REQUEST FOR INFORMATION
1. General Information
1.1. Purpose
The New Hampshire Lottery and Gaming Commission (NHLGC) is seeking responses to
this Request for Information (RFI) from sports wagering entities on their experiences,
structures, financial models, and best practices operating in states with multiple licensed
mobile and/or retail sports wagering operators.
1.2. Objective
The objectives of this RFI are to:
* Understand the potential impact of transitioning to a multiple operator model
(or "multi-operator" model) for mobile sports betting within New Hampshire.
* Understand the potential impact of moving to a multi-operator model for
retail sports betting within New Hampshire.
* Gather information on multi-operator sports wagering for legislative and
executive personnel to inform decisions concerning regulatory frameworks,
legislation, or competitive procurements.
1.3. Background
The New Hampshire Lottery and Gaming Commission ("NHLGC" or "Agency") is
responsible for the oversight of gaming activity within the State of New Hampshire
pursuant to RSA 284 and RSA 287-D through 287-J. This includes the regulation of
traditional lottery, bingo, Lucky 7, keno, iLottery, charitable gaming (including games of
chance, historic horse racing, and video lottery terminals), mobile and retail sports betting,
fantasy sports, simulcast wagering, and advance deposit wagering.
Mobile and retail sports wagering were signed into law in New Hampshire in 2019,
codified in RSA 287-I. The law required a competitive bid process to select agents to
provide sports betting with the approval of the Governor and Executive Council. As a
result of that process, DraftKings was selected as the NHLGC's sole agent for mobile and
retail sports wagering. The current contract between the parties commenced on
November 25, 2019, and, following a recent two-year contract extension, will expire on
June 30, 2028.
While New Hampshire has had tremendous success with the single operator model, key
stakeholders wish to consider all opportunities to maximize sports wagering revenues for
the state and provide an excellent product to players. To that end, there is interest in the
revenue share models of multi-operator jurisdictions, the product offerings made available
in those jurisdictions, and the experience of operators competing with other companies in
the regulated sports betting industry. The information gathered in this process will be
utilized to prepare a report for the executive branch and potentially legislators in the state
to consider in evaluating proposed contract actions, potential procurements, and long-
term planning goals for legal sports wagering in New Hampshire.

2. RFI Explanation and Questions
2.1. Information Requested
2.1.1. The State is seeking a better understanding in the areas listed below
and requests interested entities to provide responses to the following
questions, as applicable.
2.1.2. Respondents may respond to some or all of the questions below.
Responses to all questions are encouraged but not required. Please
label responses according to the question being addressed.
2.2. Questions
Q1. Please provide a brief overview of your company including:
i. The legal name of the company, organization, or entity submitting
the response.
ii. The name, title, telephone number, and e-mail address of the
person who will serve as the respondent's representative for all
matters relating to the RFI.
iii. A brief corporate overview of the entity's experience in the gaming
industry, including years in operation, types of sports wagering
offered, and a list of jurisdictions where the entity has operated
within the last five years.
Q2. Please describe your current active operations for mobile sports betting in
the U.S. by listing each jurisdiction where your company is currently
licensed/operating mobile sports wagering and years active.
Q3. For each jurisdiction provided in Q2, please describe the structure of
associated fees and licensing costs (as applicable):
i. Initial licensing or application fees.
ii. Annual/renewal fees.
iii. Server/in-state data hosting fees.
iv. Bond, surety, and/or insurance minimums.
v. Other regulatory or administrative fees.

vi. Identify how many mobile sports wagering operators are operating
in the jurisdiction as of the date of your response to this RFI.
Q4. For each jurisdiction identified in Q2, please specify the revenue owed to
the state (tax, revenue share, etc.) and all allowable deductions prior to
calculation of that amount, i.e. explain how gross and adjusted/net gaming
revenue from mobile sports betting is calculated, deductions for federal
excise tax, promotions, etc.
Q5. For each jurisdiction provided in Q2, please provide your financial
performance results for mobile sports betting for the past three years:
i. Handle
ii. GGR and AGR/NGR
iii. Amount of revenue paid to the state
iv. Market share percentage
v. Player metrics:
a. Active users (preferably by month)
b. Average spend per user
Q6. For each jurisdiction provided in Q2, please provide information on
promotional spending, limitations, and methods:
i. Annual promotional spend as percentage of GGR or handle.
ii. Common methods of player promotion (e.g., risk-free bets, deposit
matches, odds boosts, loyalty programs).
iii. Common media buys (e.g. tv, radio, affiliate marketing)
iv. Regulatory limitations (e.g., caps on bonuses, restrictions on
targeting, opt-out rules).
v. Impact on player acquisition/retention in crowded markets.
vi. Examples of state-specific rules affecting wagering offers (e.g., no
misleading "free" claims, transparent terms).

Q7. For each jurisdiction identified in Q2, what reports are provided to the
regulator to track performance, compliance, and cybersecurity
considerations? These reports include, but are not limited to, SOC-1
reports, financial analyses, industry certifications (e.g. GLI-33), and
financial result reporting. For each deliverable, please identify the cadence
of providing such information to the regulator.
Q8. For each jurisdiction provided in Q2, what is the approximate turnaround
time for the regulator's approval of requested updates to the following:
i. Internal controls
ii. House rules
iii. Major software changes (e.g. requiring a new GLI 33 certification)
Q9. For each jurisdiction identified in Q2, what access (including read-only)
does the regulator have to the following:
i. Player account information
ii. Financial results (either pre-generated or searchable)
iii. Ticket lookup
iv. Test accounts
Q10. For each jurisdiction identified in Q2, please describe the process for
seeking and obtaining approval of new events for wagering.
Q11. For each jurisdiction identified in Q2, please describe the process for
handling player disputes, including what entity has final decision-making
authority (e.g. operator, regulator, or courts).
Q12. Please describe the implementation process for your solution:
i. Once licensed, what has been the average duration it has taken for
you to implement mobile sports betting into the new jurisdiction?
ii. For multiple operator jurisdictions, were all operators approved for
launch on the same day or was it rolling launch based on date of
approval?

including any templates utilized for any data provided.

4. Entity Questions and Answers
4.1. Entity Questions
4.1.1. All questions about this RFI, including but not limited to requests for
clarification, additional information, or any changes to the RFI must be
made in writing, citing the RFI page number and part or subpart, and
submitted to the points of contact identified in Subsection 3.1.1.
4.1.2. The State may consolidate or paraphrase questions for efficiency and
clarity. Questions that are not understood will not be answered.
Statements that are not questions will not receive a response.
4.1.3. The State will not acknowledge receipt of questions.
4.1.4. The questions may be submitted by e-mail; however, the State is not
responsible for assuring accurate and complete e-mail transmissions.
4.1.5. Questions should be received by the deadline given in Subsection 3.2.,
RFI Timetable.
4.2. State Answers
4.2.1. The State intends to issue responses to properly submitted questions
by the deadline specified in Subsection 3.2., RFI Timetable. Oral
answers given are non-binding. Written answers to questions
submitted will be posted online at:

This date may be subject to change at the State's discretion.
4.3. RFI is not an RFP
4.3.1. This RFI is for informational purposes only and is not intended to result
in a contract or Entity agreement with any respondent. This RFI is not
a Request for Proposals, Bids, or Applications; formal proposals, bids,
or applications will not be considered in the RFI process and shall be
discarded. The State is seeking Entity community insight and
information concerning business, functional, operational, and technical
requirements before considering the publication of a Request for
Proposal (RFP).
4.3.2. This RFI does not commit the State to publish an RFP or award a
contract. The issuance of an RFP, as a result of information gathered
from these responses, is solely at the discretion of the State. If an RFP
is issued, it will be open to all qualified Entities, regardless of whether
those Entities choose to submit a response to this RFI. This RFI is not
and shall not be construed to be a pre-qualification process.

4.4. Entity Presentations and Discussions
4.4.1. The State may request Entities to make presentations based upon
their submission at the State's discretion. There is no guarantee that
an Entity will be asked to provide a presentation. Any and all costs
associated with a presentation shall be borne entirely by the Entity.
Entities may be requested to provide demonstrations to expound upon
their responses and proposed solutions. Entity presentations are for
informational purposes only and do not confer any additional status
upon an Entity for any future or potential Request for Proposals or
contract.
4.5. RFI Amendment
4.5.1. The State reserves the right to amend this RFI as it deems appropriate
prior to the submission deadline on its own initiative or in response to
issues raised through Entity questions. In the event of an amendment
to the RFI, the State, at its sole discretion, may extend the submission
deadline. The amended language will be posted on the NHLGC
compliance website.
4.6. Submission Instructions
4.6.1. Respondents are asked to examine all documentation and other
requirements.
4.6.2. The State requests that submissions conform to all instructions,
conditions and requirements included in the RFI.
4.6.3. Submissions should be received by the date and time specified in the
RFI Timetable, Subsection 3.2. Submissions may be emailed to the

4.7. Non-Collusion
4.7.1. Each Entity or company must offer its own response to this RFI. The
State will not accept joint submissions, and each response shall be
deemed to belong to the Entity submitting the response and prepared
without collusion with other Entities.
4.8. Prohibition on Collaborative Submissions
4.8.1. Submissions may only be submitted by one organization.
4.9. Property of the State
4.9.1. All material property submitted and received in response to this RFI
will become the property of the State and will not be returned to the
Entity. The State reserves the right to use any information presented
in any submission provided that its use does not violate any copyrights
or other provisions of law.
4.10. RFI Response Withdrawal
4.10.1. Prior to the Closing Date for receipt of submissions, a submission may
be withdrawn by submitting a written request for its withdrawal to Sole
Point of Contact identified in Section 3.1.1.
4.11. Public Disclosure
4.11.1. Any information submitted as part of a response to this RFI may be
subject to public disclosure under RSA 91-A. In addition, in
accordance with RSA 9-F:1, in the event an RFP is published by the
State and a contract awarded, that information will be made accessible
to the public online via the website Transparent New Hampshire
(www.nh.gov/transparentnh/). Business financial information and
proprietary information such as trade secrets, business and financial
models and forecasts, and proprietary formulas are exempt from
public disclosure under RSA 91-A:5, IV, subject to the provisions of
4.12.2 and 4.12.3.
4.11.2. Insofar as an Entity seeks to maintain the confidentiality of its
confidential commercial, financial or personnel information, the Entity
must clearly identify in writing the information it claims to be
confidential and explain the reasons such information may be
considered confidential. This may be done by separate letter
identifying by page number and RFI section number the specific
information the Entity claims to be exempt from public disclosure
pursuant to RSA 91-A:5. The State is not responsible for identifying or

designating information in an RFI response as confidential on behalf
of any respondent and specifically disclaims any such responsibility.
4.11.3. Each Entity acknowledges that the State is subject to the Right-to-
Know Law New Hampshire RSA Chapter 91-A. The State shall
maintain the confidentiality of the information designated by the
responding party as confidential insofar as it is consistent with
applicable laws or regulations, including but not limited to New
Hampshire RSA Chapter 91-A. In the event the State receives a
request for the information identified by an Entity as confidential, the
State shall notify the Entity and specify the date the State intends to
release the requested information. Any effort to prohibit or enjoin the
release of the information shall be the Entity's responsibility and at the
Entity's sole expense. If the Entity fails to obtain a court order from a
court of competent jurisdiction enjoining the disclosure, the State may
release the information on the date the State specifies in their notice
to the Entity without incurring any liability to the Entity. The Entity is
strongly encouraged to provide a redacted copy of the Proposal.
4.12. Liability
4.12.1. Entities agree that in no event shall the State be either responsible
for or held liable for any costs incurred by an Entity in the preparation
or submittal of or otherwise in connection with their submission.
