
to be added to the meeting invitation. An invitation will be sent to all requestors by 9:30 AM on the day of
the meeting. Please ensure that a responsible representative from your organization attends this meeting.

Questions regarding the Contract Documents should be directed to Phillip Pecoraro at
ppecoraro@buffalony.gov. Bidders shall promptly notify Phillip Pecoraro at ppecoraro@buffalony.gov of any
errors, omissions, conflicts or ambiguity within the Contract Documents. No questions or inquiries regarding
this bid will be accepted within three (3) business days prior to the bid opening.
This project is being carried out with financial aid from the Community Development Block Grant (CDBG) from
the United States Department of Housing and Urban Development (HUD). Bidders must comply with HUD’s
regulations in 24 CFR Part 75, which implement Section 3.
Each bidder’s attention is called to the General Municipal Law, which requires a bidder’s Certification of
Non-Collusion. Copies of such Certificates are part of the Proposal Form and, unless complied with, the bid
will not be accepted.
Pursuant to New York State Department of Labor (NYSDOL) requirements for public work projects:
Contractors and Subcontractors need to register before submitting any new bids or commencing new
work on a covered project on or after December 30, 2024. NYSDOL encourages all contractors and
subcontractors to register as soon as possible to obtain a Certificate of Registration to avoid negatively
impacting a bidding period or project schedule. Proof of Certificate of Registration must be submitted
with each bid.
This agreement is for services related to a project that is subject to the Build America, Buy America Act
(BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58.
Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this
project must be produced in the United States, as further outlined by the Office of Management and Budget’s
Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal
Financial Assistance Programs for Infrastructure, April 18, 2022.
BIDDERS MUST SUBMIT PRIOR TO AWARDING OF A CONTRACT A STATEMENT INDICATING THAT
THEY WILL WORK TOWARD A MINORITY WORKFORCE GOAL OF 25% AND A WOMEN WORKFORCE
GOAL OF 5%. IN ADDITION, A STATEMENT MUST BE SUBMITTED PRIOR TO THE AWARDING OF A
CONTRACT INDICATING THAT THE BIDDER WILL WORK TOWARD A BUSINESS UTILIZATION GOAL
FOR MINORITY BUSINESS ENTERPRISE OF 25% AND WOMEN BUSINESS ENTERPRISE OF 5%.
All bidders shall, with their bid, submit a statement committing to providing apprenticeship training
opportunities to workers, as well as details of workforce diversification recruiting programs directed at
attracting candidates to fill positions to meet such requirements. Any bid received without this statement may
be deemed as non-responsive and rejected.
