INVITATION TO BIDDERS

1. All vendors are encouraged to submit sealed bids via mail to:

Bid envelopes shall be plainly marked On-Call Emergency Sanitary Sewer and Storm Drain Repairs
RFB-PW-2026-029 and only include the sheets identified with the "Return with Bid" watermark.
2. Bids will be publicly open at the Ground Floor Purchasing Office at City Hall on the date shown on the Bid
Schedule below.
3. Each bid must be accompanied by a DEPOSIT in the form certified check, cashier's check or money order, made
payable to the CITY OF NEW ROCHELLE, NEW YORK, in the amount of five percent (5%) of the bid price (CASH
WILL NOT BE ACCEPTED). The City reserves the right to reject any or all bids.
4. Copies of Contract Documents are available for direct download from the City's website at
http://www.newrochelleny.com/bids.aspx under the Bid Opportunities. No fee is associated when obtaining copies
of Contract Documents. Addendums and response to questions are posted to the City's website as well. It shall
be the bidder's responsibility to check for Addendums.
5. Firms qualified and certified as Minority Business Enterprises (MBE) and Women Business Enterprises (WBE)
are strongly encouraged to submit a bid.
6. The City of New Rochelle is a supporter of the Westchester Affirmative Action Equal Employment Opportunity
requirements and agreements. In compliance with Section 3, the City of New Rochelle encourages employment
first of New Rochelle residents.
7. Please note that the Contractor shall pay the higher wage rates of either the prevailing New York State Wage
Rates or Davis Bacon.
8. Pre-Bid Meeting will be held on site on the date specified in the Bid Schedule below. This meeting is not
mandatory but all bidders are encouraged to participate to familiarize with site conditions.
9. Any questions must be submitted via email to idroese@newrochelleny.gov before the due date as specified in
the Bid Schedule below. Questions and answers will be posted in the City's website by the date shown in the Bid
Schedule below.

All contractors and subcontractors submitting bids or performing construction work on public work projects or
private projects covered by Article 8 of the Labor Law are required to register with the New York State Department
of Labor (NYSDOL) under Labor Law Section 220-i.

The law defines a "contractor" as any entity entering into a contract to perform construction, demolition,
reconstruction, excavation, rehabilitation, repair, installation, renovation, alteration, or custom fabrication. The
law defines "subcontractor" as any entity subcontracting with a contractor to perform construction, demolition,
reconstruction, excavation, rehabilitation, repair, installation, renovation, alteration, or custom fabrication, which
is subject to Article 8 of the Labor Law. Contractors are responsible for verifying that any subcontractors they
work with are registered.
All contractors submitting a bid on this procurement must demonstrate registration with the NYSDOL Public Work
Contractor and Subcontractor Registry. Bidders who are not registered at the time of bid submission will be
deemed non-responsive.

Scope of Work

Project Name: On-Call Emergency Sanitary Sewer and Storm Drain Repairs
Location of Work
The work called for under this contract will be located at various locations throughout the City of New
Rochelle. The emergency repairs may occur on any of the City owned Sanitary Sewer or Storm Drain
systems throughout the City of New Rochelle. Both Sanitary Sewer and Storm Drain systems vary in pipe
size diameters and depths.
General Description of Work
* The work called for under this contract consists of furnishing all necessary labor, material, and
equipment for the prompt repair and/or replacement of certain sanitary sewers and storm drains
owned by the City of new Rochelle on an emergency basis, with the total value of $250,000.00 (Two
Hundred Fifty Thousand Dollars and Zero Cents). The term of this contract is for a period of (1) year
commencing on the date of contract execution and terminating one year later from that date. The
contract may be extended by mutual consent of the contractor and the City of New Rochelle for two
(2) additional years in (1) year intervals, with all prices, terms and conditions remaining the same as
the original contract. (Renewal Terms).
* The contractor, in response to this request, shall submit to the Department, the contractor's proposed
percentages for covering overhead costs and profit under this contract. The contract shall be awarded
to the responsible contractor proposing the lowest percentage for overhead and profit. Bidders shall
take note that the City of New Rochelle reserves the right to award the contract to the bidder whose
proposal, after proper and thorough analysis by the City, will serve the best interest to the City of
New Rochelle.
* The basis for payment under this contract will be for the actual and reasonable percentage allowance
as submitted in the contractors bid, to cover overhead costs and profit. Prior to the commencement of
any work, a Time and Material invoice template must be submitted and approved by the City in
accordance with article 25-25.2.
* A bid bond in the amount of 5% shall be required. In lieu of a performance bond or payment bond,
five (2%) percent of all contractor payments will be held for a 60-day period after completion of each
repair.
* The City of New Rochelle reserves the right to do any portion of this work with its own forces or
solicit bids from other contractors is it is in the best interest of the City of New Rochelle.

* Due to the nature of the work, for the duration of the contract the contractor must be able to respond
promptly within six (4) hours after notification as hereinafter provided to make emergency sanitary
sewer and storm drain repairs and replacements, throughout any twenty-four (hour) period, day and
night, seven (7) days a week, including Saturdays, Sundays and holidays, completing the work
within a reasonable time period.
* The contractor shall not subcontract more than forty-nine (49%) of the contractor's bid. All
subcontracted pricing shall be reviewed and approved prior to the start of work. Payment will be
based on the actual and reasonable cost of such subcontracted work, as per article 25-25.3. The City
may require three (3) proposals for such work for review and approval.
* The cost of the Superintendent shall be deemed included in the percent of Overhead & Profit. There
shall be no direct payment for such supervision above the grade of a foreman.
* All necessary direct labor rates of wages actually paid, inclusive of payroll insurances, payroll taxes,
and labor agreement payments, shall be submitted for review and approval prior to the start of work.
Rates shall not include overhead and profit. Contractor shall submit such rates for all classes of labor
expected to be used for the project, in accordance with Prevailing Wage Rates. Contractor will be
allowed to update rates in year two and three that correspondence to Union raises.
* Where the Contractor has excess personnel or excessive or unnecessary equipment on the work site
and is ordered by the engineer to reduce the work force and equipment, no payment will be made for
the excess involved.
* All necessary rates for the maintenance, operation and rental of power operated equipment necessary
for work executed under this contract shall be based upon article 25-25.2.5. Rates shall not include
overhead and profit. Contractor shall submit such rates for review and approval prior to the start of
work. Contractor shall submit such rates for all types of equipment expected to be used for the
project. The cost of equipment characterized as "small tools" is deemed included in the Contractor's
overhead factor and shall not be eligible for separate reimbursement whether contractor-owned or
leased separately. All rates shall be inclusive. This type of equipment generally encompasses items
that are ordinarily required for the performance of the worker's job function, and included but is not
limited to equipment which ordinarily has no licensing, insurance or substantive storage costs
associated with it such as circular and chain saws, impact drills, threaders, benders, wrenches, socket
tools, etc. The rates paid shall be based on the current edition of "AED Green Book, Rental rates and
Specifications for Construction Equipment (Green Book) published by PRIMEDIA Information Inc.
* Contractor shall supply invoices for the actual cost of all materials, inclusive of transportation to the
worksite, necessary for the work.
* Each emergency repair location shall require the filing of a no-fee DPW permit within a
* Normal Work hours shall be in accordance with City of New Rochelle Code or unless otherwise
approved by the engineer. Normal works hours are as follows, Monday thru Friday 8:00AM to
5:00PM, Saturday and Sunday 10:00AM-5:00PM. If work outside the normal working hours is
required, Engineer shall direct.

* Maintenance and Protection of Traffic shall be provided in accordance with section 619 of the
standard specifications, codes, rules and regulations of the State of New York (NYCRR), The
National MUTCD and the NYS Supplement and any provisions contained in the plans and/or
proposal of this contract. This shall include all temporary advanced warning signs, barricades, cones,
barrels, and any other channeling devices and flaggers necessary to perform the work in a safe
manor. With exception of a flagger, which shall be paid for under the same guidelines as all other
laborer, no additional payment shall be made for such items described above and shall be included in
your percentage of Overhead and Profit bid. If the Engineer decides that Police traffic control is
necessary, they shall schedule at no additional cost to the contractor. If additional MPT outside the
typical devices mentioned above are required by the engineer due to the nature of the repair, i.e.,
concrete barriers, message boards, the contractor shall receive compensation.
* Excavations shall be plated at the end of each work day and road reopened. There shall be no staging
of materials and equipment within the City right of way during non-working hours.
* Excavations shall be braced and /or sheeted and dewatered as necessary so that workmen may work
therein safely and efficiently, as set forth in "The Industrial Code-Rule No.23 "Promulgated by the
State of New York-Department of Labor.
* Contractor is expected to perform all work to City of New Rochelle Standard Specifications.

INSURANCE REQUIREMENTS
A. General Requirements
1. Prior to the commencement of Work, the Contractor shall procure and maintain, at its own cost and
expense, the types and amounts of insurance indicated in Schedule A of the General Agreement. Such
insurance shall be maintained through the date of completion of all required Work. The City reserves the
right to increase or decrease the required insurance during the Contract.
2. All insurance required by the Contract shall be obtained at the sole cost and expense of the Contractor;
shall be maintained by insurance carriers licensed and admitted to do business in New York State and
acceptable to the City; shall be primary and non-contributory to any insurance or self-insurance available
to the City; and shall be endorsed to provide written notice be given to the City at least thirty (30) days prior
to the cancellation, non-renewal, or material alteration of such policies.
3. The Contractor shall be solely responsible for the payment of all premiums, deductibles and self-insured
retentions to which such policies are subject. Deductibles and self-insured retentions must be approved by
the City. Such approval shall not be unreasonably withheld. The City reserves the right to withhold portion
of payment until the deductible is satisfied.
4. All required insurance policies shall be maintained with companies that have an A.M. Best rating of an
A/VII, unless prior written approval is obtained from the City's Corporation Counsel. If, during the term
of the policy an insurer's rating falls below A/VII, the insurance must be replaced no later than the renewal
date of the policy with an insurer acceptable to the City.
5. The Contractor shall not take any action or omit to take any action that would suspend or invalidate any
of the required coverages during the period of time such coverages are required to be in effect.
6. Not less than thirty (30) days prior to the expiration date or renewal date, the Contractor shall supply the
City updated replacement certificates of insurance and amendatory endorsements.
8. All insurance policies must be open to inspection and copying by the City upon written request.
B. Workers' Compensation, Employers' Liability, and Disability Benefits Insurance
1. The Contractor shall provide, and shall cause its Subcontractors to provide, Workers' Compensation
Insurance, Employers' Liability Insurance, and Disability Benefits Insurance in accordance with the Laws
of the State of New York on behalf of all employees providing services under the Contract. Pursuant to
General Municipal Law Section 108, this Contract shall be void and of no effect unless the Contractor
maintains Workers' Compensation Insurance for the term of this Contract to the extent required and in
compliance with the New York State Workers' Compensation Law.
2. For Workers' Compensation Insurance, the Contractor shall submit one of the following forms: C-105.2
