ADVERTISEMENT FOR BIDS
The Howard-Cooper County Regional Port Authority will receive Bids for Grain Updates Project 2
until Friday, May 8, 2026 at 11:00 a.m. local prevailing time, at the Port Office, 609 Main Street,
Boonville, MO 65233 at which time and place all bids will be publicly opened and read aloud.
Bids are advertised as follows: Project will consist of removing and replacing reclaim augers and
conveyors for bins #1-#3 as well as the receiving pit conveyor. The receiving pit conveyor will be updated
to a capacity of 15,000 BPH. The reclaim conveyors will be updated to a capacity of 10,000 BPH. The
current bucket elevator cannot support any capacity greater than 6,500 BPH. The HCPA will be updating
the bucket elevator at later date. The upgraded equipment will need to have the capacity reduced using
different pulley combinations to slow the equipment to a capacity of 6,500. If this cannot be accomplished
using a simple pulley change it must be noted in the bidder's final bid. The full capacity and 6,500
capacity pulley combinations for each piece of equipment must be included. Project includes removal of
existing equipment. Project also includes alternate bids for distributor and electrical upgrades.
A pre-bid conference is not scheduled for this project.
Contract documents including plans and specifications may be obtained electronically at no charge at
www.klingnerplanroom.com. Bidders may call the office of Klingner & Associates, P.C. at (217) 223-
3670 for instructions. Printing and shipping costs for hard copies are the responsibility of the Contractor.
You must register with City Blue as a prime bidder or sub bidder to receive addendums and notices
relative to the bid.
A certified check or bank draft, payable to the order of Howard-Cooper County Regional Port
Authority, negotiable U.S. Government bonds (at par value) or a satisfactory Bid Bond executed by the
Bidder and an acceptable surety in an amount equal to five percent (5%) of the total Bid shall be
submitted with each Bid.
Attention is called to the fact that no less than the minimum salaries and wages as set forth in the
Contract Documents must be paid on this project, and that the Contractor must ensure that employees
and applicants for employment are not discriminated against because of their race, color, religion, sex or
national origin.
The Howard-Cooper County Regional Port Authority reserves the right to reject any or all Bids or to
waive any informality in the bidding.
Bids may be held by the Howard-Cooper County Regional Port Authority for a period not to exceed 45
days from the date of the opening of Bids for the purpose of reviewing the Bids.

INSTRUCTIONS TO BIDDERS
1.0 DEFINED TERMS
1.01 Terms used in these Instructions to Bidders will have the meanings indicated in the EJCDC
General Conditions (C-700 2013 Edition) and Supplementary Conditions. Additional terms used in these
Instructions to Bidders have the meanings indicated below which are applicable to both the singular and
plural thereof:
A. Bidder--The individual or entity who submits a Bid directly to OWNER.
B. Issuing Office--The office from which the Bidding Documents are to be issued and
where the bidding procedures are to be administered.
C. Successful Bidder--The lowest responsible Bidder submitting a responsive Bid to whom
OWNER (on the basis of OWNER's evaluation as hereinafter provided) makes an award.
2.0 COPIES OF BIDDING DOCUMENTS
2.01 Complete sets of the Bidding Documents in the number and for the deposit sum, if any, stated in
the Advertisement to Bid, may be obtained from the Issuing Office. The deposit will be refunded to
document holders of record who return the bidding Documents in good condition within thirty days after
opening of Bids unless otherwise noted in the Advertisement or Invitation to Bid.
2.02 Complete sets of Bidding Documents must be used in preparing Bids; neither OWNER nor
ENGINEER/ARCHITECT assume any responsibility for errors or misinterpretations resulting from the use
of incomplete sets of Bidding Documents.
2.03 OWNER and ENGINEER/ARCHITECT in making copies of Bidding Documents available on the
above terms do so only for the purpose of obtaining Bids on the Work and do not confer a license or grant
for any other use.
3.0 QUALIFICATIONS OF BIDDERS
3.01 No requirement in this Article 3 to submit information will prejudice the right of Owner to seek
additional pertinent information regarding Bidder's qualifications prior to the bid date/opening.
3.02 Bidder is advised to carefully review those portions of the Bid Form requiring Bidder's
representations and certifications.
4.0 SITE AND OTHER AREAS; EXISTING SITE CONDITIONS; EXAMINATION OF SITE; OTHER
WORK AT THE SITE
4.01 The Site is identified in the Bidding Documents. By definition, the Site includes rights-of-way,
easements, and other lands furnished by Owner for the use of the Contractor. Any additional lands
required for temporary construction facilities, construction equipment, or storage of materials and
equipment, and any access needed for such additional lands, are to be obtained and paid for by
Contractor.
4.02 Reports of explorations and tests of subsurface conditions at or contiguous to the Site may have
been used by the ENGINEER/ARCHITECT in preparing the Bidding Documents. Those reports and

drawings are not part of the Contract Documents, but the "technical data" contained therein upon which
Bidder is entitled to rely as provided in the General Conditions. Bidder is responsible for any
interpretation or conclusion Bidder draws form any "technical data" or any other data, interpretations,
opinions or information contained in such reports or shown or indicated in such drawings.
4.03 Information and data shown or indicated in the Bidding Documents with respect to Underground
Facilities at or contiguous to the Site is based upon data and information furnished to the OWNER and
ENGINEER/ARCHITECT by owners of such Underground Facilities, including OWNER, or others.
5.0 BIDDER'S REPRESENTATIONS
It is the responsibility of each Bidder before submitting a Bid to:
A. Examine and carefully study the Bidding Documents and any data and reference items
identified in the Bidding Documents;
B. Visit the Site to become familiar with local and Site conditions that may affect cost,
progress, performance or furnishing of the Work;
C. Become familiar with and satisfy itself as to all Laws and Regulations that may affect
cost, progress, and performance of the Work;
D. Carefully study all: (1) reports of explorations and tests of subsurface conditions at or
adjacent to the Site and all drawings of physical conditions relating to existing surface or
subsurface structures at the Site, and (2) reports and drawings relating to Hazardous
Environmental Conditions, if any, at or adjacent to the Site.
E. Become aware of the general nature of the work to be performed by OWNER and others
at the Site that relates to the Work as indicated in the Bidding Documents;
F. Promptly give ENGINEER/ARCHITECT written notice of all conflicts, errors, ambiguities
or discrepancies that Bidder discovers in the Bidding Documents and confirm that the
written resolution thereof by Engineer is acceptable to Bidder;
G. Determine that the Bidding Documents are generally sufficient to indicate and convey
understanding of all terms and conditions for the performance and furnishing of the Work;
and
H. Agree that the submission of a Bid will constitute an incontrovertible representation by
Bidder that Bidder has complied with every requirement of this Article, that without
exception the Bid and all prices in the Bid are premised upon performing and furnishing
the Work required by the Bidding Documents.
6.0 PREBID CONFERENCE
6.01 A pre-bid conference is not planned for this project.

7.0 INTERPRETATIONS AND ADDENDA
7.01 All questions about the meaning or intent of the Bidding Documents are to be submitted to
ENGINEER/ARCHITECT in writing. Interpretations or clarifications considered necessary by the
ENGINEER/ARCHITECT in response to such questions will be issued by Addenda mailed or delivered to
all parties recorded by the ENGINEER/ARCHITECT as having received the Bidding Documents.
Questions received less than ten days prior to the date for opening of Bids may not be answered. Only
questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be
without legal effect.
7.02 Addenda may also be issued to clarify, correct, or change the Bidding Documents as deemed
advisable by OWNER or ENGINEER/ARCHITECT.
8.0 BID SECURITY
8.01 A Bid must be accompanied by Bid security made payable to OWNER in an amount of five
percent (5%) of Bidder's maximum Bid price (determined by adding the base bid and all alternates for the
highest priced overall alternate/option) and in the form of a certified check, bank money order, or a Bid
bond (on the form included in the Bidding Documents) issued by a surety meeting the requirements of
Paragraphs 6.01 and 6.02 of the General Conditions
8.02 The Bid security of the apparent Successful Bidder will be retained until OWNER awards the
contract to such Bidder, and such Bidder has executed the Contract Documents, furnished the required
contract security, and met the other conditions of the Notice of Award, whereupon the Bid security will be
released. If the Successful Bidder fails to execute and deliver the Contract Documents and furnish the
required contract security within 15 days after the Notice of Award, OWNER may consider Bidder to be in
default, annul the Notice of Award, and the Bid security of that Bidder will be forfeited. Such forfeiture
shall be OWNER's exclusive remedy if Bidder defaults.
8.03 The Bid security of other Bidders that OWNER believes to have a reasonable chance of receiving
the award may be retained by OWNER until the earlier of seven days after the Effective Date of the
Contract or 61 days after the Bid opening, whereupon Bid security furnished by such Bidders will be
released
8.04 Bid security of other Bidders whom OWNER believes do not have a reasonable chance of
receiving the award will be returned within seven (7) days after the Bid opening.
9.0 CONTRACT TIME
9.01 The number of days within which, or the dates by which, the Work is to be substantially
completed and completed and ready for final payment, are set forth in the Agreement.
10.0 LIQUIDATED DAMAGES
10.01 Provisions for liquidated damages, if any, for failure to timely attain Substantial Completion, or
completion of the Work in readiness for final payment, are set forth in the Agreement.
11.0 SUBSTITUTE OR "OR-EQUAL" ITEMS
11.01 The Contract for the Work, as awarded, will be on the basis of materials and equipment specified
or described in the Bidding Documents, and those "or-equal" or substitute or materials and equipment
subsequently approved by ENGINEER/ARCHITECT prior to the submittal of Bids and identified by
Addendum. No item of material or equipment will be considered by ENGINEER/ARCHITECT as an "or-
