THIS IS A PROJECT LABOR AGREEMENT (PLA) SURVEY ONLY. This is a SPECIAL NOTICE. No proposals are being requested or accepted with this PLA notice.
This is a SPECIAL NOTICE only. The U.S. Army Corps of Engineers Seattle District is requesting comments from the construction community addressing use of a PLA for an upcoming project for the Construction of the Special Tactics Complex for the Air National Guard in Portland, Oregon.
DESCRIPTION OF WORK:
Located at Portland Air National Guard Base, OR, this project is to construct a multi-building Special Tactics Complex for the 125 Special Tactics Squadron (STS). The project will consolidate the STS functions from several older, inadequate facilities into a centrally located complex to support Unit Command, Squadron Operations, Communications, Dive Locker, Human Performance Program, Aircrew Flight Equipment, Combat Arms Training and Maintenance, Simulators, Logistics, Mission Alert Storage, Individual Equipment Storage, Vehicle Maintenance, and Vehicle Storage.
Facility requires specialized spaces to support assigned simulators and climbing tower. Industrial functions such as warehouse, vehicle maintenance facility, hazardous material storage and vehicle storage shelter shall be incorporated into a common complex and vehicle yard. This project constructs four buildings with the primary building being approximately 56,000 square foot two-story building to include the Human Performance function and the Individual Equipment/Mission Alert Equipment Storage function and associated support rooms, storage rooms, restrooms/showers/locker areas, utility rooms, etc. The Vehicle Maintenance Shop (~2,800 SF), Vehicle Storage Shed (~14,000 SF), and Hazardous Storage Building (~275 SF) are separate buildings. The scope includes associated sitework, utilities, landscaping, and pavements as indicated on the Construction Documents. The complex shall not exceed 73,475 SF. Complete all work within 540 days of notice to proceed (NTP).
The Portland Air National Guard Base uses the Defense Biometric Identification System (DBIDS) for all visitor passes and access credentials. It is your duty, if you are bringing someone onto this facility, to ensure they are prepared and in compliance with the standing DoD and local policy for installation access.
MAGNITUDE:
In accordance with DFARS 236.204, the magnitude of the estimated cost of construction (ECC) range for this project is between $25,000,000 and $100,000,000.
FACTORS TO BE CONSIDERED:
Some of the factors that may be considered regarding PLA use are:
(i) The project will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades.
(ii) There is a shortage of skilled labor in the region in which the construction project will be sited.
(iii) Completion of the project will require an extended period of time.
(iv) Project labor agreements have been used on comparable projects undertaken by Federal, State, municipal, or private entities in the geographic area of the project.
(v) A project labor agreement will promote the agency's long term program interests, such as facilitating the training of a skilled workforce to meet the agency's future construction needs.
(vi) Any other factors that the agency decides are appropriate.
FEDERAL ACQUISITION REGUATIONS (FAR) 22.502 DEFINITIONS:
Project labor agreement means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U. S.C. 158(f).
FAR 22.503 – POLICY:
PLA are a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of PLAs in connection with large-scale construction projects.
An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a PLA with one or more labor organizations if the agency decides that the use of PLAs will:
Advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; Be consistent with law. (Refer also to FAR 52.222-33 Notice of Requirement for PLA and FAR 52.222-34 PLA).
